HomeMy Public PortalAbout336CITY OF MEDINA ORDINANCE NO.336 AN ORDINANCE AMENDING ORDINANCE NOS. 311, 322 AND 333, INTERIM ORDINANCES RESTRICTING DEVELOPMENT WITHIN THE UPTOWN HAMEL AREA IN THE CITY. THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS: Section 1. Background. 1.01. On October 5, 1999, the city of Medina (the "City") adopted Ordinance No. 311, an interim ordinance declaring a moratorium on development within a large portion of the community, including the Uptown Hamel area. 1.02. The City's purpose in adopting the interim ordinance was to protect the on -going planning process associated with the amendment of the City's comprehensive plan. The City needed an opportunity to adopt or modify its official controls as they related to the commercial areas. 1.03. On October 3, 2000, the City adopted Ordinance No. 322, an interim ordinance extending the moratorium on development within the Uptown Hamel area through April 3, 2001, or until such time as the City might revoke or amend the ordinance. 1.04. On April 3, 2001, the City adopted Ordinance No. 333, an interim ordinance extending the moratorium on development in the Uptown Hamel area through July 3, 2001. 1.05. Since the adoption of the original interim ordinance, the City finalized its comprehensive plan and has initiated a process to consider various amendments to its zoning ordinance and other official controls. This effort has resulted in the adoption of a zoning ordinance establishing the Uptown Hamel planned unit development zoning district, which ordinance was adopted by the City on May 15, 2001 and will be effective upon publication. Section 2. Findings. 2.01. In light of the conclusion of the planning process regarding the Uptown Hamel area, it is hereby found and determined by the City that the area designated in the comprehensive plan as Uptown Hamel no longer needs to be subject to a moratorium on development. 2.02. It is hereby declared that the Uptown Hamel area as depicted on the map attached hereto as Exhibit A is no longer subject to the moratoria imposed by Ordinance No. 311, Ordinance No. 322 and Ordinance No. 333. City staff may henceforth accept and process 1 Ordinance 336 May 15, 2001 applications regarding development on properties within this area, subject to such restrictions and processes generally imposed by the City's ordinances and other law. Section 3. Effective Date. 3.01. This ordinance be effective upon its adoption and publication and following rezoning all properties designated Uptown Hamel to the Uptown Hamel planned unit development zoning district.
