HomeMy Public PortalAbout03-07-13 agenda*'1 1 The Agenda Meeting of the Mayor and Council of the Borough of hem MiTIM Carteret preceding the Regular Meeting March 21, 2013, was held on Thursday, March 7, 2013, 6:00 P.M., Council Chambers, March 7, 2D13 Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. The following were noted present: PRESENT Mayor Daniel J. Reiman Councilmember Vincent Bellino Jorge Diaz " Dennis DiMascio " Randy Krum " Susan Naples " Joseph W. Sitarz Also noted present was Municipal Clerk, Kathleen M. Barney and Borough Attorney, Robert Bergen. The Clerk stated that on January 3, 2013, the 2013 Annual Notice SDUB -E f OF M= was mailed to The Home News Tribune, The Star Ledger and NMCE posted on the Bulletin Board. Notice was published in The Home News Tribune and The Star Ledger on January 8, 2013. The meeting was opened with a minute of silent prayer and the Silent Prayer/ Pledge of Allegiance led by Mayor Daniel J. Reiman, Pledge of Allegiance 1 MRH 7, 2013 MPUIF3 FOR Upon MMS &C by Councilmembers Diaz and Krum and unanimous APPRWAL affirmative vote of the full Council present, the Minutes of February 7 and 21, 2013 were approved, transcribed and engrossed by the Clerk. CRDIWI CE Mayor Reiman read the titile of Ordinance #13 -1 into the record #13-1 and then asked if there were any questions on the ordinance. Di_azussion MVor Reinm Mayor Reiman explained Ordinance #13 -1 is in reference to the AFSCME local 2291, which is the Blue Collar Contract, which allows for a five (5) year extension of the contract at a 2% increase per year for top rate employees and it spans the number of steps from ten (10) to fifteen (15) and requires an increase in the co- insurance up to a maximum of 34% of the health care costs and an increase in the prescription co -pay from five (5) and ten (10) dollars to ten (10), fifteen (15) and twenty -five (25) dollars, which is in line with the Fireman and Management Contracts and then asked if there were any questions on the ordinance. Councilmember Krum questioned if steps means years. Mayor Reiman said in essence yes, explaining all top rate employees are on step ten (10) and this would increase then to fifteen (15) but this doesn't necessarily equate to a year because under two (2) contracts ago it used to just be a rate and now with the third contract negotiated we put in fifteen (15) steps. Upon individual roll call vote (7RDRWU #13 -1 Councilmembers Bellino, Diaz, DiMascio, Krum, Naples and Sitarz voted in the Affirmative. "AN ORDINANCE TO AMEND ORDINANCE #71 -9 ESTABLISHING First Readii SALARY SCHEDULES AND FIXING THE MATTER OF PAYMENTS OF SALARIES FOR VARIOUS OFFICIALS AND EMPLOYEES OF THE BOROUGH OF CARTERET" Mayor Reiman read Ordinance #13 -2 into the record and CRDRORCE YM-2 explained these are the maps that are required and mandated by Discus FEMA in the Stare of New Jersey and the state has already Wyor ordered the adoption and said this would be introducing the ordinance for First Reading, not necessarily approving it because we have already objected to many of the changes in the map which are already taking one thousand (1000) residential properties in Carteret and moving then into the one hundred (100) and five hundred (500) year flood zone. He said if your property was effected a letter would have been received from his office advising them that FEMA was doing this and would require them to get flood hazard insurance. He went on to say the problem would be if we don't adopt the ordinance then the residents aren't eligible to participate in the National Flood Insurance Program, so it is a Catch Twenty Two , so we are moving ahead with the adoption and then we will object to FEMA including so many areas in Carteret. ORDINANCE #13 -2 was introduced and adopted on First Reading CRDIN*MC #13-2 and the Clerk authorized and directed to advertise same for 'lrlvisory lase Public Hearing to be held on upon MMS &C by Flood Elevation Councilmembers Sitarz and Krum. "ADVISORY BASE FLOOD ELEVATION MAPS" First Reaiirg 3 WRQI 7, 2013 ORDRWU #13-3 Discussion Mayor Reiman read Ordinance #13 -3 into the record and Vayor Reirrm explained every year we are allowed to go up 2% on spending appropriations and 2% with regard to the tax levy and we have a cap bank and we are 1.4 million below in what we are allowed to spend and 2 % million below what we are allowed to tax under the cap law. He said this sets up the bank in case there are any type of future emergencies. Upon individual roll call vote Mnicipal Saget Councilmembers Bellino, Diaz, DiMascio, Krum, Naples and Sitarz An-ropriaticns voted in the Affirmative. and Establish a Cap Sank (N.J.S.A 4011:4- 45.14) "CALENDAR YEAR 2013 ORDINANCE TO EXCEED THE MUNICIPAL Est Rea71rg BUDGET APPROPRIATIONS AND ESTABLISH A CAP BANK (NJSA 40A:4- 45.14) ftor Reinmi, Mayor Reiman then spoke in reference to #9 under Resolutions , Re: Resolution "Waiving All Fees Associated With a Residential Owner Occupied ;'r13 -49 Dwellings of 1 -4 Units for Alarm Systems ", saying it was brought to his attention that a resident was installing a home alarm system and ADT said to them that X amount of dollars was for a permit fee to the city. He said he inquired what the permit fee was for and found in this instance the city was not doing any inspections so we are billing residents and we are not providing a service, so we will be waiving the fees for any type of alarm system. Public Portion Upon MMS &C by Councilmembers Sitarz and Bellino and on Resolutions/ unanimous affirmative vote of the full Council present, the public Agenda itens ard L%r Business 2 MuRQI 7 2 2 013 Public Portion portion on Resolutions /Agenda Items and New Business was Cont: opened to the public. John Casalinuovo, 118 Dorothy Street, spoke about his concern Jon Casaliu vD with the burglaries and asked if there will be a mailer with the dates and times of the Neighborhood Watch Program. Mayor Reiman explained that we have been working for a week or two with the Police Department and the Prosecutor's Office and our office of Public Information to determine what would be going on the flyer. He said we have background information about the Neighborhood Watch Program and we have added the newer dates and now with the increase in burglaries or attempted burglaries he directed the Crime Watch and Police Department to schedule two (2) meetings per month for the next six (6) months and then at least one (1) a month beyond that and what we just did was add in addition to every Wednesday, two (2) Saturdays, one (1) the end of this month and (1) in April for those residents who cannot make it during the week. He said all of this, the Neighborhood Watch Application, crime prevention tips and other information will be in the flyer and will be going out. John Casalinuovo explained that he had sent an email about the burglaries even though he realized they could not get all the details, and then he said he had heard there were two (2) carjackings in town. Mayor Reiman said there was one (1) potential carjacking in town and went on to explain in regard to the media outlets, the Chiefs Office, on a daily basis, faxes over the crime sheet to them and it doesn't have the victims name or address, just maybe the street, but we have no control over what is printed in the Tribune or Ledger and spoke briefly on this. 5 t✓NAH 7, 2013 Riblic Porticn Cont: Mr. Casalinuovo then asked if there will there be more police present because of the burgularies. Mayor Reiman said without getting specific in details there will be a significant increase in police presence. Joe Joe Czajkowski, 14 Matthew Ave. then spoke, saying he was here Czajkaasld six (6) months ago and during school hours when cars are parked on both sides of the street the speed humps work effectively but when school is out and in the evening everyone seems to ride by the curbs and go as fast as they want and the roads are beginning to break up. He said the second part is that he has to slow down to turn into his driveway and it is right after the Rite Aid driveway and people come up behind him and pass him on the right and then mentioned that there is more traffic on Heald Street now because they go there to beat the light. Mayor Reiman said those speed humps will be removed prior to the first snowfall and the DPW is looking into wider longer speed bumps to avoid people going around them. Mr. Czajkowski spoke about parking saying that Matthew and Washington has one (1) hour parking from 8:00 a.m. until 4:00 p.m., and the High School children should not be allowed to park there and he should not have to bother the Police Department for this. Mayor Reiman said they would have to look into the code. Mr. Czajkowski said he got the code from the web. Mr. Czajkowski said they still do not have a light for the street sign on the corner of Matthew and Washington. L Public Portion Cont: Mayor Reiman said the light that has been knocked down is one of over two - hundred (200) lights that we have asked PSE &G to Joe Czajkmski replace. He said they own all of the lights and the black decorative Copt: poles as well as the ones they call cobra heads that go on the telephone poles not the utility poles. Mr. Czajkowski said to put a concrete pole on that corner. Mayor Reiman said they cannot put a concrete pole on a right of way because the poles are made to give in case of a car accident. Mr. Czajkowski said he had seen in the paper around Thanksgiving that we are suing U.S. Metals and the only thing told to him was the area between Heald and Whittier Streets was a lot lower than it is today and what they did was in about the 1920's they got the chemical waste from the plants on the waterfront and made white bricks from it and used it for fill for the road and as the road is deteriorating there is signs of it especially on the corner of Whittier and Matthew Streets that there is slag and brick etc. Mayor Reiman said it would not surprise him or the Council that things were done around town that should not have been done and some things certainly were not illegal. He commented when U.S. Metals operated slag was a by- product of the refining operation and said he and Mr. DuPont are planning on doing some testing in the public right of way,s which is very difficult unless the DNA fingerprint can point to and say it was U.S. Metals. Mr. Czajkowski also asked that his street be paved. After no further discussion, upon MMS &C by Councilmembers Public Portion Sitarz and Bellino and unanimous affirmative vote of the full Cl Council present, the public portion was closed. 7 MARDI 7, 2013 Mayor Reiman read the resolutions into the record: 1. Directing the Issuance of Various Raffle Licenses. 2. Authorizing Bids for 2013 On Call Property Maintenance. 3. Award of Contract for 2013 Various Mowing, Trimming and Weed Control Program. 4. Award of Contract for 2013 Mow & Trim of Municipal Facilities. 5. Opposing 5- 2114/A -3317 Prohibiting Municipal Registration of Multi - Family Dwellings. 6. Amendment to the 2013 Temporary Budget. 7. Accepting and Approving RF(Xs for Various Professional Services. 8. Introduction of the 2013 Local Municipal Budget. 9. Upon MMS &C by Councilmembers Diaz and Krum all bills appearing on the prepared list, properly audited and signed were ordered to be paid.
