PARBE RRY, a widow, the party of th.e First Part, hereinafter called the GRANTOR, and the City of McCall, Idaho, a municipal corporation, the party of the Second Part, hereinafter called the GRANTEE, W T T N E S S E T H: That the GRANTOR for and in consideration of the sum of ONE DOLLAR ($1.00) and other valuable consideration to 1= in hand paid by the GRANTEE, the receipt hereof is hereby acknowleda d, does by these ,Irasel-ts ]rerr set releaT and ever QUITCLAIM unto the GRr.NTEF, and to its successors and assigns, a permanent easement, for a right of wa.y for water pines, mains and conduits on, under, through andacross the premises hereinafter described, together with the right to construct, maintain and repair underground pipelines and/or mains for the purpose of conveying water, together further with the right to excavate and refill ditches and/or trenc'les for the location of said water pipes, mains and conduits. The land affected by this easement and right of way is situate in Valley County, Idaho, and is described as follows: A 10 foot wide Utility Easement situate in Government Lot 4, Section 2, Township 18 North, Range 3 East, B.M., Valley County, Idaho, lying 5 feet on each side of the following described centerline: Commencing at the Northeast corner of Lot 15, Shady Beach Community as shown on the official plat thereof on file in Book 7, Page 32 of Plats in the office of the Recorder_ of Valley County, Idaho; thence North 0 � 12' la" West, 7.00 feet along the Easterly boundary of said Shady Beach Community to the real mint of beginning; thence South 82�30' Easy_, 71.0 feet; thence North 89�30' East, 60.0 feet; thence North 79�9 ' East, 71.20 feet to the Easterly boundary of the Parberry property, being the same as the 7,7esterly boundary of the Lyke property; bearings based on Shady Beach Community. TO HAVE, AND TO HOLD, all and singular the .said premises, together with the appurtenances, unto the said GRANTEE anc-. to its successors and assigns forever. This grant shall be effective as lona as said easement shall be actually used for the purpose above specified, and all right hereunder granted shall revert to the owner of the land when said use shall have been abandoned and discon.tj.nued for a term of five (5) years or longer. The GRANTEE shall at all reasonable tines have the right to enter upon the lands hereinabove described for the purpose of constructing, repairing and maintaining said water pines, Mains and. conduits, doing as little damaae as possible.
