HomeMy Public PortalAbout21-9922 Approving the Special Exception Site Plan for Batching Plant and Finished Concrete ProductionSponsored by: City Manager RESOLUTION NO. 21-9922 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, APPROVING THE SPECIAL EXCEPTION SITE PLAN REVIEW REQUEST FOR THE OPERATION OF A CONCRETE BATCHING PLANT AND FINISHED CONCRETE PRODUCTION COMPANY FACILITY ON THE PROPERTY LOCATED AT 13050 NW 30TH AVENUE AND IDENTIFIED BY FOLIOS 08-2128-002-0020; 08-2128-002-0030; 08-2128-002- 0040; 08-2128-002-0050; 08-2128-002-0060; 08-2128-002-0090; 08-2128-004-0380; AND 08-2128-004-0330, IN THE I-2 ZONING DISTRICT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the Code of Ordinances of the City of Opa-Locka and the City of Opa-Locka's Land Development Regulations, Ordinance 15-31, the City Commission has the power to approve, approve with conditions or deny any site plan review request; and WHEREAS, AMDI USA, Inc. ("Applicant") desires to continue the operation of their concrete batching plant on this eight parcel development site ("Property"), in the I- 2 (Industrial Planned) zoning district and to comply with the requirements of the City Land Development Regulations; and WHEREAS, the Property consists of two (2) gross acres. Access to the Property will continue to be provided from NW 131st Street pursuant to a public right of way easement. The western portion of NW 131st Street will be vacated and therefore not available for vehicular traffic. The existing buildings and operation of the Property will remain and continue (in an improved state) in the same previous manner; and WHEREAS, in accordance with Section 22-60 of the City's Land Development Regulations, Ordinance 15-31, the use of the Property to produce cement and clay products requires the approval of a special exception application; and WHEREAS, the Applicant has submitted plans through the site plan process to illustrate compliance with the requirements of the City's Land Development Regulations (as well as the Miami -Dade County Code of Ordinances) and to illustrate all non- conforming aspects of this operation. The Applicant will take steps to mitigate or reduce the non -conforming aspect as much as possible by site design or through variance request; and Resolution No. 21-9922 WHEREAS, the Applicant seeks to obtain Final Site Plan Review approval in the accordance with the requirements of the City of Opa-Locka for the operation of a concrete batching plant on the property located at 13050 NW 30th Avenue and identified by folios 08-2128-002-0020; 08-2128-002-0030; 08-2128-002-0040; 08-2128-002-0050; 08-2128-002- 0060; 08-2128-002-0090; 08-2128-004-0380; AND 08-2128-004-0330 in the I-2 Zoning District; and WHEREAS, on November 17, 2020, AMDI USA, Inc. presented their formal application request, all evidence, documents, and marked exhibits before the Planning & Zoning Board and the Planning & Zoning Board recommended approval of the Special Exception Site Plan request by a 4 to 0 vote, pursuant to the City Code of Ordinance and the City Zoning Regulations; and WHEREAS, the City desires to approve the Final Site Plan Review attached hereto as Exhibit "A" to this Resolution. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: SECTION 1. RECITALS. The above recitals are true and correct and are incorporated into this Resolution by reference. SECTION 2. APPROVAL Approval of Site Plan. The City Commission of the City of Opa-Locka hereby approves a request for Final Site Plan Review for operation of a Concrete Batching Plant on the property located at 13050 NW 30th Avenue and identified by folios 08- 2128-002-0020; 08-2128-002-0030; 08-2128-002-0040; 08-2128-002-0050; 08-2128-002- 0060; 08-2128-002-0090; 08-2128-004-0380; and 08-2128-004-0330, in the I-2 (Industrial Planned) Zoning District. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected or re -codified copy of same with the City Clerk. 2 Resolution No. 21-9922 SECTION 4. The property site is currently being used for the Concrete Batching Plant Operation, however the review and approval of these requests would bring this operation into compliance with City Land Development Regulations and Miami -Dade County Code of Ordinances. The applicant, AMDI USA, INC., desires to continue the operation of their concrete batching plant on this eight parcel development site in the I-2 (Industrial Planned) zoning district and to comply with the requirements of the City Land Development Regulations. This development site includes the properties listed and a portion of NW 130th Street and a portion of NW 30th Court between NW 130th Street and NW 131st Street, and the site is approximately 166,498 square feet or 3.82 Acres according to the site plan. The applicant submitted plans through the site plan review process to illustrate compliance with the requirements of the Land Development Regulations and to illustrate all non -conforming aspects of this operation and the steps the applicant will take to mitigate or reduce the non -conforming aspect by site design or through variance approval request. This Special Exception Final Site Plan Review request and plan was reviewed by the Planning & Zoning Board on November 17, 2020. The Planning & Zoning Board recommended approval of this request by a 4-0 vote. Financial Impact The Concrete Batching Plant operation will continue to obtain City Business Licenses and Certificate of Use. There is no significant financial impact. Proposed Action: Staff has recommended approval of this request. The applicant's project site requires the assemblage of eight parcels which total 3.82 acres which is suited for this proposed use as it relates to the size, shape and character of the property. 4. The proposed use is compatible with the other industrial uses that surround this site. 5. The proposed use will not adversely affect the development of the general neighborhood or district as this is an industrial use that is permitted in this zoning district. 6. The proposed use will not generate vehicular traffic or create vehicular circulation problems that would have an unfavorable impact on surrounding properties when compared with the uses permitted by right in the same district. Odom Zarb Davis -Walker Project Narrative and Special Exception Narrative AMDI USA, INC., ("Developer") intends to continue the operation of an existing concrete batching plant and finished concrete production company ("Project") on property located at 13050 NW 30" Avenue, including unimproved rights of way for portions of NW 130'x' Street and NW 30th Court ("Property") . All parcels are further identified on the attached and are in the City of Opa Locka ("City"). The Property is zoned I-2 ( industrial planned district) and consists of 2 gross acres. Access to Property will continue to be provided from NW 131st Street pursuant to a public right of way easement. A western portion of NW 131m Street will be vacated, and therefore not available for vehicular traffic. The existing buildings, and operation of the Property will continue (in an improved state) as they have for the last years. In accordance with the I-2 zoning regulations, the use of the Property to produce cement and clay products require the approval of this special exception application. To that end, the balance of this narrative will address compliance with the special exception criteria outlined in Section 22-60 of the City's Zoning Code ("Code"). 1. Compliance with the City's Comprehensive Plan. The City's Comprehensive Plan Policy LU-1.7 provides that: "The City's Land Development Regulations shall conform to, and implement, the use, density and intensity standards prescribed for the land use districts provided on the Future Land Use Map" Accordingly, the Project is located on property with an I-2 zoning designation, which is consistent with the underlying Industrial land use designation of the Property. Furthermore, the proposed uses are permitted in the zoning district. Additionally, the use is already existing, therefore approving this request will further the goal of conforming the use on the Property with the zoning regulations. 2. As such, the request to obtain valid zoning approval for an existing use on the Property. Clearly, the use is in a well -planned area as the existence of same has not caused complaints from surrounding property owners to date. 3. The size, shape and character of the property are suited for the proposed use. In accordance with the City's Code, the minimum size for a use such as the Project is 2 acres. The Property consists of 2 acres; therefore, the size of the property is suited for the purpose. With regard to the shape and character of the Property, the location of the Property is consistent with the use, in that it is in a section of the City which is industrialized. 4. Compatibility with the existing uses near the property. The Property is surrounded by industrial uses, therefore the use of same for an existing concrete batching plant and finished concrete production company is compatible with the area. Approval of the requests submitted in connection with the Property will allow for the valid, use of the Property in compliance with existing City Code. 5. Will not adversely affect the development of the general neighborhood or district. The general character of the neighborhood is industrial. The proposed use will not have an adverse effect on the neighborhood, or district. 6. Will not generate vehicular traffic or create vehicular circulation or ingress/egress problems or parking demands that have an unfavorable impact on surrounding properties when compared with uses permitted by right in the same district. The Property has sufficient circulation, ingress, and egress to service the Project. Further, parking provided on the Property is consistent with what is required b the City Code. The use therefore will not create any unfavorable traffic, or parking demands. 7. Potential for fire and/or other equally or greater dangerous hazards. The Project will follow all required lifelsafety precautions and regulations with regard to its operation. 2 8. Create an unfavorable environment impacts on surrounding uses (e.g. noise, glare, smoke, dust, odor, fumes, water pollution, or general nuisance). The Project will not create unfavorable environmental impacts on the surrounding uses. In fact, it appears that the use is consistent with the establish development pattern in the area. 9. Consistent with existing and planned pedestrian and vehicular circulation adjacent to and near the property. The proposed Project is consistent with the existing vehicular circulation pattern of the area near the Property. 10. Site is adequately served by essential public services and facilities not requiring additional public expense in infrastructure improvements. The proposed Project will be adequately served by the necessary public services and facilities. 11. Will not adversely affect any site or feature of historical, cultural, natural or scenic importance. The Project will not adversely affect any site or feature of historical, cultural, natural or scenic importance, as there are none in proximity to the Property that the Developer is aware of. 12. Will not be contrary to the public health, safety, and welfare, provided that a denial based exclusively on this language shall include explicitly findings regarding the way in which granting the special exception would be contrary to the public health, safety and welfare. I am the owner of 13195 NW 38th Avenue. The property to the south of the above subject property. I have the following questions and concerns about the effects of the Operations of A, C and D to the neighboring properties. What type of construction material will be processed and how will it be processed? Will the material be asbestos free and how will this be monitored? Will the material be lead free and how will this be monitored? Will the process be compacting, compressing and/or pulverizing? Will the process be noisy? Will the process pollute the air and ground water with dust? What tonnage do you anticipate processing in a year? What will be the effects on local traffic? A major concern is the erosion and flooding of 38th Avenue directly in front of my property and the only entrance and exit to the 3805 property. When this area floods (which is often), getting in and out of this area is extremely dangerous. It is common to see abandoned cars sitting in the street that has been flooded. Any zoning approvals for this area should be directly tied to Road and Sewer Repairs prior to increased industrialization. This proposed process will require daily, multiple trucks bringing material to the site and multiple trucks leaving the facility with the processed material. I would appreciate my concerns and recommendations being considered for the sake, safety and respect of the neighborhood. The Miami Dade Property Appraiser does not assign land values to public rights of way. Instead, this office computed the average land values (current year) obtained from the Miami Dade Property Appraiser for the 8 parcels adjacent to the right of way being vacated (see Table 1). The average land value of properties adjacent to the right of way being vacated is $18.43/SF with an market value of $30.00/SF established by Commercial Appraisal Group Co. The average of the market value and the mean SF value from the Miami Dade Property Appraiser is $24.22/SF. The dedication (by separate instrument) of approximately 7,450 SF of right of way along the alignment for NW 131st Street (which as explained in my correspondence dated June 11, 2021, attached, is needed for the City's programmed construction of NW 131st Street between NW 30th and NW 31st Avenues), has by the same logic a value of $180,439.00.
