Following numerous efforts over the years to address these issues with adjacent property owners, it is now apparent that the most timely and efficient way to address sidewalk condition complaints is to have City staff take care of it directly and then bill the property owner. Chasing down property owners or rounding up contractors to do the work and then having to follow up on the process cost significantly more in staff time than simply removing the snow and fixing the problem directly with City staff. Staff consulted with several of the property owners with chronic sidewalk complaints about this new proposed process and fee. The receipt of complaints and response efforts will be coordinated between the Parks and Streets Departments. If Council approves the fee resolution, all property owners with sidewalk frontage will receive a letter from the City reminding them of their obligation to maintain the sidewalk, that the City will respond to complaints, and the established fee will be assessed to the owner for the time needed to abate the sidewalk nuisance as outlined in the attached resolution. Fee calculations have been determined according to State code and are based on administrative time, the hourly rate of equipment use, and the average loaded wage of employees doing the work. The proposed fee was published in the Star News as required by law.  RECOMMENDED ACTION: Conduct a Public Hearing on the proposed fee. Approve Resolution 19-05 to adopt fees to be charged to property owners for removal of snow, ice, and rubbish from sidewalk related matters as outlined in the resolution and authorize the Mayor to sign all necessary documents.
