HomeMy Public PortalAbout321CITY OF MEDINA ORDINANCE NO.321 ORDINANCE NO.321 APPROVING PUD DEVELOPMENT PLAN AND REZONING PROPERTY TO PUD 1 The city council of the city of Medina ordains as follows: Section I. Recitals. 1.01. The city of Medina (the "City") has received applications from Restoration Development, LLC (the "Developer") regarding the rezoning and platting of certain land in Medina generally located north of Evergreen Road, west of CSAH 101 and south of Hackamore Road, which land is legally described in Exhibit A attached hereto (the "Property"). 1.02. Hennepin County is the fee owner of the Property and the Developer has a purchase agreement to purchase the Property from Hennepin County. 1.03. On May 16, 2000, the City adopted Ordinance No. 317, which became effective on May 18, 2000. Ordinance No. 317, entitled "An Ordinance Adding Section 830 to the City Code Titled Planned Unit Development 1 and Planned Unit Development 2", established residential planned unit development districts within the text of the City's zoning ordinance. 1.04. On July 5, 2000, the city council approved the Concept Plan proposed by the Developer for the Property. 1.05. On September 11, 2000 the city council adopted final amendments to its comprehensive plan and submitted the plan to the Metropolitan Council for its review and approval. 1.06. On September 13, 2000 the Metropolitan Council approved the City's comprehensive plan and authorized the City to put the plan into effect. 1.07. Among the elements within the City's comprehensive plan is a change in the land use designation of the Property from rural residential to planned unit development 1. 1.08. On August 17, 2000 the planning commission held a public hearing on the Developer's proposed PUD Development Plan for the Property and rezoning application, after which hearing the planning commission recommended approval of the PUD Development Plan and rezoning, subject to certain terms and conditions. 1.09. On September 5, 2000 the city council reviewed the Developer's application for approval of the PUD Development Plan and rezoning for consistency with Ordinance No. 317 and the Concept Plan, considered the planning commission's recommendations regarding the PUD Development Plan and rezoning and heard additional comments from the Developer and others wishing to address the city council regarding the matter. Pursuant to Ordinance No. 317, now codified as Section 830 of the City's zoning ordinance, the City makes the following findings regarding the PUD Development Plan: 2.01. Consistency with the General Preservation and Development Guide with allowance for some variation with justification. Finding — Consistent, except for southwest corner and two slope areas where some deviation was granted. 2.02. The Plan includes conservation and preservation consistent with the General Preservation and Development Guide and provides sufficient usable open space and evidences preservation of natural features. Finding — Consistent with appropriate guarantees. 2.03. The Plan is in harmony with the general purposes and intent of the zoning ordinance and this district. Finding — Consistent. 2.04. The Plan provides for and is in keeping with the promotion of the public health, safety, and general welfare of the City or its citizens. Finding — Consistent. 2.05. Consistency with protection of the natural environment. Finding — Consistent, based on the Developer's commitment to work with the City staff on site, except for two small areas where some deviation was granted based on restoration. 2.06. Compatibility of the proposed Plan with this district, the General Preservation and Development Guide, the Concept Plan, and the goals and policies of the comprehensive plan. Finding — Consistent with the deviations previously granted. 2.07. Effect of the proposed Plan on the neighborhood in which it is located. Finding — The effects are judged to be beneficial. 2.08. Internal organization and adequacy of various uses, densities, circulation and community facilities, recreation areas, open spaces, screening, and landscaping. Finding — The internal organization is favorable with respect to uses, density, circulation, recreation areas, open space, and landscaping. 2.09. Consistency with all other relevant land use controls and other applicable provisions of the city code. Finding — Consistent. 2.10. Such other factors as the City deems relevant. Finding — Consistent. No other factors have been identified. RHB-185980v2 ME230-308 2 Ordinance 321 09-19-00 Section III. Rezoning. 3.01. Based on the above findings, approval is hereby granted to the Developer for the PUD Development Plan and rezoning of the Property to PUD 1. The approved PUD Development Plan and related documents are shown on Exhibit B attached hereto. Approval is granted subject to the following terms and conditions: a. The Developer must execute a development agreement, including restrictive covenants and conservation easements, consistent with this approval and acceptable to the City in form and substance; and b. The PUD Development Plan and related preliminary plat are subject to the changes and modifications noted in the companion resolution approving the preliminary plat of the Property. 3.02. The PUD Development Plan permits up to 150 units, including 30 bonus units. The bonus units have been awarded based on the city council's conclusion that the PUD Development Plan meets or exceeds all elements specified in section 830.05, subd. 1 (b) of the City's zoning ordinance regarding the awarding of up to 30 bonus units for the Property. 3.03. The PUD Development Plan is subject to approval of final site and building construction plans prior to issuance of any building permit for the Property. Section IV. Effective Date. 4.01. The City staff is authorized and directed to publish this ordinance rezoning the Property from Rural Residential to PUD 1 upon satisfaction of all the above terms and conditions. Recitals. 1.01. The city of Medina (the "City") has received appli- cations from Restoration Development, LLC (the "Developer") regarding the rezoning and platting of cer- tain land in Medina generally located north of Evergreen Road, west of CSAH 101 and south of Hackamore Road, which land is legally described in Exhibit A attached hereto (the "Property"). 1.02. Hennepin County is the fee owner of the Property and the Developer has a purchase agreement to pur- chase the Property from Hennepin County. 1.03.On May 16, 2000, the City adopted Ordinance No. 317, which became effective on May 18, 2000. Ordinance No. 317, entitled "An Ordinance Adding Section 830 to the City Code Titled Planned Unit Development 1 and Planned Unit Development 2", established residential planned unit development districts within the text of the City's zoning ordinance. 1.04. On July 5, 2000, the city council approved the Concept Plan proposed by the Developerfor the ` Property. 1.05. On September 11, 2000 the city council adopted final amendments to its comprehensive plan and submitted the plan to the Metropolitan Council for its review and approval. On September 13, 2000 the Metropolitan Council .wed the City's comprehensive plan and authorized the City to put the plan into effect. 1.07. Among the elements within the City's comprehen- sive plan is a change in the land use designation of the Property from rural residential to planned unit devel- opment 1. 1.08.On August 17, 2000 the planning commission held a public hearing on the Developer's proposed PUD Development Plan for the Property and rezoning appli- cation, after which hearing the planning commission rec- ommended approval of the PUD Development Plan and rezoning, subject to certain terms and conditions. 1.09.On September 5, 2000 the city council reviewed the Developer's application for approval of the PUD Development Plan and rezoning for consistency with Ordinance No. 317 and the Concept Plan, considered the planning commission's recommendations regarding the PUD Development Plan and rezoning and heard additional comments from the Developer and others wishing to address the city council regarding the matter. Section II. Findings. Pursuant to Ordinance No. 317, now codified as Section 830 of the City's zoning ordinance, the City makes the following findings regarding the PUD Development Plan: 2.01. Consistency with the General Preservation and Development Guide with allowance for some variation with justification. Finding - Consistent, except for southwest comer and two slope areas where some devi- was granted. 2.02. The Plan includes conservation and preservation consistent with the General Preservation and Development Guide and provides sufficient usable open space and evidences preservation of natural features. Finding - Consistent with appropriate guarantees. 2.03. The Plan is in harmony with the general purposes and intent of the zoning ordinance and this district. -Finding - Consistent. 2.04. The Plan provides for and is in keeping with the promotion of the public health, safety, and general wel- fare of the City or its citizens. Finding - Consistent. 2.05. Consistency with protection of the natural envi- ronment. Finding - Consistent, based on the Developer's commitment to work with the City staff on site, except for two small areas where some deviation was granted based on restoration. 2.06. Compatibility of the proposed Plan with this dis- trict, the General Preservation and Development Guide, the Concept Plan, and the goals and policies of the com- prehensive plan. Finding - Consistent with the devia- tions previously granted. 2.07. Effect of the proposed Plan_ on the neighborhood in which it is located. Finding - The effects are judged to be beneficial. 2.08. Internal organization and adequacy of various uses, densities, circulation and community facilities, recre- ation areas, open spaces, screening, and landscaping. Finding - The internal organization is favorable with respect to uses, density, circulation, recreation areas, open space, and landscaping. 2.09. Consistency with all other relevant land use con- trols and other applicable provisions of the city code. Finding - Consistent. 2.10. Such other factors as the City deems relevant. Finding - Consistent. No other factors have been iden- tified. Section III. Rezoning. 3.01. Based on the above findings, approval is hereby granted to the Developer for the PUD Development Plan i and rezoning of the Property to PUD 1. The approved PUD Development Plan and related documents are shown on Exhibit B attached hereto. Approval is granted subject to the following terms and conditions: ' a. The Developer must execute a development agree- ment, including restrictive covenants and conservation,'' easements, consistent with this approval and acceptable to the City in form and substance; and b. The PUD Development Plan and related prelimi- nary plat are subject to the changes and modifications noted in the companion resolution approving the pre- liminary plat of the Property. 3.02. The PUD Development Plan permits up to 150 units, including 30 bonus units. The bonus units have been awarded based on the city council's conclusion that the PUD Development Plan meets or exceeds all ele- ments specified in section 830.05, subd.1 (b) of the City's zoning ordinance regarding the awarding of up to 30 bonus units for the Property. _ 3.03. The PUD Development Plan is subject to approval of final site and building construction plans prior to issuance of any building permit for the Property. Section IV. Effective Date. 4.01. The City staff is authorized and directed to publish this ordinance rezoning the Property from Rural Residential to PUD 1 upon satisfaction of all the above terms and conditions.
