PUBLIC NOTICE REGARDING ADOPTION OF
ORDINANCE 337 CREATING RURAL
COMMERCIAL HOLDING
(RCH) ZONING DISTRICT
The city council of the city of Medina has adopted
Ordinance No. 337. The ordinance establishes a new rural
commercial holding zoning district. The purpose of the dis-
trict is to provide a district which is consistent with the area
guided for commercial reserve in the city's comprehensive
plan. This is the area (generally, the westernmost portions
of T.H. 55) which is not yet served by urban services but
which will one day be included in that area. The ordinance
establishes permitted, conditional and accessory uses
within the zone and provides for development standards
applicable to all uses. The district is similar to the recently
adopted urban commercial district and the city's old rural
commercial zone but excludes water -intensive uses. The
full text of Ordinance No.337 is available for inspection at
Medina city hall during regular business hours.
PUBLIC NOTICE REGARDING ADOPTION OF
ORDINANCE 338 CREATING RURAL RESIDENTIAL
- URBAN RESERVE (RR-UR) ZONING DISTRICT
The city council of the city of Medina has adopted
Ordinance No. 338. The ordinance establishes a new rural
residential -urban reserve zoning district. The purpose of
the district is to provide a district which is consistent with
the area guided for residential urban reserve in the city's
comprehensive plan. The ordinance is intended for those
areas of the community which will not develop at even
rural residential densities until at least 2020. The ordinance
establishes a minimum lot size of 40-acres with at least 5
acres of contiguous soils suitable for individual on -site
sewage disposal systems. However, lots smaller than 40
acres may be established through a PUD or if a ghost plat
is filed at the time of lot division which demonstrates the
feasibility of subdividing the property in the future at a
density no less than three dwellings per acre. The full

directed to cause the city's zoning map to be changed to
reflect the new zoning.

summer season we leave behind
one of the wettest springs in
memory, and all that rain is hav-
ing a drastic effect on the grow-

Planning Commission seat

The city of Long Lake is accept-
ing applications from Long Lake
residents and/or business own-
ers to fill an opening on the Plan-
ning Commission effective July

MEDINA
City seeks Planning
Commission applicants
The planning commission has
an opening to fill out a term that
would expire in March 2004.
This is a commission that makes
recommendations to the City
Council concerning applications
for subdivision, conditional use
permits, variances and rezoning.
City ordinance states that mem-
bers of the Planning Commission
shall be persons who have
resided in the City for at least
three years immediately preced-
ing appointment.
Interested persons should sub-

the Carver County Sheriff's
Office. Statements from wit-
nesses are still being gathered to
illuminate any other circum-
stances behind the drowning.
The Minnesota Regional Coro-
ner's office will do an autopsy,
which could tell more about Rue-
bin's health, said Owens.
Ruebin's death marks the sec-
ond drowning at Lake Ann Park
this year, following just days
after the drowning of a Min-
netonka man on June 15. Last
year, there were two deaths in
Lake Ann Park.

Advisory Committee to work on

police in providing services to
the community; and
• identifying programming of
interest in the areas of community
safety education, crime preven-
tion, and youth -related activities.
Approximately nine to 11
members will be appointed by
the City Council. Membership
should, to the extent possible,
reflect the diversity of the com-
munity and include representa-
tives of the City Council, youth
(all school districts), business,
crime watch block captains and
the four wards. The committee
will meet at least four times per
year and be advisory,in nature

provide free tree
consultation services
City of Minnetonka foresters
provide tree consultation serv-
ices for residents and businesses
in the community. Trees with
Dutch elm disease or oak wilt are
required to be removed when
they are diagnosed with these
diseases.
Residents can call (952) 988-
8400 to obtain a list of tree
removal contractors. If the city
tags a diseased tree, residents can
utilize the services of the city's
removal contractor (removal
prices are on file with the
foresters). If residents choose to
use the city's contractor, removal
costs can be paid in one of three
ways: 1) by check in the full
amount, or 2) put on the utility
from a long way south of here.
Tomatoes and peppers are also
hot -weather crops. They want
warm soilandlong days of sun-
shine.
Instead, we've been getting
nighttime lows in the 50s head-
ing into the last week of June. It's
been raining since April, and wet
soil stays cool. Moisture also
squeezes air particles out of the
soil that are essential for root
development. Plus, I learned in
master gardener training that
the sun doesn't shine much
when it rains, so we're no doubt
way behind in the number of
sunlight hours for the season.
It's not prudent to complain
too much. The wet, cool weather
is only messing up our hobby, as
opposed to the impact it is hav-
bill and paid for over a one-year
period, or 3) by special assess-
ment (this would include interest
charges).
Filings open July 3 for
municipal election
The city of Minnetonka will
hold municipal elections this fall.
The positions to be elected at the
General Election in November
are mayor and two council -at -
large seats, A and B. Filings for
these offices open on Tuesday,
July 3 and remain open through
Tuesday, July 17. Interested per-
sons may file for these offices
during regular city hall hours, 8
a.m.-4:30 p.m., Monday through
Friday. The filing fee is $5.
A primary election will be held
on Tuesday, Sept. 11. The pri-
mary ballot will include a refer-

The City of Victoria is issuing the results of monitoring
done on its drinking water for the period from January 1
to December 31, 2000. The purpose of this report is to
advance consumers' understanding of drinking water and
heighten awareness of the need to protect precious water
resources.
Source of Water
The City of Victoria provides drinking water to its residents
from a groundwater source: two wells ranging from 430 to
640 feet deep, that draw water from the Quaternary Buried
Artesian aquifer.
The City of Victoria's 2001 water system status.
Work was completed last summer on a second water stor-
age facility; this structure has a capacity of 500,000 gallons.

AN ORDINANCE AMENDING
SECTION 825.07, SUBD. 29 OF THE CODE
OF ORDINANCES REGARDING
ESSENTIAL SERVICES
The city council of the city of Medina ordains as follows:
Section I. Section 825.07, subd. 29 of the Medina Code of
Ordinances is amended by adding the underlined material
as follows.
Subd. 29. Essential Services - Overhead or underground
electric, gas, communication, steam or water transmission
or distribution systems and structures, by public utilities or
govemmental ,departments or commissions or as are
required for protection of the public health, safety or gen-
eral welfare including towers, poles, wires, mains, drains,
sewers, pipes, conduits, cables, fire alarm boxes, policy call
boxes, and accessories in connection therewith, but not
including buildings or any personal wireless service facil-
ities or unlicensed wireless service facilities, as defined in
47 U.S.C. 332(c)(7)(C). Notwithstanding the above, a
building may be constructed as an accessory structure to an
essential service provided that it may be used only to pro-
vide weather protection for stationary equipment, may not
exceed 400 square feet and may not exceed 15 feet in
height. If a building is constructed as an accessory structure
to an essential service, the exterior building materials must
be in compliance with Section 828.04 and the site must be
landscaped in accordance with Section 828.09 of this ordi-
nance.
Section II.. This amendment shall take effect upon its adop-
tion and publication.
Adopted by the Medina City Council on the 19 day of June,
2001.

ORDINANCE NO. 345
AN ORDINANCE AMENDING ORDINANCE
NOS. 311, 322, AND 333, INTERIM ORDINANCES
RESTRICTING DEVELOPMENT
WITHIN THE CITY.
The city council of the city -of Medina ordains as follows:
Section 1. Background.
1.01. On October 5, 1999, the city of Medina (the 'City")
adopted Ordinance No. 311, an interim ordinance declar-
ing a moratorium on development within a large portion
of the community.

Results of Monitoring
No contaminants were detected at levels that violated fed-
eral drinking water standards. However, some contami-
nants were detected in trace amounts that were below legal
limits. The table that follows shows the contaminants that
were detected in trace amounts last year. (Some contami-
nants are sampled less frequently than once a year; as a
result, not all contaminants were sampled for in 2000. If any
of these contaminants were detected the last time they were
sampled for, they are included in the table along with the
date that the detection occurred.)
Key to Abbreviations:
MCLG - Maximum Contaminant Level Goal: The level of
a contaminant in drinking water below which there is no
known or expected risk to health. MCLGs allow for a mar-
gin of safety.
MCL - Maximum Contaminant Level: The highest level of

1.02. The City's purpose in adopting the interim ordinance
was to protect the on -going planning process associated
with the amendment of the City's comprehensive plan. The
City needed an opportunity to adopt or modify its official
controls as they related to the commercial areas.
1.03. On October 3, 2000, the City adopted Ordinance No.
322, an interim ordinance extending the moratorium on
development within portions of the community through
April 3, 2001, or until such time as the City might revoke
or amend the ordinance.
1.04. On April 3,2001, the City adopted Ordinance No. 333,
an interim ordinance extending the moratorium on devel-
opment through July 3, 2001.
105. Since the adoption of the original interim ordinance,
the City finalized its comprehensive plan and initiated a
process to consider various amendments to its zoning ordi-
nance and other official controls. This effort has resulted in
the adoption of numerous new zoning district ordinances,
the last of which was adopted by the City on June 19, 2001
and will be effective upon publication.
Section 2. Findings.
2.01. In light of the conclusion of the planning process
regarding the commercial areas of the community, it is
hereby found and determined by the City that, subject to
the exception noted in 2.02 below, there remain no areas of
the community which need to be subject to a moratorium
on development.
2.02. It is hereby declared that no area of the community is
subject to the moratoria imposed by Ordinance No. 311,
Ordinance No. 322, and Ordinance No. 333, except the
property guided public/semi-public and zoned multi-
family residential and identifiedby PINs 12-118-23-21-0001
and 12-118-23-22-0001. City staff may henceforth accept
and process applications regarding development on prop-
erties within the entire City, except as noted herein, subject
to such restrictions and processes generally
imposed by the City's ordinances and other law.
Section 3. Effective Date.
3.01. This ordinance be effective upon its adoption and
publication.

Compliance with National Primary Drinking Water
Regulations
The sources of drinking water (both tap water and bottled
water) include rivers, lakes, streams, ponds, reservoirs,
springs, and wells. As water travels over the surface of the
land or through the ground, it dissolves naturally occur-
ring minerals and, in some cases, radioactive material, and
can pick up substances resulting from the presence of ani-
mals or from human activity.
Contaminants that may be present in source water
include:
Microbial contaminants, such as viruses and bacteria,
which may come from sewage treatment plants, septic sys-
tems, agricultural livestock operations, and wildlife.
Inorganic contaminants, such as salts and metals, which can
be naturally -occurring or result from urban stormwater
runoff, industrial or domestic wastewater discharges, oil
and gas production, mining, or farming.
Pesticides and herbicides, which may come from a variety of
sources such as agriculture, urban stormwater runoff, and
residential uses.
Organic chemical contaminants, including synthetic and
volatile organic chemicals, which are by-products of
industrial processes and petroleum production, and can,
also come from gas stations, urban stormwater runoff, and
septic systems.
Radioactive contaminants, which can be naturally occurring
or be the result of oil and gas production and mining
activities.
In order to ensure that tap water is safe to drink, the U.S.
Environmental Protection Agency (EPA) prescribes regu-
lations, which limit the amount of certain contaminants in
water provided by public water systems. Food and Drug
Administration regulations establish limits for contami-
nants in bottled water, which must provide the same pro-
tection for public health.
Drinking water, including bottled water may reasonably
be expected to contain at least small amounts.of some con-
taminants. The presence of contaminants does not neces-
sarily indicate that water poses a health risk. More infor-
mation about contaminants and potential health effects
can be obtained by calling the Environmental Protection
Agency's Safe Drinking Water Hotline at 800-426-4791.
Some people may be more vulnerable to contaminants in
drinking water than the general population. Immuno-
compromised persons such as persons with cancer under-
going chemotherapy, persons who have undergone organ
transplants, people with HIV/AIDS or other immune sys-
tem disorders, some elderly, and infants can be particu-
larly at risk from infections. These people should seek
advise about drinking water from their health care
providers. EPA/CDC guidelines on appropriate means to
lessen the risk of infection by Cryptosporidium are avail-
able from the Safe Drinking Water Hotline at 800-426-4791.
