BAL HARBOUR VILLAGE COUNCIL MEETING MINUTES
SPECIAL MEETING - JUNE 59 2007
A Special Meeting of the Bal Harbour Village Council was held on Tuesday, June 5, 2007, at
the Bal Harbour Village Hall Council Chambers (655 — 96th Street, Bal Harbour, Florida).
1. CALL TO ORDER /ROLL CALL• The meeting was called to order at 4:00
p.m. by Assistant Mayor Rosenfield. The following were present:
Assistant Mayor Jean Rosenfield
Councilman Joel S. Jacobi
Councilman Martin Packer
Alfred J. Treppeda, Village Manager
Ellisa Horvath, CMC, Village Clerk
Richard J. Weiss, Village Attorney
Absent: Mayor Howard J. Berlin
Councilman Jaime M. Sanz
As a quorum was determined to be present, the meeting commenced.
2. PLEDGE OF ALLEGIANCE: The Pledge was led by Police Chief Thomas
Hunker.
Mr. Weiss requested an Executive Session to discuss the Lynne Bloch - Mullen vs. Joel
Jacobi, Bal Harbour Canvassing Board, etc. litigation. It was the consensus ofthe Council for
the Clerk to schedule the Session.
3. ORDINANCE FIRST READING: The following Ordinance was read by
title, by Mrs. Horvath:
AN ORDINANCE OF BAL. HARBOUR ,VILLAGE, FLORIDA., AMENDING THE
VILLAGE CODE BY AMENDING CHAPTER 16 "SOLID WASTE ", ARTICLE I
"IN GENERAL" BY CREATING SECTION 16 -5 `FEES IMPOSED FOR
COLLECTION OF SOLID WASTE AND RECYCLING SERVICES" AND SECTION
16 -6 "LATE PAYMENT CHARGE, SPECIAL ASSESSMENT LIEN FOR
DELINQUENT SOLID WASTE AND RECYCLING SERVICE FEES"; PROVIDING
FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR AN EFFECTIVE DATE.
Assistant Mayor Rosenfield opened the public hearing.
Dina Cellini, resident— 211 Bal Cross Drive, requested clarification that the Ordinance
will not go into effect in terms of fees until a resolution is passed. Mr. Weiss clarified that
the Ordinance will not be implemented, until the fees are passed. Ms. Cellini requested that
residents have an opportunity to speak about the fees, when they are presented. Mr. Weiss
noted that a public hearing is provided for in the Ordinance (Section 16 -5). Mr. Treppeda
explained that he would like the ability to pass a garbage fee, if he finds it is necessary due
to budget cuts in response to the property tax reform issue.

There being no additional comments, Assistant Mayor Rosenfield closed the public hearing.
A motion was offered by Councilman Jacobi and seconded by Councilman Packer to approve the
Ordinance. The motion carried with the vote as follows: Mayor Berlin absent; Assistant Mayor
Rosenfield aye; Councilman Jacobi aye; Councilman Packer aye; Councilman Sanz absent.
4. OTHER BUSINESS:
Dina Cellini, resident — 211 Bal Cross Drive, questioned if Councilman Jacobi will be
included in the Executive Session discussion. Mr. Weiss noted that will be determined
before public notice of the Session.
Chief Hunker announced that a DUI checkpoint will be held on June 8th, at 96th Street &
Collins Avenue.
5. ADJOURN: There being no further business, a motion was offered by
Councilman Jacobi and seconded by Councilman Packer to adiourn. The motion carried
unanimously (3 -0), and the meeting adjourned at 4:07P.m.
