HILLSBOROUGH TOWN BOARD
February 9, 1998
Town Barn
The Hillsborough Town Board met in Closed Session on February 9, 1998 in the Town
Barn. Present for the Board Meeting were Mayor Horace H. Johnson, Sr., Commissioners
Richard Simpson, Catherine Martin, Frances Dancy, and Evelyn Lloyd. Absent from the meeting
was Commissioner Kenneth Chavious. Staff present were Town Manager Eric Peterson, Town
Clerk Donna F. Armbrister, Finance Director Sherry Carter. Others present were Nick Herman
from the Town Attorney's Office.
CLOSED SESSION
1. Closed Session for the purpose of discussing potential litigation and a personnel
matter
Finance Director Sherry Carter presented two delinquent Food and Beverage Tax
situations to the Board and requested guidance. The two restaurant owners were Neil Littman
(Oliver's) and Kelly Akins (Kelsey's Cafe, The Corner, and Kelsey's Restaurant and Tavern).
After some discussion, and by consensus, the Board directed the staff and Town Attorney
to proceed with the issuance of a warrant for Neil Littman for the delinquent Food and Beverage
Tax due to the fact that this has been habitual and due to the amount of lateness.
Commissioner Martin requested to be excused from the discussion of Kelly Akins'
delinquency due to the fact that her husband is Mr. Akins' Attorney which might be a conflict of
interest.
By consensus, the Board excused Commissioner Martin from the discussion.
After some discussion, and by consensus, the Board directed the Town Attorney to write
the standard collection letter to Mr. Akins to encourage compliance.
Upon a motion by Commissioner Lloyd, seconded by Commissioner Simpson, the Board
moved to return to Open Session by a vote of 4-0. The motion was declared passed.
By consensus, the Board invited Commissioner Martin to rejoin the Closed Session.
