AMENDING CODE OF THE BOROUGH OF CARTERET, SECTION 198
ENTITLED "PROPERTY MAINTENANCE"
BE IT ORDAINED that Section 198 of the Code of the Borough of Carteret is amended as
follows:
Enforcement Officer
The Code Enforcement Officer Fire Sub-Code Official or Police personnel shall be considered
the enforcement officers of the provisions of this article.
Notice of Violation
The Enforcement Officers shall serve written notice of violation of order on the person or
persons responsible for the erection, construction, alteration, repair, maintenance, use and
occupancy of any premises in violation of the provisions of the Article. Violators shall be
_ allowed ten (10) days to abate said conditions before further action is taken unless, in the
opinion of the Enforcement Officer, special reasons or conditions have been demonstrated to
allow for an extension of this time period.
Appeals
Within ten (10) days of notification of violation of this Article or within the extended time
period as permitted by the Enforcement Officer, an owner or operator may appeal for relief
from the provisions of this Article to the Council. Said appeal shall be acted upon within
forty-five (45) days of the date of appeal, and if action is not taken during that time period
or during an extension of that period as agreed to between the Enforcement Officer and the
owner or operator, the relief shall be considered granted.
Emergencies
In the event that a nuisance or hazardous condition exists which in the opinion of the
Enforcement Officer, places individuals on or near the site in immediate danger or in the
opinion of the official causes inconvenience and distraction from the neighborhood, that
condition shall be immediately rectified by the owner or operator. If said immediate action
is not taken the Enforcement Officer shall cause said action to be taken. The expense for said
remedial action shall be borne by the owner or operator.
