HomeMy Public PortalAboutResolution 81-982 PCRESOLUTION NO. 81 -982 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY GRANTING A CONDITIONAL USE PERMIT IN CASE NO. 81 -644 THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. A Conditional Use Permit is hereby granted to maintain and operate a 32 -run dog kennel which has heretofor been a legal nonconforming use, and to allow expansion of the kennel by the addition of a new office, which will be attached to the rear of the house replacing an existing open patio cover on property located at 4943 Encinita Avenue, a por. of Parcel 19 of Record of Survey (L.A. Co. Rec. R.S. 56 -12). SECTION 2. Findings: 1. The kennel has been in existence and operation continuously since before the City was incorporated. 2. Since incorporation of the City, the kernel has not been expanded or in any way violated the nonconforming use pro- vision of the Zoning Code. 3. The applicant now desires to enlarge the kennel by the construction of a new 265 sq. ft. office, but such addition would be a violation of Section 9273 regarding additions to nonconforming uses. 4. The conditional use permit for the kennel would remove the nonconforming status and would then allow additions to be made to a "conforming" kennel. 5. The use is appropriate to the zone and to the area and is adjacent to kennels on two sides and very close to a third kennel across Encinita. 6. The kennel use conforms to the provisions of the General Plan as they apply to the subject area. SECTION 3. Conditions: To this conditional use permit as approved by the Planning Commission, the following conditions are imposed: 1. Construction of the new office shall be substantially as shown on submitted Plan "A ". 2. All necessary permits shall be obtained from the Building Department. 3. The kennel operation shall not be expanded by the addition of any new runs or dog keeping areas except as specifically approved by the Planning Commission. 4. To the max;m►m, extent possible, the operation of this kennel shall comply with City standards for kennels. 5. To ensure operation standards are being met, the operator shall allow inspection of the premises by Planning Department staff or Animal Control personnel and shall accompany staff on such inspection. Inspection shall be by appointment only. 6. Applicant shall file, or cause to be filed, with the City Clerk, a document which the City may record, which shall acknowledge that the owner of the subject property is aware of and accepts the conditions set forth in conditions 1 through 5 above, and that the subject property, regardless of any change in ownership, is bound by and subject to the provisions of the resolution granting the conditional use permit and the conditions contained therein. 7. This conditional use permit shall become effective immediately following the 10 -day appeal period. SECTION 7. The Secretary of the Planning Commission shall certify to the adoption of this Resolution and shall forward a copy thereof to the applicant and to the City Clerk.
