HomeMy Public PortalAbout77-089 (10-04-77)• • • 4 RESOLUTION NO. 77 -89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION NO. 67 -9 ESTABLISHING ON AND OFF- STREET PARKING SPACES FOR EXCLUSIVE USE OF PHYSICALLY HANDICAPPED PERSONS WHEREAS, effective January 1, 1976, the California Vehicle Code was amended to permit a local authority by ordinance or resolution to designate parking spaces for the exclusive use of handicapped persons whose vehicles display special distinguishing license plates or placard issued to disabled persons or disabled veterans; and WHEREAS, the enforcement of such parking is pursuant to the requirements of Section 9105 and 22511.5 of the California Vehicle Code; and WHEREAS, the intent of such ordinance or resolution is to authorize strategically located parking spaces for handicapped persons traveling in specially licensed vehicles on public streets and in publicly owned leased or controlled off- street parking facilities: NOW, THEREFORE THE CITY COUNCIL of the City of Lynwood does hereby resolve as follows: SECTION 1. Definitions a. On- street parking shall mean vehicle parking on public ways. b. Off - street parking facility shall mean any publicly owned parking lot, or facility located off the public way for the express purpose of- providing vehicular-parking. C. "Administrative Authority" shall mean the Director of Public Works. d. Physically handicapped persons shall mean any person who has lost the use of one or more limbs or both hands or is severely disabled as to be unable to travel at a reasonable rate of speed with or without the aid of a mechanical device. �y SECTION 2. Establishment of On- Street Parking Spaces When so directed by the City Council, by ordinance or resolution, the Director of Public Works is hereby authorized and directed to desig- nate parking spaces for the exclusive use of physically handicapped persons whose vehicles display a distinguishing license plate or placard issued to disabled persons pursuant to Section 22511.5 of the Vehicle Code or to disabled veterans, as specified in Section 9105 of the Vehicle Code. Such parking space shall be indicated by blue paint on the curb or on the edge of the paved portion of the street adjacent to the space. In addition to blue paint, this space may also be indicated by standard approval signs consisting of a profile view of a wheelchair with occupant in white on a blue background posted immediately adjacent to, or visible from, each parking space. SECTION 3. Establishment of Off - Street Parking Spaces a. The Director of Public Works when so directed by the City Council's ordinance or resolution, is hereby authorized and directed to designate spaces in publicly owned, leased or controlled off - street parking facilities for the exclusive use of physically handicapped persons whose vehicles display a distinguishing license plate or placard issued i to disabled persons pursuant to Section 22551.5 of the Vehicle Code or to disabled veterans, as specified in Section 9105 of the Vehicle Code. 1 Such designation shall be made by posting a sign immediately adjacent to and visible from each stall or space, consisting of a profile view of a wheelchair with occupant in white on a blue background. In addition to the signs, such spaces may also be identified by a painted message and /or symbol on the pavement within each space. I b. There shall also be posted immediately adjacent to and visible from such space, a sign which clearly and conspicuously states the following: "Unauthorized vehicles not displaying distinguishing license plates or placard issued to physically handi- capped persons will be towed away at owner's expense. Towed vehicles may be reclaimed by telephoning Lynwood Sheriff's Station, 537 - 6111." APPROVED AND ADOPTED THIS 4th DAY OF October, 1977. ES E.
