HomeMy Public PortalAbout2017-51 Supporting the following Legislative Priorities for the year 2018RESOLUTION NO. 2OI7-5I A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; SUPPORTING THE FOLLO\MING LEGISLATIVE PRIORITIES FOR THE YEAR 2OI8; PROVIDING FOR AN EFFECTIVE DATE. V/HEREAS, the Village Council of the Village of Key Biscayne wishes to support the following Legislative Priorities for the year 2018. NO\il THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA THAT IT SUPPORTS THE FOLLOWING LEGISLATIVE PRIORITIES FOR THE YEAR 2018: That the following Legislative Priorities for the year 2078 be adopted by the Village of Key Biscayne: Section l. The Village supports broad exercise of home rule powers granted to municipalities under Florida Constitution and supports legislative deference to municipal powers that it confer under Section 1666.021, Florida Statues. Section 2. The Village supports legislation providing for administrative procedures and required intergovernmental cooperation and planning (including mitigation planning) as a condition to local government land development approvals, and an appeal process, for proposed developments or commercial events projected or likely to cause traffic, public safety, nuisance or other impacts affecting areas outside the jurisdiction of the permitting government, Section 3. The Village supports the Legislature examining the preparation and the response of public utilities to severe weather events and requiring that the cost of undergrounding any electric transmission lines be equally shared by the utilities and all system ratepayers. The Village also supports legislation that provides financial incentives including financing and funding for relocating power lines, protecting sub stations and generating lines and other utilities underground on barrier islands. Section 4. The Village supports legislation that provides financial incentives for beach renourishment on barrier islands and dispensation to be able to add more sand to our beach. The Village also supports legislative efforts to unify and consolidate state and local regulatory agencies that rule to what extent we can renourish our beaches. Additionally, Key Biscayne seeks modification to the criteria used by the Department of Environmental Protection (DEP) in determining and assigning annual funding priorities by incorporating beach access and parking availability of adjacent state and local parks, recognizing different transportation modalities (bicycles), and supporting creative solutions to beach erosion such as breakwaters. Key Biscayne will also promote legislative efforts to enhance cooperation and communications between federal, state, and local regulatory agencies so that beach renourishment projects can be conducted with a minimum of delay and obstacles. Section 5 The Village supports grant and legislative line item funding that enhances local financial capacity to address water resources, drainage, flood mitigation, sea level rise and water supply development. Specifically Key Biscayne requests $500,000 for stormwater pump station and drainage wells at the north end of the Key Biscayne K-8 Center. Section 6. The Village supports legislation for funding sources to mitigate our sand loss because of upstream developments. Section 7. The Village supports Flood Hazard Mitigation that provides financial incentives and policies for addressing sea level rise. Section 8.The Village supports legislation to modernize and improve traffic signalization. Section 9. The Village supports legislation allowing local communities, particularly coastal, to establish pilot programs to regulate and/or ban plastic bags and Styrofoam products. Section 10. The Village supports legislation prohibiting the use of wireless communication devices while driving. Section 11. The Village opposes the anti-lobbying measure. Section 12.The Village supports the development of regional transit efforts and state funding for that purpose. The Village opposes any effort to eliminate and /or divert the revenue stream from the Miami-Dade half-penny transportation surtax provided to municipalities or add additional requirements/limitations on how those dollars can be used by Miami-Dade municipal governments. Section 13. The Village opposes the approval of casino gambling in the State of Florida, either through legislation allowing for a constitutional amendment or by the Constitutional Revision Commission placing such as a measure on the ballot. 2 Section 14. The Village supports legislation that increases current per student funding, increases Safe School funding, increases Exceptional Student Education funding and opposes unfunded mandates. Section 15.The Village supports the legislative initiatives of Miami-Dade County Public Schools and hereby incorporates those by reference (Exhibit A). Section 1.6. The Village of Key Biscayne requests continued funding for the Florida Forever Program and the Florida Recreation Development Assistance Program (FRDAP). Key Biscayne is particularly interested in securing FRDAP support for Civic Center Park and 401 Hampton Corner Park. They are both in the amount of $50,000. Section 17 The Village of Key Biscayne will monitor legislative issues: the Village will direct its legislative consultant to monitor the following issues and provide timely data should these issues be taken up at the legislative session: 1.) Modification of the traffic signalizatioî;2.) Resources, policy changes and permitting support for sea-level arise initiatives such as coastline protection and beach renourishment programs and water programs; 3.) Any reduction to Municipal revenue sources from State Revenue Sharing. PASSED AND ADOPTED this 24th day of October, 2017.
