Public Complaint Rules of Procedure

follows
1. Copies of Complaint Intake Forms of

Z. Upon review of the Complaint, the Complainant
will be advised in writing whether they may address the
Commission at length, or whether a time -limit will be set on
such comments.
3. Staff shall be directed to advise Complainant
of the disposition in a mailed Notice of Hearing, including a
copy of the complaint, to the complainant and to e
Sheriff's Deputies to appear and address the Comm ssion if
they wish.
4. The burden of proof to establish misconduct is
on the Complainant. Even so, the Commission has no powers to
do other than listen to the Complainant and make
recommendations, and /or advise the City Council. The
Commission may also choose to forward its recommendations to
the Sheriff's Department. The complainant may call
witnesses, as may the Deputies, but time to prese t evidence
shall be limited to no more than 90 minutes, except under
unusual circumstances agreed to by a majority of the
Commissioners.
5. Since there is no formal "hearing" process,
there will be no cross examination of either the omplainant,
any witnesses or Deputies. The Commissioners may ask
questions of any party as a point of information, or to gain
elaboration of points made.
6. Both the Complainant and the named peputy, as
well as the Sheriff's Department, have a right to oopies of
any materials generated as a result of complainan 's public
address to the Commission.

LAW ENFORCEMENT REVIEW BOARD
Meeting of January 27, 1993
The regular meeting of the Law Enforcement Review Board was held on
January 27, 1993, in the City Hall Council Chambers. (The agenda
was duly posted as prescribed by the Brown Act.)
The meeting was called to order at 6:28 p.m. by Chairperson Robert
Downs.
The pledge of allegiance was conducted by Robert Downs.
Members in attendance were: Don Brantley, Elizabeth Dixon, Robert
Downs, and David Willis. Hilario Esparza was absent.
Staff members in attendance were: Deborah Jackson and Pat Alvarez.
Also present were Sheriff's Department Lt. Jurado and Journal
Newspaper reporter John Wagner.
The minutes of the December 23, 1992 regular meeting were approved
as distributed.

Public Orals
- John Wagner, reporter from the Wave Newspaper, asked the
commissioners questions relative to the commission:
1. Q. How many residents are usually present at commission
meetings?
A. There has been an average of two to three persons at
each commission meeting.
2. Q. Have all complaints ran their complete course: i.e.
given to Council, then referred to Sheriff's
Department, and responded back to the complainant?
A. A representative from the Sheriff's Department is
always present at commission meetings. Copies of
complaints are forwarded both to the City
Councilmembers and to the Sheriff's Department
Captain. The Sheriff's Department in turn, respond to
the complainant. The commission is currently in the
process of designing a follow -up response letter to be
sent to every person who files a complaint with the
Law Enforcement Review Board.
3. Q. Do residents have to sign up in order to be heard by
the board?
A. No, they just come to the meeting and speak.

o Hilario Esparza - Chiropractor
Lt. Jurado stressed that the public needs to be educated on
how the Sheriff's Department works. Residents should be
encouraged to file complaints relative to law enforcement
services with the Sheriff's Department first, then, if they
are not satisfied, they should come to the Law Enforcement
Review Board.
Board Members' Orals
. - David Willis stated that it is important that people are aware
of the board's functions.
Elizabeth Dixon asked how are Sheriff's Deputies assigned to
different areas in the city? Lt. Jurado answered that they are
first assigned to work in the jail, they are asked where they
would like to transfer to.
Elizabeth Dixon also asked what was the status of the bicycle
patrol project. Lt. Jurado said that the officers have
already been selected, and they are in the currently being
trained.
- Robert Downs attended the California Contract Cities
Commissioner's Workshop that was held on January 9, 1993 in
the City of Commerce. He thought the workshop was very
informative and beneficial.
There being no further business, the meeting adjourned at 7:00 p.m.
to the February 24, 1993 regular meeting.
