Summit Riders Horseman's Association is writing to inquire if we may again gain access to the
above-referenced property. For nearly 40 years,we have had access through The San Jose Water
Works' property onto the former Cothran property. We rode there any time we wished,and also
had overnight campouts,by invitation of the property owner.
When Mid-Pen obtained the property we still were able to ride these trails,but for the last year-
and-a-half we have been shut out of this area. We feel that we have a prescriptive easement to
use the property,in light of the number of years we have ridden the trails.
Summit Riders was given permission to put a water trough on the property,which we did,years
ago,with the assistance of a Mid-Pen ranger. At no time has the Club received any complaints
from the residents;we don't ride close enough to any of the homes to be seen,and have had
cordial relations with any residents we've come in contact with.
For many of our local riders;this property is the only place to ride in the winter months;be cause,
the trails don't get muddy. We are hopeful that something can be done to again open up this area
to equestrian use.

The District's real property staff has reviewed our related property files and we respectfully disagree
with Mr. Lysori� claim to an easement over the adjacent District property. It is the District's position
that Mr. Lysons does not possess access rights over the dirt road on the District-owned property, as
identified on the attached map (road in question is highlighted in orange).
The District works diligently to foster and maintain good relationships with its neighbors. Accordingly,
the District issued Mr. Lysons an Adjacent Resident Temporary Use Permit on October 21, 2011
(current permit attached). This permit grants Mr. Lysons the ability to access the dirt road in question
on foot.

Over the past two years this office, on behalf of our client Mr. Neil Lysons, has had
opportunity to discuss with your organization certain issues relating to adjoining parcels of
property located on Stevens Canyon Road. The Midpeninsula Open Space District had
purchased the land adjacent to our client's property at which time discussion was held about
easements enjoyed by both parties on the adjoining properties.

claim dated March 7, 2012. The District's Real Property staff has reviewed our related property files,
and we respectfully disagree with Mr. Lysons' claim to an easement over the adjacent District
property. It is the District's position that Mr. Lysons does not possess access rights over the dirt road
on the District-owned property, as identified on the attached map (road in question is highlighted in
orange).
The District works diligently to foster and maintain good relationships with its neighbors. Accordingly,
the District issued Mr. Lysons an Adjacent Resident Temporary Use Permit on October 21, 2011
(current permit dated January 4, 2012 attached). This permit grants Mr. Lysons the ability to access the
dirt road in question on foot.

District Ombudsperson Interview and Appointment
LEGISLATIVE,FUNDING AND PUBLIC AFFAIRS COMMITEE'S
RECOMMENDATION
The Legislative, Funding and Public Affairs Committee (LFPAC)recommends that the Board
appoint Dr. Erik Nolen Allen as the District's Ombudsperson.
SUMMARY
On May 24, 2011, Carol Joyce, the District's Ombudsperson for many years, resigned from her
position to take advantage of an employment opportunity in another state,leaving the District
with the task to appoint another Ombudsperson to act as a liaison between District staff and the
public to resolve citizen inquiries and concerns.
On July 13, 2011 the Board approved a recruitment and selection process for a new
Ombudsperson which delegated responsibility for screening the District Ombudsperson
applications to LFPAC (See Report R-1 1-74) and charged the committee with returning to the
Board with the top applicants. The committee interviewed Dr. Allen on February 22, 2012, and
recommends that the Board appoint him to the position of Ombudsperson.
Following is a summary of the Ombudsperson's duties; for the complete list of the
Ombudsperson's role, duties, assignment and reporting responsibilities please see Attachment 2:

DISCUSSION
At its May 26, 2004 meeting(see Report R-04-57),the Board adopted Resolution No. 04-13
establishing a process for appointment of a District Ombudsperson in conformity with the San
Mateo County Local Agency Formation Commission's(LAFCO's)conditions of approval of the
District's expansion to the San Mateo County coast in 2004.
At its July 13, 2011 meeting,the Board of Directors approved the General Manager's
recommendation for a selection process which included screening of the applications by LFPAC
and a return to the Board with the top four applicants. The Board, it was decided, would then
schedule interviews and appoint an Ombudsperson either at an upcoming Regular or Special
Meeting.
LFPAC met with Dr. Allen on February 22, 2012, and is enthusiastic in recon-unending his
appointment as the District's new Ombudsperson. Dr.Allen is currently the Administration and
Planning Analyst for San Jose State University, has past mediation experience along with a
certificate by the Santa Clara County Dispute Resolution Program and he comes highly
recommended by, among other people,Associate Professor and Program Director for Higher
Education Administration at Saint Louis University Dr. Gerard Fowler. Professor Fowler
currently serves as the Regional Chair for the National Academy of Arbitrators and arbitrates and
mediates employment disputes in schools, colleges and private industry.
The Committee believes that the full Board will agree that Dr. Allen will be an effective
mediator who can work with constituents to address any issues that may arise and that he will be
able to serve as an outstanding Ombudsperson for the District.
FISCAL IMPACT
There are no unbudgeted fiscal impacts with this report.

Role of Ombudsperson
The Ombudsperson is an appointee of the Board of Directors who follows up on resident or
neighbor inquiries or complaints for the purpose of attempting to resolve misunderstandings or
conflicts that have not been resolved satisfactorily by District staff. The Ombudsperson works
independently and objectively to assist in maintaining positive relations with District residents

Scope of Duties
The Ombudsperson would assist residents in their interactions with the District and facilitate
conflict resolution when needed. The Ombudsperson would not handle issues that are
privileged or confidential, or which involve personnel, labor relations, legal matters, or Board
decisions. The Ombudsperson would present facts that may lead the Board or staff to
improve operations or better address citizen needs, as opposed to advocating either for or
against a resident, staff or Board policy. The Ombudsperson would not establish or
recommend District policy, or affect or make fiscal or budgetary decisions.
Assignment and Resorting Responsibilities
If the initial contact from a citizen is the Ombudsperson, the Ombudsperson will contact the
General Manager before taking further action. If the General Manager is not able to resolve
the concern/complaint to the citizen's satisfaction, the Ombudsperson will follow up with the
citizen for further resolution efforts. If the initial contact from a citizen were a Board
Member, the Board Member would immediately contact the General Manager. If the
General Manager is not able to resolve the concern/complaint to the citizen's satisfaction, the
General Manager shall inform the citizen of the District's Ombudsperson process and shall
request the Ombudsperson contact the complainant to offer further assistance.
After completing inquiry and resolution efforts the Ombudsperson would then report back to
the General Manager and provide a written summary report for the Board at least quarterly.

Field Enforcement Activity Report for Calendar Year 2011 and Ten-Year Field Activity
Summary
GENERAL MANAGER'S RECOMMENDATIO
Accept the Calendar Year 2011 Miscellaneous Enforcement Activity Summary and the Ten-Year
Field Activity Summary.
SUMMARY
This report continues the transition, started in 2010, from the previous data collection and
presentation method, to a system which is based on a complete electronic input Access database.
The previous system used a combination of manual record keeping, Excel spreadsheets,
converted into a less sophisticated Access database. Since the report covers the last ten years, it
needs to be understood that the data from the previous system (first eight years) is not going to be
as accurate as the data from the last two years. Therefore, violation occurrences and trends will
be more accurate as we proceed with the new system data and the old system data is reduced in
the coming years.
As such, the total violations on District property in calendar year(CY) 2011 increased by 5.3%
over CY2010. Parking and Parking-After-Hours violations accounted for 49.6% of the total
violations in the past year, with Rancho San Antonio experiencing the greatest number of parking
violations of any District preserve as expected, due to the nature of its parking and use.
Total bicycle violations decreased by 12.3% over the previous year. This continues a downwards
trend that started in 2007. Bicycle accidents also dropped from a high of 40 accidents in 2009 to
22 accidents in 2011.

In 2010 the number of off-road vehicle incidents was highlighted. It had jumped from 15
incidents in 2009 to 38 incidents in 2010. We believe this was due to a rash of motorcycle
violations coming from a neighboring property onto El Corte de Madera Open Space Preserve.
The number has decreased to 26 incidents in 2011, which we believe is the result of increased
enforcement activity by District Rangers targeting the violators. These efforts will continue to be
made a priority in 2012.
DISCUSSION
Since April 1995, staff has given the Board written monthly reports on emergency incidents and
enforcement activities on District land. At the end of each year, the Board receives a summary of
that year's data as well as a comparison to previous years. Information for this year's report was
generated from the new Incidents Database, which was placed in service for data collection on
January 1, 2010. In prior years the creation of this report relied mostly upon manual data
collection methods, which were more prone to error and had limited data collection capabilities.
Therefore data up to and including 2009, was imported from the previous system, while 2010 and
2011 data has been electronically collected and entered into the new Enforcement Data Base
System. In addition, we are continuing to refine the current database to collect the desired
information and improve the presentation of information and analysis from the system for the
future.
Three summaries are presented for Board review in this report: the CY2011 Miscellaneous
Enforcement Activity Summary(Appendix A), and the Ten-Year Field Activity Summary
(Appendix B.1). Also provided is a summary of the actual violation codes, listed in order of
frequency of occurrence(Appendix B.2). Note that information for prior years in Appendix B.2
is not complete due to the incomplete information gathered in the earlier data gathering process.
Graphical representation of trends is shown in appendices C and D.
The Miscellaneous Enforcement Activity Summary(Appendix A) lists, in chronological order
for the past year, contacts made or reports taken by staff of potentially serious, violent, or other
criminal activity on or near District land. This is not a comprehensive list of incidents but
reflects incidents of special interest or concern.
The Ten-Year Field Activity Summary includes violations of District Land Use Regulations,
emergency responses, criminal activity, and mutual aid incidents. Only contacts that resulted in
some form of written record, such as a District incident report, written warning, citation, or
mutual aid assistance report have been included in these summaries. General assistance to
preserve visitors, informational contacts, and verbal warnings are not included.
Trends and Issues
• Violations of District Ordinances continue to be the primary enforcement focus of
District Rangers, as noted in Appendix B.2.
• After-hours parking violations were the highest occurring violations (331).

followed by after-hours use (206 violations).

• Rancho San Antonio continues to be the most active preserve for parking violations with
270 parking citations in 2010. This is comparable with the 260 parking citations in 2011.
• Recorded bicycle violations decreased from a high of 368 violations in 2009 to 250
violations in 2011. Bicycle speed and night riding rose slightly, as shown on the chart
below. The number of Closed Area violations tends to vary according to the weather
since trails are not generally closed during dry periods.

• The number of bicycle accidents decreased from a high of 40 accidents in 2009,to 22
accidents in 2011, which is slightly below the 27 accidents per year average, experienced
over the last ten years (see Appendix D).

She was found semi-conscious by preserve visitors,who called for assistance. Santa
Clara County Fire arrived at the Mora gate followed by a District Ranger. The ranger drove
down to the patient and transported the patient to a waiting ambulance.

Jan 26 A vehicle,which was observed in the parking lot after-hours,was found to be connected 3 SMCSO 2
/R 11 S025 with a missing person's report out of Dublin. District Maintenance Crew stated that the
vehicle has been parked since January 24,2011. Upon searching the vehicle,diabetic
testing equipment was found,creating concern for the driver.San Mateo County Sheriff
Deputies were requested. The person was later located in Sausalito unharmed.

Jan 29 A District Ranger discovered two subjects dumping dirt and rocks over the side of the road 3 SCCSO 2
IR 11F022 into the preserve. A long and difficult contact ensued with the subjects. The ranger
requested the assistance of additional rangers,and Santa Clara County Sheriff Deputies.
After the deputies arrived,one of the rangers cited one of the subjects for a dumping of
waste violation and warned him for resisting arrest. Both subjects were then released.

Feb 01 A CalFire Captain came upon the scene of a dump site on District Property. It consisted of 3 SMCF 3
IR 11F027 three 55 gallon barrels,one 30 gallon barrel, several 5 gallon buckets, several one gallon
cans, unknown bags of what appeared to be concrete, and numerous tires. After notifying
the District,three rangers responded to the scene. Santa Clara County Fire evaluated and
determined the dump was not actively releasing hazardous material or that it was an
immediate danger.
District Rangers temporarily fenced off the area until a Maintenance&Construction
Supervisor could meet with a Haz Mat Clean-up Contractor who removed all materials for
$1,800.00. Because of the quantity and cost,the crime is a felony.

IR 11F033 searching for an individual.The ranger was driving up the Jones Trail,where the road is
narrow and has a steep side shoulder,when a male runner approached his vehicle without
slowing down, slammed his hand into the left side view mirror folding it up against the
door. The subject gave the ranger the"one finger salute"and yelled profanities as he
continued to run down hill.

MA 11F028 bike and a knife, sitting on the side of the trail crying. A Santa Clara County Sheriff Deputy SCCP 2

determined was not the person reported. St.Joseph's Hill OSP and the Los Gatos Creek
Park were further searched. Officers were unable to locate the subject.

MA 11F026 The suspect had been involved in a resisting arrest incident at Pheasant Road on the
previous Saturday.A Santa Clara County Sheriffs Deputy was requested to meet the
ranger at Hicks&Pheasant roads.The deputies arrived and identified the suspect as
having mental health issues and hearing difficulties. He was contacted and asked to leave
the Pheasant and Hicks Road area.

Feb 10 A District Employee Resident Ranger received a call from Mountain View Communications 5 AMR
IR IIS033 of a woman reporting her boyfriend and three others were overdue on their horses at Long CDF
Ridge OSP.

A California Highway Patrol helicopter was sent to the area. District Staff responded and SMCSO 2
met with Santa Clara County Sheriff Deputies and the friends of one of the missing riders.
After extensive searching for over five hours District Rangers received a verbal response SCCSO 3
back to their calls while on Canyon Trail near the Table Mountain Trail in Upper Stevens
Creek County Park.
At 2:17 am, District Staff located the four riders next to Stevens Creek,approximately 1000
feet to the east of the Grizzly Flat Trail. The individuals were uninjured but slightly
hypothermic. They had built a small fire to keep themselves warm.The temperature had
dropped into the 30's and all the cyclists were in short sleeve bike shirts and shorts.

Feb 13 A District ranger observed a car parked on Hwy. 35 at Saratoga Gap OSP. Two people 2 SCCSO 1
IR 11 S037 were observed partially nude about 20'off the Achistaca Trail.
Upon approaching the couple,the male pulled up his shorts and charged the ranger
questioning his authority to make contact with them. The suspect then told the female with
him to get into their truck,while continuing to ignore orders by the ranger to stop.
They fled south on Hwy 9 in their vehicle. A Santa Clara County Sheriff Deputy
responded while the ranger followed the couple down Hwy.9 toward the town of Saratoga,
where deputies pulled them over. The male was cited for nudity and resisting a peace
officer in the performance of his/her duty. The female was cited for nudity. Both subjects
were released.

Feb 21 A District Ranger cited a subject who had taken his motorcycle around the Mount 1
IR 11F043 Umunhum gate and had ridden to the intersection of Loma Prieta Road where he was
photographing his bike. The subject was also warned for having an expired driver's
license and no proof of insurance.

IR 11F044 Sierra Azul OSP had been rammed. When the ranger arrived at the gate he found the
gate was bent and moved outward with the chain and locks missing.

AR 11FO47 County Fire was requesting a response to Sheldon Road on a report of a man down. SCCF 3
The individual was found,and transported by ambulance. The individual had been seen SCCSO 4
wandering, in a disoriented state, naked below the waist,and with a ripped shirt. The
individual had been in the preserve overnight, and was possibly mentally ill. Paramedics
reported that the subject was also hypothermic.

IR 11F060 preserve. California Fish and Game determined the animals were domestic,most likely a

fighting or dog fighting. The S.P.C.A.officer who responded suspected a"Satanic Ritual" 1
based on the fact that the dog was missing its head. East Palo Alto Police responded as
well to take the report.

Mar 09 A solo vehicle accident occurred on the upper access road just beyond the Model Airplane 3 SCCSO 2
AR 11F059 lot. The driver said he was distracted by watching the airplanes.
He hit the curb,was unable to correct his course,and went off the road and down the
embankment where he came to a stop in some coyote brush. He then tried to drive his
vehicle across a drainage and got the front end of his vehicle stuck in the mud. A tow
truck came and removed the vehicle so that the driver could drive it away.

the Japan earthquake.

Mar 25 District crew members discovered a petroleum leak coming from a brick building on the 2 F&G 1
j IR 11FO70 north side of the college.The building basement had approximately one foot of oily water SCCF 6
covering the entire floor.
Rangers responded to the site and smelled the petroleum/water mix(significant amounts
of rain had fallen)which was flowing outside the building down the road and towards a
creek.
The crew's supervisor placed an absorbent dam below the site to prevent the spill from
spreading. Rangers notified Santa Clara County Fire and their HAZMAT team who
responded and continued to place absorbent rolls and constructed two additional dams.
Also notified were California OES,California Dept.of Fish&Game and San Jose Water
Dept.A private contractor was requested to remove the spill.

Mar 30 A stolen vehicle was found in the preserve. It had been driven through a T-post fence and 3 SCCSO 1
IR 11F075 left parked in a field off of Hicks Road.
One of the vehicle's back windows had been broken,the interior had been doused with
motor oil,and the key was left in the ignition. Rangers met with a Santa Clara County
Deputy who had made contact with the vehicle's owner. Pictures and a report was taken
prior to the removal of the vehicle.

Apr 02 An off-duty ranger heard a large tree fall, and screaming from the parking lot area. He 5
IR 11F077 responded to the area and a woman said she had left her car and started walking across
the parking lot when she heard and saw the tree falling and hitting three vehicles parked
underneath.There were no injuries.
The ranger called additional staff to assist with securing the area and removing the tree.
The ranger obtained contact information from the owners of the three vehicles that were
damaged. Two vehicles were towed away, and one was driven from the scene.

Apr 09 A party hiking in the Devils Canyon area of Long Ridge OSP notified Saratoga Summit 10
IR 11 SO74 Fire Station that a female member of their party was missing. The District was notified CDF 3
through Mountain View dispatch and a search of Devils Canyon was conducted that
evening into the late night with no results.
The search continued on into the next morning when San Mateo County,Contra Costa
County and Alameda County SAR units joined the search. Later in the morning a resident SMCSO 5
in the area called Dispatch to say that the lost woman had shown up at his house. A SMCO
search team responded to the residence,confirmed the identify and evaluated her. She SAR
was taken by District staff to meet with the rest of her party. The woman had spent the
night in the Devils Canyon area.

Apr 11 A report of a possible marijuana grow site was received by the San Mateo County 1 SMCSO 1
IR 11SO86 Narcotics Task Force,who conducted an investigation. When the Sherriff's Office and
District staff arrived at the location,which is below the first series of waterfalls on Peters
Creek, several feet of plastic irrigation line crossing the undesignated trail were found.
The lines were followed to several relatively level meadow areas where cultivation had
taken place, most likely the previous year. The Narcotics Task Force estimated that
approximately 1,200 plants had been harvested. The water lines were then cut into
several pieces and taken out of the canyon,but several thousand feet of line remain along
with refuse from the cultivation operation.

Apr 16 District staff responded to a report of a dog vs.dog attack at the preserve. An unleashed 3 SMCSO 1
IR 11S081 dog attacked a leashed dog on the Spring Ridge Trail. Staff made contact with the handler
(not owner)of the aggressive dog(now on leash)and she stated that her dog had
attacked another dog.The dog had blood on its face.
She had agreed with the owner of the injured dog to pay any vet bills associated with the
attack. She also stated that the aggressive dog was a rescue and that the owner was
planning on aggression training. The owner of the injured dog stated that he was nipped
while trying to separate the two dogs and his dog was probably going to lose part of the
ear. He estimated the vet bill would be approximately$1,000.

Apr 16 District staff monitored a radio report of a vehicle accident on Highway 35 near the 1
MA 11S085 Stillheart compound. Updated information was received that the patient might be
experiencing a seizure. District staff were first on scene,and found two patients needing
medical aid.
A female was shaking and hysterical. A male that had been unconscious had regained
consciousness. They had both ingested a marijuana brownie. The victims were
transported by ground ambulance.

Apr 23 A male jogger came running downhill toward a ranger who was in her vehicle. He swerved 1 LGP 1
IR 11F105 toward the vehicle's driver side door,cocked his fist,and punched the vehicle mirror which LGPD 1
slammed into the partially open vehicle window, leaving a 1/2"black mark on the window.
The suspect continued running down the hill without saying anything.
The ranger determined that the suspect was likely to be a previously known offender.The
ranger contacted Los Gatos Police Dept. and met with an officer along with a Los Gatos
Park Ranger.She showed both officers a picture of the suspect and described the
incident. District staff are following up on this case with the District Attorney's office,and
charges will be filed.

May 04 A male jogger who is the subject of a District Safety BOL,spat on a ranger while the 4 LGP 1
IR 11F111 ranger,and another ranger were detaining an unrelated party. When ordered to stop,the LGPD 1
suspect taunted the rangers,and stated he would spit in a ranger's ear every time he saw
one and also stated he would punch a ranger. SCCSO 2
Law enforcement was called but was unable to locate the individual either on the trails or
at his last known residence. The report was written for Battery on a Peace Officer as well
as Resist/Obstruct/Delay a peace officer and taken to Santa Clara County D.A.office. A
warrant has been issued for the suspect's arrest.

May 07 While on patrol District rangers observed four vehicles driving an estimated 25 MPH in the 4
IR 11S100 preserve parking lots. As the four vehicles entered the parking lot they cut off a vehicle
which was leaving,causing the driver to slam on his brakes.
One of the entering vehicles lost control and slid sideways in the equestrian lot. A second
vehicle drove around the loop at the end of the equestrian lot and spun a 180 degree turn.
These two drivers were cited for reckless driving and released. The other two drivers were
given verbal warnings for reckless driving and released.

May 12 A vehicle,traveling southbound on Highway 35,spun out of control hitting a tree. The 3 CDF
MA 11S101 vehicle overturned and came to rest on its roof in the northbound lane. The driver was not CHP 1
wearing a seatbelt,and was unconscious. He was extricated from the vehicle,and flown

May 15 Nine juveniles were detained for exploding a"dry ice bomb"within the preserve. In 2 SCCSO 2
IR i 1F125 addition,they were in possession of a BB,Airsoft,and Cap guns. One juvenile received a
written warning,the rest were verbally warned. Parents of all the juveniles were
contacted.
The principal of a local high school was also contacted as the juveniles stated that they
were filming a reenactment of a World War II battle for a class,that all of the students
were assigned to make a film, and were being graded on accuracy and authenticity.

May 26 A vehicle accident,with a fatality and multiple injured parties,occurred in the Russian 7 AMR
IR I IS109 Ridge Preserve. The accident took place in the Mindego Hill area involving a District CDF

first on scene. All of the victims were triaged and transported as needed(some by CALSTAR

sheriffs office notified District staff. Narcotics Task Force personnel were called in,and

road in an upright position caught between two bay trees.Certain items had been stripped
from the vehicle. A ranger took photographs for the report.

MA 11F164 Deputies were responding to a child endangerment call. An 8 year old girl was found in
the restroom parking lot alone waiting for her father's return. When the father returned he
was questioned by the deputies.
Child Protective Services was contacted,and a follow up investigation will be conducted.
The child was released into her mother's custody.

Jul 08 District docents reported to rangers they had seen a person riding an ATV in the preserve 3
IR 11S134 on the Bella Vista Trail. The ATV slowed down as he passed the Docents. The male rider
was advised that vehicles were prohibited in the Preserve and all designated entrances
were posted to that effect. He stated: "I just come in now and then to check on things."
The Docents reported a physical description of the rider.
Rangers searched the preserve and located ATV tracks on Monte Bello Road and
Waterwheel Creek Trail. Damage to the log"horse gate"at MB08 where the ATV entered
was also observed. Dirt ATV tire markings were left from M808,down Monte Bello Rd.
and went left onto Monte Bello Terrace. There are three Monte Bello Terrace residents
who were contacted and warned.

Jul 11 An illegally constructed downhill bike trail was discovered in the preserve. The trail 2
IR 11F185 descends a steep hill from Woods Trail down to gate SA02. The trail had been
constructed with tools including jumps and other technical features.

Jul 20 An unlawfully constructed bike trail was discovered off of Hicks Road in the preserve.The 1
IR 11F200 trail had been constructed on very steep terrain that included jumps and other technical
features. It did not appear to have any recent use and was possibly never completed.

Jul 27 A vehicle prohibited violation occurred. One subject entered the preserve through the gate 3 SCCSO 2
IR 11F213
and had driven around the Preserve. He was stopped trying to exit the gate where a
ranger determined he was a parolee. He had drug paraphernalia in the vehicle and the
registration was five years expired although the vehicle displayed current tags.
Sheriffs Deputies responded and arrested the subject for parole hold. A ranger cited the

the suspect by the two victims.

Jul 30 Rangers responded to the preserve to a report of personal items found beside the trail, 3 LGPD 2
IR 11F223 including a cell phone and a possible suicide note. Sheriff Deputies on scene with rangers SCCSO 4
were able to locate the subject at home in Los Gatos via phone numbers found in the cell
phone. Los Gatos Police took the subject from the home for a"72 Hour Psychiatric SCCP 3
Evaluation Hold".

IR 11F228 two subjects exiting the preserve.While both subjects were initially cooperative,one of the
subjects ran away from the ranger,back into the preserve, and was not found.The
remaining subject was cited for a"Closed Area"violation.

Aug 06 Two subjects were seen in the preserve after hours. They had a bottle of wine with no 1
IR 11 S150 food present. One was cited for"After hours use Prohibited,"and the other was given a
written warning.
Both people were warned for alcohol possession without a picnic lunch and released. The
cited subject had previously assaulted and attempted to choke a District Ranger.

Aug 07 Rangers responded to a report of three trespassers. Rangers were unable to locate the 2 SCCSO 2
IR 11F237 subjects and believed they were hiding in a building.They called for Santa Clara County
Sheriffs Office to fill.The subjects were seen leaving a building and running downhill cross
country and refusing verbal commands to stop.
Sheriff and rangers waited at the subject's vehicle.When the subjects exited gate SA08 it
was after the closing time for the preserve. They were cited for being in the preserve after
closing time and given warnings about being in a hazardous closed area and resisting
arrest.

Aug 19 Santa Clara County Sheriff,and Fish and Game officers raided a marijuana grow site in 1 F&G 2
IR 11F260 Sierra Azul.Two suspects were arrested at the site,while a third fled the scene and was SCCSO 3
not found.
The two arrested individulas faced multiple felony charges related to growing and
trafficking marijuana as well as being armed.Three firearms were located at the grow site
along with 5,000 to 10,000 plants.The plants were eradicated.The area is still in need of
remediation work.

performed CPR prior to the arrival of District staff. The victim was pronounced dead at the SMCF
scene.

Sep 05 A docent hiking with a group in Monte Bello observed a man carrying a long gun. Santa 3 SCCSO 1
MA 11S203 Clara County Sheriffs officers were notified through Mountain View Dispatch, and District
staff also responded to the scene.The docent informed the man that guns were not
allowed inside the Preserve, but the suspect ignored the information.
Deputies contacted the caretaker of a neighboring property and determined he was the
person with the gun. A District ranger was summoned to provide information about the
property lines. The caretaker was advised to contact the Operations Manager for further
clarification. No further action was taken.

Sep 16 A search for a overdue hiker was conducted in Saratoga Gap, Monte Bello, Long Ridge 5 SCCSO

morning. The hiker was found the next morning at the Saratoga Gap residences on
Charcoal Road where he had spent the night in one of the unoccupied houses. He was SCCO

Sep 19 A Ranger stopped to investigate chainsaw activity near Saratoga Gap and Highway 9. A 1 CHP
MA 11 S211 motorcycle was seen down below the roadside, in the brush. The plate was run and it was
found that the motorcycle had been stolen. CHP responded and recovered the bike.

IR 11S215 above the trail . Backup units were requested. When contacted,the two men,verbally SMCSO 6
abused District staff. District rangers had to draw a baton and OC spray when one subject
would not comply with commands and continued to advance towards a ranger,after being
ordered to stop.
San Mateo County Sheriffs Deputies were requested. Both men were taken into custody
for being drunk in public.

Sep 29 Two bicyclists riding in the preserve discovered an indivdual alongside the trail. The 4 LIFE
AR 11S219 person had been in the preserve for two days and nights in a location far enough off the PAF 2
trail to be invisible. He hadn then crawled to the trail to get help.
PAPD 2
District staff were contacted and responded to the scene and also contacted Palo Alto Fire
and Police departments. The man had inflicted several cuts to his abdomen and groin,
exposing his internal organs. He was conscious and responsive, but lacked a regular
radial pulse and his blood pressure was so low as to be unreadable.
District staff provided medical care, including oxygen. The fire department provided
advanced care, including an IV. The patient was transported to hospital by helicopter.

Oct 08 District Rangers received a report that a car break-in was in progress. The report was 3
IR 11F307 relayed from the Santa Clara County Sheriffs Department. Rangers responded and saw
the reported subjects driving away in a car. The rangers followed the car and requested
that Sheriffs Deputies and San Jose Police respond. Neither department was available to
respond so the Rangers stopped following the subjects. A ranger left a note on the victims
car asking that they contact a ranger and the sheriffs department concerning the break-in.

Oct 22 A District Ranger was investigatigating two cars that had been parked at the Redwood 3 SMCF
IR 11S231 Trailhead overnight,when a couple walked up. They told the ranger that they had seen a SMCSO 6
body hanging from a tree. The couple were illegally camping in the preserve when they
saw a backpack,left alone. The next morning the pack was still at the location and the SMCCOR 1
couple decided to look in it,when they noticed the body. District Rangers responded with
fire and located the body. The incident was turned over to the San Mateo County
Coroners Office.

IR 11S236 emergency helicopter landing in the preserve. He stated that the fog had rolled in
unexpectedly and he felt flying any further would be dangerous.
He was given a ride out by a friend and returned to retrieve the helicopter the next
morning. At that time he made contact with the employee resident who notified the Skyline
Ranger Staff who responded to take a report.

Nov 08 While on foot patrol a Ranger heard what
sounded like Airsoft guns being fired. Two 3 PAPD 1
IR 11S249 people with a duffle bag and a small backpack were contacted inside Gate FH01 . One
person admitted to having a loaded handgun, and Airsoft guns. Both subjects were
searched, and temporarily handcuffed for the rangers'protection. A loaded handgun and
two Airsoft guns were found. Palo Alto Police responded and cited one of the suspects for
carrying a concealed weapon and for violation of District Ordinance 403.1 (Discharge of
weapon on District lands).

Nov 12 While on patrol a Ranger observed a bicyclist in the preserve after official closing. When 2
IR 11S255 contacted,the visitor became verbally abusive and belligerent. After being cited he threw
the citation on the ground, uttering more obscenities. He also claimed that he worked for
the FBI and threatened that he had friends at Homeland Security,and the IRS,who could
make things difficult for the rangers.
The person was advised that not responding to the citation could result in a bench warrant;
after which he picked up the citation still uttering more obscenities. Rangers contacted the
FBI, and confirmed that the individual is not an employee. The suspect was contacted by
the FBI and warned not to impersonate an FBI employee.

IR 11S262 and both were released. A check of the District's database revealed that they were repeat
offenders.

Nov 25 Extensive vandalism and damage was discovered at the former Woods Estate. District 1 SMCSO 4
IR 11S265 Rangers discovered several broken windows in both the main house and the carriage
house,and doors on the three structures were left open. In addition, Graffiti was found in
one of the rooms,the area was littered with empty cans,cigarette butts,and
miscellaneous trash. Woodside Fire advised that they had been on the property and
believed someone had gone under the chain link fence. They also stated a light had been
left on in one of the structures. District Staff noted that the chain link fence gate appeared
to have been tempered with.
The San Mateo County Sheriffs office was requested to make a report. The Deputy
advised posting no trespassing signs and installing video monitoring equipment.

Nov 27 An individual was severely injured when he was riding downhill on a trail which is 1 HMBF 3
AR 11S268 seasonally closed to bicycles. He attempted to jump over a downed tree branch,and
caught his back tire on the branch. District Rangers arrived to find the victim was being
treated by Half Moon Bay Fire. Rangers took a report from the witnesses,who were given
verbal warnings for riding on a closed trail.
The patient was transported to the hospital where he underwent surgery for a broken hip
and a severed tendon in the shoulder. A District ranger investigated the accident scene.
There was a skid mark below the branch 15'in length followed by an extensive skid mark
from where the individual hit the ground. In addition to his injuries,there was also damage
to his bicycle helmet.

Nov 30 A Ranger drove up on an in-progress auto burglary at a preserve trailhead. The suspect 1 LGPD 2
IR 11F357 fled in a vehicle at a high rate of speed. The Ranger radioed in a description of the
vehicle,and a direction of travel.
Los Gatos Police searched for the suspect, but were unable to locate him. The victim was
contacted,and he said that a backpack containing a camera and jewelry were taken from
his vehicle. A report was taken by Los Gatos Police.

MA 11 S274 cabin on fire. A District Ranger was first on scene. The fire was ultimately extinguished by PGE
CalFire, but the home was a total loss.

District Staff provided medical assessment and treatment to the owner of the residence.
She declined further medical treatment.

Dec 03 District Rangers received a report from Mountain View dispatch of a suspicious 6 CDF 1
IR 11S275 circumstance in the preserve. A male had run away from his female companion, into the SMCSO 1
preserve, and had not returned. Rangers were first on scene and obtained information
from the female companion. The woman said that after inhaling a single hit of a marijuana
cigarette,the male had"gone berserk"and run into the woods. He had not returned after
90 minutes,so the woman returned to the preserve parking lot and called for assistance.
San Mateo County Sheriff and CalFire responded. The man returned,and was checked
for medical issues and also for being under the influence of drugs. He was covered with
scratches and blood on his face, neck, arms and legs. After being cleared,the man was
transported by a deputy to a location where he could be picked up by a taxi. The woman
was transported by a friend.

Dec 06 A District powered wheelbarrow,with a value of$7,000,was stolen from the preserve. 2 SMCSO 1
IR 11 S279 The wheelbarrow had been cable-locked to a tree near the Horseshoe Lake dam at the
end of the work day Friday. When the crew returned to work on Tuesday the equipment
was missing.
A thorough search was conducted and eventually tracks from the equipment were found
leaving the Preserve. The San Mateo Sheriffs office was requested and took a report.
There were no witnesses or suspects identified.

Dec 28 A person who was hiking,experienced chest pain and possibly lost consciousness. EMS 5 2
AR 11F392 was activated. District Rangers and fire responded and found the patient on a single track SCCF 3
trail. The patient was treated and taken by wheel litter to the trailhead. The victim was
taken to the hospital by ground ambulance.

Dec 28 Two juveniles were reported to be riding motorcycles in the preserve. Two District 2
IR 11F393 Rangers responded, located,and stopped the motorcycles. Both juveniles were issued
JCR's(citations)for operating motorcycles on District Lands and were released to one of
the juvenile's uncles.

SUBJECT: Stevens Creek Shoreline Nature Study Area(Site 25) Clean-up
This memorandum provides an update on the site cleanup activities that are planned at the
District's 55-acre Stevens Creek Shoreline Nature Study Area.
Background
The District's Stevens Creek Shoreline Nature Study Area is located in the Mountain View
baylands, adjacent to Moffett Field. This small Preserve forms part of a larger seasonal pond
that serves as Moffett Field's stormwater retention basin, known as Site 25. Since 1953, during
the Navy's operation of Moffett Field, this fully diked seasonal pond has been part of the storm
water management system for the western portion of Moffett Field. Over many decades, this
retention basin had been collecting surface runoff with suspended, contaminated sediment. This
retention basin continues to collect runoff to this day, however, the sources of contaminants have
been recently isolated and either remediated or contained. The contamination that has previously
accumulated within Site 25 is the subject of a remediation effort that has spanned nearly 20
years. The Navy is responsible for the environmental cleanup at Site 25 and has been working
with numerous agencies, including the US Environmental Protection Agency and California
Regional Water Quality Control Board, to prepare a remedial action plan for this site. Extensive
investigations at Site 25 have confirmed the presence of DDT, polychlorinated biphenyls
(PCBs), lead, and zinc (chemicals of concern) at levels requiring remediation.
Cleanup Approach
After many years of discussion with the various regulatory and oversight agencies, and in
consultation with US Fish and Wildlife Service and California Department of Fish and Game,
the Navy has finalized an approved Remedial Design/Remedial Action Work Plan for Site 25
and is expecting to begin cleanup work shortly. The cleanup will consist of the excavation of
sediment at known hot spots that contain elevated levels of the chemicals of concern. Remedial
goals have been established to be protective of ecological receptors, which were based on known
sensitive bayland wildlife, and set for a tidal marsh scenario. The tidal marsh scenario is
comparatively more protective than the scenarios of a managed pond or storm water retention
pond, and addresses the District's concerns of not precluding a future restoration of the property
to tidal marsh. The selection of areas to be excavated was based on prior investigations,
including numerous soil samplings.
Sediment removal is scheduled to take plan in summer-fall 2012. Areas that need to be cleared
of pickleweed will be done using manual tools with a biologist present to monitor the clearing.
Temporary dams will be deployed within the seasonal pond to partition the pond into three zones
beginning in May 2012. Water from each zone will be pumped to other zones to allow the work
to occur. To address concerns regarding contaminant dispersal due to water pumping, effluent
samples will be taken daily at the pump discharge point and a field meter will monitor turbidity.
If results detect changes that are much higher than baseline levels, pumping will cease and the
operation will be reassessed.
Confirmation samples will be taken after sediment excavation is completed to verify the
attainment of the do-not-exceed Remedial Goals at each excavation site. The Navy's Operations
and Maintenance requirements for the cleanup work include ecological monitoring,replanting of
salt grass and pickleweed, and inspections of the re-vegetation work. Also, the Remedial
Design/Remedial Action Work Plan includes biological and ecological protection measures,
including pre-construction surveys, site inspections, and documentation, to protect listed and
special status species. Also, preconstruction photo surveys of existing infrastructure will be
conducted so that possible impacts related to the cleanup activities can be assessed and
appropriate repairs can be made.
A District permit to enter has been provided to the Navy to allow the work to commence,
including all preconstruction surveys and mobilization. The San Francisco Bay Trail (which
traverses the edge of District Property) will be closed on the east and west sides during work
hours. Notice of actual closure dates will be provided to the Association of Bay Area
Governments, US Fish and Wildlife Service, and the District at least 3 weeks in advance of the
closures. The District will post these closures at the site and on our District webpage.

The Midpeninsula Regional Open Space District strongly supports AB 2388 which would
assist the Santa Clara County Open Space Authority(OSA) in preserving vital open
space lands by allowing it to use its time, revenue and staff resources much more
efficiently and in a manner that is entirely consistent with the best practices of other open
space districts in California.
The OSA was created by the Legislature in 1993, at the behest of the community, in order
to preserve key portions of Santa Clara County's natural environment. At that time, PRC
Section 35159 required bidding on all contracts above $10,000. Other open space
districts in California and the Bay Area, however, have a $25,000 threshold for bidding.
AB 2388 amends PRC Section 35159 by raising the threshold for requiring bidding and
Board approval of the lowest responsible bidder from $10,000 to $25,000.
In addition, PRC 35159 requires that the OSA adhere to lowest responsible bidding
requirements for all services including planning, management training and other routine
administrative functions. This compels the agency to select the lowest bidder—
regardless of the qualifications of the contractor. AB 2388 also removes the requirement
that services be subject to lowest responsible bidding procedures and, as a result, the
OSA will ultimately spend less money because the lowest cost service provider
frequently provides less overall service.

We urge you to support this critical change in the OSA's enabling legislation. AB 2388's
sensible amendments will in the long run save taxpayers money, result in more efficient
and effective protection of public open space lands and allow OSA to create more
opportunities for public recreation.
