A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
AUTHORIZING THE MAYOR TO EXECUTE THE REVOCABLE LICENSE
AGREEMENT BETWEEN THE CITY AND ST. FRANCIS MEDICAL CENTER FOR
THE CITY'S OPERATION OF AN ANTENNA ON THE CENTER'S MAIN BUILDING
ROOF FOR THE CITY'S SCADA SYSTEM
WHEREAS, the construction of a new Supervisory Control and Data Acquisition
System ( SCADA) is one of several on -going water projects aimed to improve the
reliability and efficiency of the City's water system; and
WHEREAS, the SCADA system requires the installation and operation of a relay
radio wave antenna; and
WHEREAS, in consideration for the mutual benefits from this project, the St.
Francis Medical Center (the Center) has agreed to grant the City the right to install and
operate said antenna on the roof of its certain building through a License Agreement
(the License); and
WHEREAS, said License was approved by the City Council on January 3, 2012
by Resolution No. 2012.007; and
WHEREAS, the St. Francis Medical Center has requested some changes in the
License language relating to the term, liability insurance and other minor language
modifications; and
WHEREAS, said revised License has been reviewed by the Center's and the
City's legal councils.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. That the City Council of the City of Lynwood hereby rescinds
Resolution No. 2012.007 adopted on January 3, 2012, approving the License
Agreement with the St. Francis Medical Center for the installation, operation and
maintenance of a radio wave antenna on the Center's roof for the Water System's new
SCADA System, Project No. 4011.67.984.
Section 2. That the City Council of the of City of Lynwood approves a revised
Revocable License as shown in Attachment "A" attached herewith with the St Francis
Medical Center for the installation, operation and maintenance of a radio wave antenna
on the Center's roof for the Water System's new SCADA System, Project No.
4011.67.984.
Section 3 . That the Mayor is authorized to execute said Revocable License
prepared in a form approved by the City Attorney.
Section 4 . That this Resolution shall take effect immediately upon its adoption.
Section 5. The City Clerk shall certify as to adoption of this Resolution.
PASSED, APPROVED and ADOPTED this 17 day of April, 2012.
