HomeMy Public PortalAbout2021-03-15 DRAFT SP ACT 6431Section 1. (a) Notwithstanding section 11 of chapter 138 of the General Laws or any
other general or special law to the contrary, the licensing authority of the city
known as the Town of Watertown may convert up to 7 existing licenses for the sale
of wine and malt beverages to be drunk off the premises, under section 15 of said
chapter 138, to licenses for the sale of all alcoholic beverages to be drunk off the
premises under said section 15 of said chapter 138.
(b) Notwithstanding section 17 of chapter 138 of the General Laws or any other
general or special law to the contrary, the licensing authority of the city known as
the Town of Watertown may convert up to 7 existing licenses issued under section
12 of said chapter 138 for the sale of wine and malt beverages to be drunk on the
premises to a license for the sale of all alcoholic beverages to be drunk on the
premises. The license shall be subject to all of said chapter 138, except said section
17.
(c) In the event a license converted under section (a) or (b) is cancelled, revoked or
is no longer in use, it shall be returned physically, with all of the legal rights,
privileges and restrictions pertaining thereto, to the licensing authority and the
licensing authority. If a license converted under section (a) or (b) is hereafter
transferred in any way, except as noted in section (d), the license shall no longer be
eligible for the status obtained pursuant to this act and shall revert to it's prior
status.
(d) The licensing authority shall not approve the transfer of the license granted
under section (a) or (b) to any other location, but it may grant the license to a new
applicant at the same location if the applicant files with the licensing authority a
letter from the department of revenue and a letter from the department of
unemployment assistance indicating that the license is in good standing with those
entities and that all applicable taxes, fees, and contributions have been paid.
(e) An applicant seeking a conversion under either section (a) or (b) shall submit an
application for approval to the licensing authority within 2 years of the passage of
this act. Upon receipt of an application, the licensing authority has 60 days to
render a decision or said application is deemed approved.
(f) The City known as the Town of Watertown shall have the authority to increase
the annual licensing fee for licenses obtained pursuant to this act by no more than
50% of the annual cost of an all alcoholic beverage license.
Section 2. (a) This act shall take effect upon its passage.
