HomeMy Public PortalAbout2012.078 (04-17-12)RESOLUTION NO. 2012.078 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AMENDMENTS TO THE EXISTING AGREEMENT BETWEEN THE CITY AND MUNISERVICES, LLC AND APPROVING A 1 -YEAR EXTENSION WITH OPTION TO RENEW TO PROVIDE SALES AND PROPERTY TAX ANALYSIS AND REPORTING SERVICES, AND ON -GOING SALES AND PROPERTY TAX AUDIT RECOVERY SERVICES WHEREAS, on October 5, 2010, the City and MuniServices entered into an initial one -year term to provide sales tax, property tax and audit recovery services for the City and then, Lynwood Redevelopment Agency, with two one -year options to renew existing agreement at the City's discretion; and WHEREAS, the initial one -year term ended on October 4, 2011 and due to the uncertainty with regard to redevelopment agencies, the City did not exercise its right to extend existing agreement for an additional year; and WHEREAS, due to ABx1 26 provisions to dissolve redevelopment agencies, staff saw a need to renegotiate and amend the existing agreement to omit all services relating to redevelopment, and WHEREAS, the new proposed agreement will also allow MuniServices to continue to provide services to the City for an additional year, with two one -year options to renew agreement at the City's discretion. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council approves a new agreement between the City of Lynwood and MuniServices, LLC and authorizes the Mayor to execute attached Agreement in a form approved by the City Attorney. Section 2 . Total contract amount shall not exceed $10,000 annually for sales tax and property tax analysis and reporting services. Section 3 . For audit recovery services, the City shall remit 20% of newly recovered sales tax revenues and 25% of newly recovered property tax revenues to MuniServices. Since audit findings are on a per basis case and cannot be forecasted, the City Council authorizes the City Manager or his Designee to authorize transfers from received sales tax and property tax revenues to pay for recovery fees due to audit recovery services provided by MuniServices. Section 4. The term of new agreement shall be retroactive to October 5, 2011 and expire on October 4, 2012 and shall include two (2) one -year extension options at the end of each term and can only be exercised by the governmental authority of the City Manager. Section 5. This resolution shall take effect immediately upon its adoption. Section 6. The City Clerk shall certify as to the adoption of this City Council Resolution.
