APPROVING CHANGE ORDER & FINAL PAYMENT -
ESSEX STREET SEWER REPAIR PROJECT
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a
contract to Rock Solid Construction for the Essex Street Sewer Repair Project; and
WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has
advised the Governing Body that a modification of the contract is reasonable and
necessary and has recommended that the aforesaid contract be modified in accordance
with the Final Payment and Closeout Change Order (see attached); and
WHEREAS, the aforesaid Closeout Change Order includes an increase in scope of work
required to complete the intended project and to address unforeseen site conditions
encountered during construction, as advise by the Borough's Consulting Engineer; and
WIIEREAS, the Borough's Consulting Engineer, CME Associates, has advised that the
above described changes and/or modifications to the project were unforeseen at the time
of the award of the original contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
I. That the above - described Final Payment and Closeout Change Order, a
copy of which is attached hereto and made a part hereof, providing for a
revised contract price of 259,042.00 is hereby approved.
2. That the appropriate Borough Officials and/or Consultants are hereby
authorized to execute said Close Out Change Order, and any other related
documents to effectuate the same, all based upon the recommendation of
the Borough's Consulting Engineer.
3. That the Borough Purchasing Department is hereby authorized to issue
payment pursuant to the attached Final Payment and Closeout Change
Order.
4. That a copy of this Resolution and a fully executed copy of the Final
Payment and Closeout Change Order be forwarded to CME Associates for
distribution to Rock Solid Construction.
