HomeMy Public PortalAboutResolution 83-1096 PC1 RESOLUTION No. 83- 1096PC A RESOLUTION OF THE PLANNING COMMISSION'OF THE CITY OF TEMPLE CITY GRANTING CUP 83 -702. THE PLANNING COMMISSION OF THE' CITY OF TEMPLE CITY DOES RESOLVE: SECTION 1. Based upon a public hearing for property at 9123 E. Broadway to expand the uses at the existing private school, the planning commission finds: (1) That the site for the proposed use is adequate in size, shape, topography and circumstances; and (2) The the site has sufficient, access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use; and (3) That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare. SECTION 2, Accordingly, said variance is granted to allow seven new classrooms, ai nursery, and a library to the existing facilities, subject to the following conditions: (1) That this conditional use permit is granted for the land and for the purposes described in the application and as shown on submitted plans labeled Plan "A "; and (2) This application is for a major addition to the ele- mentary school facilities existing on the property and does not represent a new or different use of the property nor does approval of the conditional use permit authorize any other use of the property. The temporary classroom building approved in August, 1982, shall be removed from the property prior to occupancy of the new facilities; and (3) Detailed development plans, including site plans, floor plans, elevation and landscaping, irrigation and structural plans as required by the Building Department shall be sub- mitted to the Planning Director for review and approval prior to issuance of building permits; and (4) The new driveway approach on Noel Drive shall meet County Road Department standards. and (5) That all requirements of any law or ordinance of the City, County or State shall be complied with and nothing in this approval shall waive or change any such law or ordinance; and (6) That all utility facilities shall be placed underground; (7) That all landscape areas adjacent to parking and circu- lation areas shall be enclosed by a raised 6" concrete curb or low wall. All planters adjacent to the street right- of-way shall be constructed per specifications of the Public Works Department; and " " " RESOLUTION NO. 83- 1096PC CONDITIONAL USE PERMIT CASE (8) That no outside open storage of any kind shall be permitted on the site; and (9) That, once constructed, all improvements shall be maintained in accordance with the approved plans. All landscaping shall, at all times, be maintained in con- formance with the approved landscape plan and in a manner acceptable to the Planning Director; and (10) That trash enclosure(s) shall be provided and main- tained of a size and location as approved by the Planning Director. Said trash storage area(s) shall be enclosed with a solid wall of sufficient height to adequately and aesthetically screen the area and shall include a solid gate. The trash storage area(s) shall be maintained in good repair at all times; and (11) That any mechanical and /or electrical equipment, including solar panels, to be located on the roof of the structure or "pad" mounted on the site, shall be shown on the site plan and elevation plans, and shall be screened in a manner as approved by the Planning Director; and (12) That no final inspection or occupancy permit shall be granted until all construction is completed and all im- provements and landscaping are installed in accordance with the plans approved and the conditions required by the Plan- ning Commission and /or City; and (13) That a lighting plan shall be submitted to the Plan- ning Director for review and approval prior to issuance of building permits. Lighting shall be directed so as not to shine into adjacent residential areas; and (14) That noise shall be maintained within the limits of the City's Noise Ordinance; and (15) That sprinklers and hoses will be utilized during construction to minimize dust emanating from the site; and (16) That, within thirty days of approval, the applicant shall file with the Planning Department an affidavit of acceptance of conditions stated herein on forms as provided by the Planning Department; and (17) That, unless the use is inaugurated not later than one (1) year after this approval is granted and is diligently pursued thereafter, this approval will automatically become null and void. SECTION 3. The Secretary shall certify to the adoption of the Resolution.
