REFERRING RESOLUTION ON AGING INFRASTRUCTURE
TO THE PLANNING BOARD
WHEREAS, the governing body of the Borough of Carteret (the "Borough ") is
interested in determining that a delineated area located within the Borough constitutes an
Area In Need Of Rehabilitation pursuant to N.J.S.A. 40A: 12A-1 et seq.; and
WHEREAS, N.J.S.A. 40A:12A -14 requires the governing body of the Borough to
submit its proposed Resolution determining an Area In Need Of Rehabilitation to the
Borough's Planning Board (the "Planning Board ") for its review and consideration of any
recommendation(s) with regard thereto.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
1. That the Planning Board is hereby requested to review the attached
Resolution attached hereto as Exhibit "A" determining the delineated
area described therein as an Area in Need Of Rehabilitation pursuant
to N.J.S.A: 40A: 12A-1 et seq. .
2. That the Planning Board, following said review, submit its
recommendation(s) to the governing body of the Borough pursuant to
N.J.S.A. 40A:12A -14.
3. That the Planning Board is hereby authorized to utilize the services of
Beacon Planning and Consulting Services, LLC to assist the Planning
Bond with its review.
4. That this resolution shall take effect immediately.
5. That a copy of this Resolution be forwarded to the Planning Board for
action consistent therewith.

EXHIBIT "A"
APPROVING THE DESIGNATION OF REHABILITATION AREA
BOUNDARIES WITH AGING HOUSING AND INFRASTRUCTURE — COOKE
AVENUE REHABILITATION AREA
WHEREAS, pursuant to the New Jersey Redevelopment and Housing Law, N.J.S.A.
40A: 12A -1 et seq. ( "Redevelopment Law "), the governing body of a municipality may
determine a delineated area to be in need of rehabilitation if it determines that there exist
in that area such conditions to include that more than half of the housing stock in the
delineated area is at least 50 years old, or a majority of the water and sewer infrastructure
in the delineated area is at least 50 years old and is in need of repair or substantial
maintenance, and a program of rehabilitation may be expected to prevent further
deterioration and promote the overall development of the community; and
WHEREAS, the Mayor and Council of the Borough of Carteret (`Borough Council ")
have determined, based upon research conducted by the Borough's Consulting Engineers,
T &M Associates, and the Borough's Tax Assessor, and a further planning evaluation
conducted by Beacon Planning and Consulting Services, LLC, that such condition(s)
exist in the proposed Cooke Avenue Rehabilitation Area which consists of all of the
properties located within the Borough Tax Block located at the northeast corner of
Washington Avenue and Cooke Avenue, bounded to the north by Irving Street, to the east
by High Street, to the south by Washington Avenue and to the west by Cooke Avenue,
and identified as Block 6502 on the Official Tax Map of the Borough ( "Rehabilitation
Area "); and
WHEREAS, the Borough Council, pursuant to the provisions of N.J.S.A 40A: 12A-14 of
the Redevelopment Law, wishes to formally determine, by way of the adoption of the
within Resolution, that the above described Rehabilitation Area constitutes an area in
need of rehabilitation; and
WHEREAS, by Resolution #13 -154, adopted on August 15, 2013, the Borough Council
has referred the within Resolution to the Planning Board of the Borough of Carteret
( "Planning Board ") for its review and recommendation; and
WHEREAS, the Planning Board at its meeting on August 28, 2013, conducted its review
and has submitted its recommendation(s) regarding this proposed Resolution; and
WHEREAS, the Borough Council has given due consideration to the recommendation(s)
of the Planning Board; and
WHEREAS, the Borough Council further concludes that there exists within the
delineated Rehabilitation Area such conditions, including that more than half of the
housing stock in the delineated area is at least 50 years old, and a majority of the water
and sewer infrastructure in the delineated area is at least 50 years old and is in need of
repair or substantial maintenance, and a program of rehabilitation may be expected to
prevent further deterioration and promote the overall development of the community.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey that the above described Cooke
Avenue Rehabilitation Area is an area in need of rehabilitation as so defined by N.J.S.A.
40A:12A -14 and is hereby so designated.
BE IT FURTHER RESOLVED, that a duly executed copy of this Resolution shall be
transmitted to the Commissioner of the New Jersey Department of Community Affairs.
BE IT FURTHER RESOLVED, that, upon approval of the within rehabilitation area
designation by the Commissioner of Community Affairs pursuant to N.J.S.A. 40:12A-
6(5), should the same be required thereby, Beacon Planning and Consulting Service,
LLC, is hereby authorized and directed to work with the appropriate Borough Officials
and Professionals in developing and advancing a program of rehabilitation for the hereby
designated Cooke Avenue Rehabilitation Area.
BE IT FURTHER RESOLVED, that duly executed copies of this Resolution shall be
transmitted to the Planning Board, filed in the office of the Borough Clerk, and forwarded
to Beacon Planning and Consulting Services, LLC.
