HomeMy Public PortalAbout316CITY OF MEDINA ORDINANCE NO.316 AN ORDINANCE AMENDING ORDINANCE NOS. 305 AND 311, INTERIM ORDINANCES RESTRICTING DEVELOPMENT OF CERTAIN RESIDENTIAL PROPERTIES IN THE CITY. THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS: Section 1. Background. 1.01. On December 15, 1998, the city of Medina (the "City") adopted Ordinance No. 305, an interim ordinance concerning development of the land commonly known as the Elwell Property. 1.02. On October 5, 1999, the City adopted Ordinance No. 311, an interim ordinance declaring a moratorium on development within the urban commercial, urban commercial-1, uptown Hamel and a residential parcel known as the Holasek property. The ordinance also extended the duration of the previous moratorium on the Elwell property. 1.03. The City's purpose in adopting the interim ordinances was to protect the on -going planning process associated with the amendment of the City's comprehensive plan. The City needed an opportunity to adopt or modify its official controls as they related to designated areas, including the Elwell and Holasek properties, two large parcels which the City believed posed special development challenges and opportunities. 1.04. Since the adoption of the interim ordinances, the City has been engaged in the process of finalizing its comprehensive plan and has initiated a process to consider various amendments to its zoning ordinance and other official controls. This effort has included the adoption of an amendment to the zoning ordinance establishing the new residential P.U.D. zoning districts. The P.U.D. 1 zone is intended to apply to the Elwell property. The P.U.D 2 zone is intended to apply to the Holasek property. The P.U.D ordinance establishes the framework under which development of each site may proceed. The ordinance establishing the P.U.D. 1 and P.U.D. 2 zones was adopted by the City on May 16, 2000 and will be effective upon publication. Section 2. Findings. • 2.01. In light of the conclusion of the planning process regarding the Elwell and Holasek properties, it is hereby found and determined by the City that said parcels no longer need to be subject to any moratorium on development. It is hereby declared that the Elwell and Holasek properties, which areas are depicted on Exhibit A attached hereto, are no longer subject to the moratoria imposed by Ordinance No. 305 and Ordinance No. 311, including any restrictions resulting from portions of these properties lying within 1000 feet of other lands subject to development restrictions. City staff may henceforth accept and process applications regarding development on these properties, subject to such restrictions and processes generally imposed by the City's ordinances and other law. Section 3. Effective Date. 3.01. This ordinance shall take effect upon its adoption and publication. Adopted by the city council of the city of Medina this 16th day of May, 2000.
