Approve Amendments to the District's Conflict of Interest Code
GENERAL MANAGER'S RECOMMENDATION2W
Adopt the attached Resolution Amending the District's Conflict of Interest Code
DISCUSSION
Pursuant to Government Code Section 87306.5, every two years the District is required to review
its Conflict of Interest Code and submit a notice to the code-reviewing body(California Fair
Political Practices Commission or FPPC), that specifies whether the Conflict of Interest Code
(Code) is accurate or needs amending. The purpose of Section 87306.5 is to ensure that: "No
later than July 1 of each even-numbered year, the code reviewing body shall direct every local
agency which has adopted a Conflict of Interest Code in accordance with this title to review its
Conflict of Interest Code and, if a change in its code is necessitated by changed circumstances,
submit an amended Conflict of Interest Code in accordance with subdivision (a) of Section
87302 and Section 87303 to the code reviewing body."
The Code must be amended when adding or deleting positions, changing disclosure categories or
changing job titles. Based on these criteria, staff filed the required notice with the FPPC in
September 2012, stating that the District's Conflict of Interest Code needed to be amended due to
the completion of the District's Classification and Compensation Study. The proposed
amendments to the Code are as follows:
1. Addition of the"Accountant"position.
2. Re-naming the position of"Administration and Human Resources Manager" to
"Administrative Services Manager".
3. Re-classification of the"Communications Specialist"to "Media Communications
Supervisor".
4. Addition of the "District Clerk"position.
5. Addition of the"Docent Program Manager".
6. Addition of the"Executive Assistant".
7. Re-classification of the "GIS Coordinator"to "GIS Administrator".
8. Addition of the"Human Resources Supervisor"position.
9. Addition of the"Information Technology Administrator"position.
10. Re-naming the position of"Maintenance and Resource Supervisor"to "Maintenance,
Construction and Resource Supervisor".

11. Addition of the"Natural Resources Manager"position.
12. Re-namingof the"Principal Management Analyst"to "Senior Management Analyst".

classified as"Senior Planner".
In accordance with the FPPC regulations, the District's Notice of Intention to amend its Conflict
of Interest Code has been posted for at least 45 days prior to tonight's Public Hearing on the
matter. As of the writing of this report, the District Clerk has received no public or staff
comments regarding the proposed changes.
A complete copy of the proposed amended Conflict of Interest Code is attached for your review.

Notice of the public hearing and proposed amendments has been posted for the required 45 days

CEQA COMPLIANCE
This is not a project under the California Environmental Quality Act(CEQA).
NEXT STEPS
If approved by the Board, staff will transmit the proposed amendments to the District's Code to
the FPPC for final review and approval. Once approved by the FPPC, staff will implement the
amended Code and notify all affected employees.

RESOLUTION 12-XX
RESOLUTION OF THE BOARD OF DIRECTORS
OF THE MIDPENINSULA REGIONAL OPEN SPACE DISTRICT
AMENDING CONFLICT OF INTEREST CODE
WHEREAS, by Resolution No. 00-73, the Board of Directors of the Midpeninsula
Regional Open Space District adopted a Conflict of Interest Code pursuant to the Political
Reform Act of 1974; and
WHEREAS, Government Code Section 87306.5 requires a biennial review of the
District's Conflict of Interest Code; and
WHEREAS, the District, in accordance with the California Fair Political Practices
Commission Regulation 18750.1 (Title 2 California Code of Regulations Section 18750.1),
has prepared code amendments, noticed affected staff members and the public of its intent
to amend the code, and conducted a public hearing to consider the amendments.
NOW, THEREFORE, the Board of Directors of the Midpeninsula Regional Open
Space District does hereby resolve to repeal Resolution No. 00-73 and adopt the amended
Conflict of Interest Code as contained herein,to be effective on the thirtieth (30) day
following approval of the District's amended code by the Fair Political Practices
Commission.

GENERAL MANAGER'S RECOMMENDATION
Adopt a resolution appointing Director Siemens as the District representative with the SCCSDA,
and appointing General Manager Steve Abbors as the alternate representative.
SUMMARY
The District has a history of participation in the activities of the SCCSDA, through the local
Santa Clara County Chapter. It has been some time since the Board has formally designated who

On July 11, 2012, the Board approved a Resolution (No. 12-34) supporting the inclusion of

is a most recent and powerful example of the various ways in which the SCCSDA is an
important and valuable place for collaboration between special districts.
In order to effectively participate in the activities of the SCCSDA, it is necessary to designate a
representative, and an alternate representative, to the SCCSDA.

Informational Presentation from the National Marine Fisheries Service regarding the Central
California Coast Coho Salmon Evolutionarily Significant Unit Final Recovery Plan
GENERAL MANAGER'S RECOMMENDATION
Receive an informational presentation from National Marine Fisheries Service (NMFS)
regarding the Central Coast Coho (CCC) Salmon Evolutionarily Significant Unit (ESU) Final
Recovery Plan.
SUMMARY
The CCC Coho salmon ESU includes all naturally spawned (reproducing)populations of Coho
salmon within a specific portion of the Central California Coast. Within the District's Sphere of
Influence, this area includes San Gregorio, Pescadero, and Gazos Creeks (all San Mateo County
Coast Coho bearing streams). The CCC Salmon ESU was listed by the state as "Endangered" in
1995 and federally as "Threatened" in 1996 and then re-listed federally to "Endangered" in 2005.
DISCUSSION
The NMFS issued a final Recovery Plan for the CCC Salmon ESU in September 2012. Recovery
Plans are used to identify a road map for restoration of listed species and their ecosystems to the
point that they no longer need protection under the Endangered Species Act.
NMFS will present information contained in the Final Plan to the Midpeninsula Regional Open
Space District Board of Directors.
Many District projects are undertaken that benefit Coho salmon including: implementation of the
Big Dipper Ranch Roads Restoration Project, the El Corte de Madera Creek Watershed
Protection Program, routine maintenance activities, and proposed future work efforts associated
with the La Honda Creek Open Space Preserve Master Plan. In some instances, grant funding
tied to Coho Salmon and other threatened fisheries recovery has been awarded (or applied for) in
order to fund implementation of a specific project.

FISCAL IMPACT
The District, as part of its mission statement, already works to "protect and restore the natural
environment" including Coho salmon habitat, through implementation of strategic purchases,
restoration projects, and by upgrading and maintaining existing infrastructure. Projects that
benefit Coho salmon are anticipated to continue to occur regardless of whether or not a Recovery
Plan has been issued for the species. The Recovery Plan has identified important Coho Salmon
habitat within the District's boundary, and within specific preserves, which can help facilitate
additional grant funding for future acquisition and restoration. The District will continue to seek
grant opportunities to fund Coho salmon preservation and restoration/recovery projects.

Informational Report on the District-wide Interpretative Plan
GENERAL MANAGER'S RECOMMENDATION
Receive an informational presentation about the District-wide Interpretive Plan
SUMMARY
Docent Program Manager Ren6e Fitzsimons will provide an informational presentation about the
District-wide Interpretive Plan. The plan was developed to provide the District with a broadly-
scoped analysis and understanding of the many diverse natural and cultural history assets that are
associated with the District's Preserves and the related interpretive opportunities those assets
represent. The District-wide Interpretive Plan is the District's first comprehensive look at the
need for, and the use and benefits of interpretation.
DISCUSSION
The District-wide Interpretive Plan identifies overarching themes that apply across all of the
District's preserves, examines the unique niche the District serves amongst land management
agencies, establishes criteria to help the District prioritize future interpretive programs or
projects, and assists with the agency's management objectives.
Interpretive stories and messages are identified in the plan that can be provided to visitors to
enrich their experience and to explain the importance of open space land preservation. The plan
also brings together data, information, and professional guidance in a format not previously
available to the District.
In FY2011-12, the development of a multi-media nature tour project at Skyline Ridge Preserve
was completed—a project that was identified in the District-wide Interpretive Plan. Future
interpretive projects for the District will be considered, evaluated, and pursued using the plan as
a decision-making tool when funding and Action Plan priorities allow.

Meeting Agenda Includes Options Regarding Radar Tower—
Los Altos,California [October 15,20121 The Midpeninsula Regional Open Space District invites
the public to attend a meeting on the remaining project elements, including the radar tower
options, for the Mount Umunhum Restoration and Public Access Project taking place on
Wednesday, October 17, 2012, at 7:00 p.m. The meeting will be held at the Historic Del Monte
Building at 100 S. Murphy Avenue in Sunnyvale. Parking is available in the Caltrain parking lot
across the street and in the nearby Macy's parking lot off Washington Avenue (see attached
map).
Rising 31,486 feet, Mount Umunhum is one of the highest peaks in the Santa Cruz Mountains. Its
slopes host a rich diversity of life and contain the headwaters of several creeks. Its name comes
from an Ohlone word meaning"resting place of the hummingbird" and plays a central role in
their creation beliefs. The Almaden Air Force Station operated atop the peak from 1957 to 1979.
The District bought Mount Umunhum from the federal government in 1986 and incorporated it
into the Sierra Azul Open Space Preserve.
In late 2009, the federal government appropriated $3.2 million to the Army Corps of Engineers
to begin cleaning up the former air force station, which is nearing completion. The cleanup
allows the District to begin planning for public access to the peak to provide new recreational
opportunities and breathtaking views of the Valley.
The agenda for the public meeting will feature a selection of the radar tower options. In addition
to the three options that have been put forward, as of the September 19 special meeting two
interim actions have been added for Board consideration. The interim actions allow time for
partnerships and/or outside funding to be secured to implement one of the options and address
its long-term management and maintenance. Information will be available on design
opportunities and constraints, short- and long-term maintenance, and associated costs for all
three options and the two interim actions. For more information see

- District Contributes $414,000 Toward a Long-Term Solution -
Los Altos, California [October 19, 20121 Wednesday night, after careful consideration of the
District's mission and public input received during a two-year planning process, the
Midpeninsula Regional Open Space District Board of Directors voted unanimously to keep the
Mount Umunhum radar tower for five years to provide time for its supporters to develop
partnerships needed to preserve the tower for the long term. The approval by the board of
"Interim Action A: Near-term repair and securing of structure while seeking external
partnerships" came after considering public input, the tower's impact on the recreational and
educational opportunities at the site, and the potential for long-term partnerships to help fund the
retention of the tower.
"We realized the tower is an important part of this project for many of the people who have
provided public comment," said Curt Riffle, president of the District's board of directors. "We
are contributing $414,000 and are looking forward to working with partners over the next five
years who will provide the funding, expertise, and other resources necessary for a long-term
solution for the tower."
The District is excited about the pending opening of the summit of Mount Umunhum to the
public. Mount Umunhum provides a one-of-a-kind opportunity to create a visitor destination rich
with history, recreation and the enjoyment of nature. The first phase of the board-approved plan
for the project that includes design of a trail to the summit and a parking area at the Bald
Mountain trailhead will continue.
"Approval of the Mount Umunhum Environmental Restoration and Public Access Project is the
culmination of more than 25 years of hard work," said General Manager Steve Abbors, "which
included negotiations with the military to decommission the air force station, removal of toxic
materials to protect water quality and the environment, and planning by the District to prepare
the summit for public access in just a few years."

In other board actions, the following project elements were approved on a phased, conceptual
basis:
