No. 13- 176 Date of Adoption 0- 3, 2013 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T &M ASSOCIATES — NOE STREET AREA FLOOD CONTROL PROJECT WHEREAS, the Borough of Carteret is in need of specialized engineering services in connection with the Noe Street Area Flood Control Project; and WHEREAS, the Borough's Consulting Engineers, T &M Associates, possess the requisite skill and expertise to provide said services; and WHEREAS, T &M Associates has submitted a proposal to provide said engineering services at a total cost not to exceed $5,000.00; and WHEREAS, the Mayor and Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: L That the proposal from T &M Associates for engineering services related to the Noe Street Area Flood Control Project, in a total amount of $5,000.00 billable in accordance with T &M's existing contract with the Borough is hereby approved; 2. That annexed hereto is a copy of said proposal; 3. That this action is approved as an award of a professional services contract pursuant to N.J.S.A. 40A:11- 5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. The Noe Street Area Stormwater Pump Station project includes Construction of various drainage improvements in the Noe Street area of the Borough including an equalization basin, pump station and collection system improvements. T &M will provide the professional engineering services to prepare the necessary 1-1210ans Financing Program Documentation on behalf of the Borough by the October 7, 2013 (first Monday) deadline in accordance with the following Scope of Services: H210ans APPLICATION DOCUMENTS It's our understanding the Authority has elected to submit to the New Jersey Environmental Infrastructure Trust (NJEIT) to receive funding to design the improvements for Noe Street Area Stormwater Pump Station project as a single application for consideration in the State Fiscal Year (SFY) 2015 program. The documents required must be submitted to the NIDEP by October 7, 2013 to be eligible for 2015 funding. The following represents our scope Of work to assist the Borough in preparing a single application submission to the NJEIT: 1. Access to the 1-1210ans websfte login - The Borough will need to designate an Authorized Official as required by the NJEIT. The Authorized Official will need to be a full -time employee of the Borough. Once selected, the Authorized Official will need to contact the NJEIT at (609) 219 -8600 and request that a login access be provided for submittal of the Borough's application. An email will be forwarded to the Authorized Official with login instructions. Once logged in, the Authorized Official can designate an Authorized Representative to serve as the main contact person for the proposed project. This Authorized Representative must be a full time employee of the Borough or an elected official. Please note that the Authorized Official and the Authorized Representative can be the same person; however, T &M cannot be designated as the Authorized Representative. Upon selection of the Authorized Representative, our office will coordinate with this individual to receive access to the H210ans website account in order to initiate preparation of the requisite funding documentation. 2. Letter of Intent - T &M will complete the online Letter of Intent form, outlining a description of the proposed project, need for the project, preliminary project costs, and Borough contact information. Any comments will be addressed and the Borough shall be responsible for electronically submitting the form as required by the funding program. Due date for the Letter of Intent Is October 7, 2013. 3. Planning Document - As required by NJDEP, T &M will prepare, in accordance with NJDEP requirements, a Level 1 Environmental Review Planning Document. The planning document will outline the project service area, project alternatives, selected project detail, and include a discussion of potential environmental impacts, the need for the project, water quality considerations and benefits. Details on permitting, cost estimate, construction schedule, and funding repayment will also be included. Mapping and figures showing the project location and proposed improvements will be prepared and included in the final report. A draft document will be submitted to the Borough for review and comment. Once comments have been addressed, hard copies of the final document will be submitted to the NJDEP and a digital copy will be uploaded to the H210ans website account by the October 7, 2013 deadline as required. We hereby propose to provide the engineering services delineated above to complete the funding documentation package required for Noe Street Area Stormwater Pump Station project for a "not -to- exceed" fee of $5,000.00. Our fee Is based upon the 2013 Hourly Rate Schedule established within our current Agreement for Professional Services. We are prepared to assign personnel and begin the above mentioned work Immediately upon authorization. Professional Engineering fees to design the sewer improvements for the Noe Street Area Stormwater Pump Station project Including construction drawings, contract documents, specifications, bidding assistance and construction services (contract administration and construction observation) will be supplied to you under a scope of services and fee estimate.
