APPROVE THE AGENDA Council Member Council Member Holmes moved to approve the agenda as submitted. Council Member Council Member Sowers seconded the motion. The Police Chief upon receipt of the application shall make a recommendation to the City Clerk to approve or deny the application. Whenever the City Clerk shall determine that an application for alcoholic beverage license transfer or renewal is complete, the City Clerk shall approve or deny such application. All decisions of the City Clerk shall be reported to the City Council at the next regularly scheduled City Council meeting after such decision. The City Clerk is also responsible for all processing of business, taxi, snow removal, pawnbroker, child daycare licenses, vendor permits, and public event applications. Action: Council review the License report. AB 20-245 Request for Approval of a Proposal for Construction Engineering and Inspection (CEI) Engineering Services – Legacy Intake Station Construction: This agenda item is a request for approval of a proposal for engineering services for construction engineering and inspection (CEI) for the Legacy Park Intake Station Reconstruction Project. The construction contract for this project was approved at the 8/24/20 City Council meeting. This proposal will allow the Project Engineer, Project Architect, structural engineer, and SCADA engineer to assist the City and the Contractor to complete the project in accordance with the project plans and specifications and DEQ requirements. Action: Approve the proposal for engineering services for Clear Solutions Engineering in the amount of $44,159 and authorize the Mayor to sign all necessary documents. AB 20-246 Request Approval of a Service Agreement with Garden Valley Cottages, LLC to widen and overlay Porous Pave cart path in front of 7 Birch Tee: Last year, the Porous Pave company did a test area of cart path at the Golf Course where the pressure sewer line had been repaired and the path removed. The Pathway was not wide enough and was damaged during winter snow removal. The agreement with Garden Valley Cottages would widen and patch the existing path to make it match the width of the other paths and help with snow removal. Action: Approve the service agreement with Garden Valley Cottages, LLC to widen and overlay Porous Pave cart path in front of 7 Birch Tee and authorize the Mayor to sign all necessary documents. AB 20-250 Request to Authorize the Library Director to sign the Idaho STEM Action Center Public-Private Partnership (P3) Grant Award Agreement Amendment: In 2019, the McCall Public Library was awarded a $50,000 Public-Private Partnership (P3) grant from the Idaho STEM Action Center to support the construction of an educational classroom (aka MakerSpace) within the McCall Public Library Expansion project. The $50,000 grant award was matched by $100,000 in private donations contributed to the Library Foundation for a total grant contract amount of $150,000. With the onset of COVID and the outcome of the May 2020 Library bond election, an extension to the grant agreement and project schedule is needed to accommodate the revised anticipated Library construction schedule. Therefore, the amendment to the grant agreement extends the project timeline to May 15, 2023. The award agreement calls for the Library Director’s signature and this agenda bill is asking for that permission. Action: Authorize the Library Director to sign the Idaho STEM Action Center Public-Private Partnership Grant Award Agreement Amendment. AB 20-251 Request for approval of Idaho Broadband Grant Agreement for the McCall RAPID project: The Coronavirus Aid, Relief, and Economic Security Act (CARES Act) is a Federal Program to provide emergency assistance for individuals, families, and businesses affected by the 2020 coronavirus pandemic. Under the Idaho CARES Act Broadband Program, the City of McCall is eligible to receive an apportionment of CARES Act funding distributed through the State of Idaho, Department of Commerce. On August 26, 2020, Idaho Commerce announced the City has been approved for $771,063 in Idaho Broadband CARES Act funding to support implementation of McCall’s RAPID broadband effort. This grant funding will be used to install and splice fiber throughout the entirety of conduit already in the ground (~12 miles), provide wireless service in 5 separate locations across the City for public access for distance learning, and complete the bid alternate route of the Buried Conduit, Phase 2 project. These funds are required to be spent on shovel ready projects that can be completed before December 15, 2020. At its August 27, 2020 meeting, Council accepted the grant award pending review of the grant agreement. Idaho Commerce has provided the Idaho Broadband Grant Agreement and it has been reviewed by staff and the City Attorney. Action: Approve the Idaho Broadband Grant Agreement and authorize the Mayor to sign all necessary documents. AB 20-254 Request for Approval of a Service Agreement with Skiftun Land Surveying for a topographic and detail survey for new clubhouse ramp: A topographic and detail survey of south side of the clubhouse is needed for a new handicap ramp. This project is in the CIP to replace the ramp because the existing does not meet code and is falling apart. The survey is needed as part the engineering and design in the FY20 budget. Construction is in the CIP in FY21. Action: Approve a Service Agreement with Skiftun Land Surveying for a topographic and detail survey for new clubhouse ramp and authorize the Mayor to sign all necessary documents. Council Member Holmes moved to approve the Consent Agenda as submitted. Council Member Nielson seconded the motion. In a roll call vote Council Member Holmes, Council Member Nielsen, Mayor Giles, Council Member Maciaszek, and Council Member Sowers all voted aye, and the motion carried. The opportunities for a new comer are vast. The last 30 plus years have seen positive changes and lost opportunities for the future. As a past P&Z, Historical and several other committees' member reviewing all the facts and planning is a tough and unforgiving position to be in. You taking on the position you have is remarkable and we thank you for doing your part to further the positives for Valley County. The hardest thing in any public service committee is looking beyond what is here today for the twenty plus years ahead. Your council meeting of 10 Sept 2020 presents you with the opportunity to review the facts and findings of The Stibnite Gold Project. This project has been in the works for many years enabling folks to learn and educate oneself about the project for a long time. We ask that you assure yourself with your own education, site visits, and asking question so that a fact based opinion is arrived at. To the point, Stibnite is a Brown Field site that has to be cleaned up ASAP. Thank you for your time and service. REPORTS McCall Chamber of Commerce Monthly Report Lindsey Harris introduced Haley Johnson, a new member of the Chamber of Commerce. They updated the Council on the various topics the Chamber is working on including the winter 2020- 2021Visit McCall Magazine; a virtual restaurant industry round table with the regional task force to support restaurants as they transition from summer and fall/winter with limited patio seating as the weather shifts on September 15th; and the virtual annual Idaho Conference on Recreation and Tourism. They also assured the Council that Winter Carnival 2021 is still going to happen. There will be changes to accommodate for covid-19 concerns, but the carnival will still take place. Monthly City of McCall Department Reports City Manager Council had no questions. Airport Council had no questions. City Clerk City Clerk BessieJo Wagner answered questions regarding the 2020 Winter Carnival Local Option Tax funded fireworks. Community & Economic Development Community & Economic Development Director Michelle Groenevelt gave a brief report on the Local Housing Committee. Golf Course Council Member Sowers commended the department on how great the course was looking. Information Systems Council had no questions. Library Council Member Holmes complimented the library on the Walk with the Library event. Parks and Recreation Council Member Holmes stated she has received multiple compliments from the public on how much they love the Rotary Park swim lanes. Mayor Giles thanked the Parks staff for all of their good work. Police Council had no questions. Public Works Council Member Holmes thanked the department for the bollards at the end of East Lake Street as it has been very effective in controlling traffic from going the wrong way. Mayor Giles is amazed at what has been accomplished on the downtown project. AB 20-248 Parks and Recreation Advisory Committee Annual Accomplishment Report Forest Stanley, Parks and Recreation Advisory Committee Chair, presented the annual accomplishment report. The Parks and Recreation Advisory Committee is established pursuant to Idaho Code 50-210 to advise and make recommendations to the McCall City Council on matters pertaining to the operations, management and programming of the McCall Parks and Recreation Department. The Committee consists of seven voting members serving rotating three-year terms. Forest Stanley shared highlights of the last year of the different recreational programs, commended the Parks staff on how well they did on keeping the city parks clean even after busy holiday weekends, and touched on Parks operations. He spoke to recreational field space ideas, the delay with the Parks & Recreation Master Plan update, the pocket park development, and deferred projects and challenges. The Council thanked the Committee for all of their efforts for the City. BUSINESS AGENDA AB 20-249 Request to appoint Dawn Matus to the McCall Public Art Advisory Committee Economic Development Planner Delta James presented the appointment of Dawn Matus to the McCall Public Art Advisory Committee (PAAC). The mission of the PAAC is to make recommendations to City Council regarding public art projects and policies within the City of McCall. The PAAC was formed in 2012 by resolution of City Council (Resolution 12-13), consisting of five members appointed by City Council. Resolution 19-10, adopted by City Council on June 13, 2019, expanded the committee size from five (5) to seven (7) members. Members are appointed to three-year terms, which are renewable for one additional term. Due to other commitments, Dave Peugh has submitted his committee position resignation creating one vacancy on the committee. The position vacancy was advertised for two weeks resulting in letters of interest from four applicants. One applicant subsequently withdrew his application and, therefore, at its August 31, 2020 meeting, the PAAC interviewed the three remaining applicants and unanimously recommended Dawn Matus to City Council for appointment to the committee. The other two applicants, after learning more about the roles and responsibility of the committee, have since removed their application for consideration and, instead, have requested to participate in an upcoming public art project committee. Dawn Matus introduced herself and shared her education and experience in the art world and journalism. Council Member Holmes moved to appoint Dawn Matus to the McCall Public Art Advisory Committee for three-year term expiring September 2023. Council Member Maciaszek seconded the motion. In a roll call vote Council Member Holmes, Council Member Maciaszek, Mayor Giles, Council Member Nielsen, and Council Member Sowers all voted aye, and the motion carried. AB 20-247 Request for Approval of a Contract for Services with HDB Marine to install six steel piles in two clusters of three to mitigate movement of docks at Art Roberts Park (Pending permits from Idaho Dept. of Lands) Parks & Recreation Director Kurt Wolf presented the Contract for Services with HDB Marine to install six steel piles in the lake off the end of each dock to mitigate movement of docks at Art Roberts Park. The piles will be driven in a triple configuration similar to those at May Marina and in other areas around the lake. In total, there will be two locations consisting of six piles in two clusters of three. The contractor is mobilized in McCall doing other work on the lake and pending permits from the Idaho Department of Lands, staff would like to capitalize on the availability of the pile driver while it is in the area and avoid future mobilization costs. The Council had no questions. Council Member Maciaszek moved to approve Proposal for contracted services with HDB Marine with funding assistance from the County Waterways Fund to install piles off the shore of Art Roberts Park to better secure dock systems and authorize the Mayor to sign all necessary documents. Council Member Sowers seconded the motion. In a roll call vote Council Member Maciaszek, Council Member Sowers, Mayor Giles, Council Member Holmes, and Council Member Nielsen all voted aye, and the motion carried. AB 20-244 Local Housing Incentive Program Deed Restriction for 117 Broken Pine (lot 42) Community & Economic Development Director Michelle Groenevelt presented the Local Housing Incentive Program Deed Restriction for 117 Broken Pine (lot 42). The West Central Mountain Housing Trust has voluntarily agreed to place the deed restriction on the townhome unit located at 117 Broken Pine in the new Broken Ridge subdivision located off Boydstun Lane per Resolution 19-02 Local Housing Incentive Policy. This is the first local housing deed restriction and reimbursement that will be implemented and was previously approved by Council on July 9, 2020. The Local Housing Deed Restriction template has been revised to reflect the actual purchase price of the townhome at $307,000. The previously approved deed restriction listed the base price as $250,000. Staff clarified a few minor details, shared the reason behind why the price was higher was not known, and answered questions about rental caps. Council Member Nielsen moved to approve the Amended Local Housing Deed Restriction for West Central Mountains Housing Trust and allow Mayor to sign all necessary documents. Council Member Holmes seconded the motion. In a roll call vote Council Member Nielsen, Council Member Holmes, Mayor Giles, Council Member Maciaszek, and Council Member Sowers all voted aye, and the motion carried. AB 20-252 Stibnite Gold Project Draft Environmental Impact Statement Update and Direction to Staff City Manager Anette Spickard presented the Stibnite Gold Project Draft Environmental Impact Statement (DEIS) update. The Forest Service is accepting public comments on the DEIS for the proposed Stibnite Gold Project, also referred to as the Midas Gold project, which is a gold and antimony mine operation seeking a permit to operate on approximately 3,500 acres of federal, state, and private lands near Yellow Pine. The DEIS analyzes 5 alternatives: 1) the original proposal, 2) an amended proposal submitted by the company, 3) a proposal to relocate the development rock and tailing storage facilities to avoid or reduce potential impacts to federally listed fish species, 4) a proposal from the Forest Service and Cooperating Agencies responding to significant issues identified during the project scoping phase, and 5) the no action alternative. The company is soliciting public support for alternative 2. Specific written comments will be accepted until October 13, 2020. All project documents, proposals, and analyses are found at https://www.fs.usda.gov/project/?project=50516. Manager Spickard shared that the City will see increased traffic and staff is primarily focused on reviewing the analysis related to transportation impacts and socio-economic impacts as they relate to the City of McCall. One item of note that stands out in the report is the identification of Lick Creek and Warm Lake roads as possible routes to the site, but not identified was how they would travel between Highway 55 and Lick Creek roads. She will be working with staff to gather comments and questions for this issue. The Council may wish to provide additional comments related to any part of the project. Council can continue this discussion at the September 24, and if needed the October 8, meetings with the goal of approving submittal of comments at the October 8 meeting. The Council shared their concerns. Council Member Holmes expressed concerns with the Lick Creek route and expressed the need to address safety and sidewalks for both Davis Ave. and Lick Creek Road. Council Member Maciaszek echoed Council Member Holmes sentiments. Council Member Sowers is also concerned with the Lick Creek route and what Midas Gold will be doing ( to help with the improvements of those roads. Council Member Nielsen would like consideration given to the incident response impact of any emergencies the mine may have on the City's emergency response team. Staff will prepare their comments for the Forest Service. COVID-19 Update Police Lieutenant Dallas Palmer gave the update. The latest number of positive cases is at 34,310 with a 10% increase since the last update to Council and is lowest increase since Memorial Day weekend. Governor Little will keep the State at level 4 for the next two weeks. A local mask mandate will remain in place as the Central District Health (CDH) order has no expiration date. Enforcement has gone well and the CDH has moved the McCall-Donnelly and Cascade school districts from yellow level to green due to the lack of new cases. No changes will be made in the schools until after the impact of the Labor Day weekend is known. City Manager Anette Spickard shared that the City has been dealing with the impact to staff since the schools have started up again. Upcoming Meetings Schedule Discussion Council discussed upcoming meetings. Council Member Holmes shared she may have a conflict for the September 24 meeting.
