WATER LINE, EASEMENT
THIS INDENTURE, Made this 2* day of December, 1982,
'by and between VIOLA M. PARBERRY, a widow, the party of the
First Part, hereinafter called the GRANTOR, and the City of
McCall, Idaho, a municipal corporation, the party of the
Second Part, r.ereinafter called the GRANTEE,
W T T N E S S E T H:
That the GRANTOR for and in consideration of the sum of
ONE DOLLAR ($1.00) and other valuable consideration to her in
hand paid by the GRANTEE, the receipt whereof is hereby
acknowledged, does by these presents remise, release and -for-
ever. QUITCLAIM unto the GRANTEE., and to its successors and
assigns, a permanent easement for a right of cagy for water
pipes, mains and conduits on, under, through and across the
premises hereinafter described, together with the right to
construct, maintain and repair underground pipelines and/or
mains for the purpose of conveying water, together further
with the right to excavate and refill ditches and/or trenches
for the location of said water pipes, mains anc,conduits.
The land affected by this easement and right of way is
situate in Valley County, Idaho, and is described as follows:
A 10 foot wide Utility Easement situate in Government
Lot 4, Section 2, Township 18 North, Range 3 Fast,
B.M., Valley County, Idaho, lying 5 feet on each side
of the following described centerline:
Commencing at the Northeast corner of Lot 15, Shady
Beach Community as shown on the official plat thereof
on file in Book 7, Page 32 of Plats in the office of
the Recorder of Valley County, Idaho; thence North
0°12'14" West, 7.00 feet along the Easterly boundary
of said Shady Beach Community to the real point of
beginning; thence South $2°30' East, 71.0 feet.; thence
North 89°30' East, 60.0 feet; thence North 79°n''
East, 71.20 feet to the Easterly boundary of the
Parberry property, being the same as the `gesterly
boundary of the Lyke property;,bearings based on Shady
Beach Community.
TO HAVE AND TO HOLD, all and singular the said premises,
together with the appurtenances, unto the said GRAN= any:.
to its successors and assigns .forever.
This grant shall be effective as long as said easement
shall be actually used for the purpose above speci.f_ied., and
all right hereunder granted. shall revert to the owner of the
land when said use shall have been abandoned and c'isconemued.
for a term of five (5) years or longer.
The GRANTEE shall at all reasonable tines have the right to
enter upon the lands hereinabove described for the purpose of
constructing, repairing and maintaining said water nines, mains
and conduits, doing as little damage as Possible.
