HomeMy Public PortalAbout21-9921 Variance Request for the Operation of a Concrete Batching PlantSponsored by: City Manager RESOLUTION NO. 21-9921 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, APPROVING A VARIANCE REQUEST FOR THE OPERATION OF A CONCRETE BATCHING PLANT AND FINISHED CONCRETE PRODUCTION COMPANY FACILITY ON THE PROPERTY LOCATED AT 13050 NW 30TH AVENUE AND IDENTIFIED BY FOLIOS 08-2128-002-0020; 08-2128- 002-0030; 08-2128-002-0040; 08-2128-002-0050; 08-2128-002- 0060; 08-2128-002-0090; 08-2128-004-0380; AND 08-2128-004- 0330, IN THE I-2 ZONING DISTRICT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 22-58 of the City of Opa-Locka's Land Development Regulations, Ordinance 15-31: "Owners of lands or structures may apply to the City for a variance from the requirements or restrictions of the Land Development Regulations; except that no variance for use or density issues shall be considered"; and WHEREAS, AMDI USA, Inc. ("Applicant") desires to continue the operation of their concrete batching plant on this eight parcel development site ("Property") in the I- 2 (Industrial Planned) zoning district and to comply with the requirements of the City Land Development Regulations; and WHEREAS, the Applicant seeks to obtain Variance Request approval, in accordance with the City's Code of Ordinances and Land Development Regulations, for the operation of a concrete batching plant on the property located at 13050 NW 30th Avenue and identified by folios 08-2128-002-0020; 08-2128-002-0030; 08-2128-002-0040; 08-2128-002-0050; 08-2128-002-0060; 08-2128-002-0090; 08-2128-004-0380; and 08-2128- 004-0330 in the I-2 Zoning District; and WHEREAS, as indicated on the site plan, this development meets certain applicable zoning standards except it exceeds the 75 percent impervious area coverage, the east setback is less than the required 50 -foot and the rear setback is less than the required 25 -foot setback; and WHEREAS, in accordance with the City's Zoning/Land Development Regulations, four (4) variances have been requested by Applicant in order to allow the Property to continue its current operations: (1) variance from Code section 22-153 regarding the location of parking spaces; (2) variance from Code section 22-182(A)(7)( e) regarding the width of the landscape buffer; (3) variance from Code section 22-95 Resolution No. 21-9921 regarding the setback of the existing building; and (4) variance from Code section 22-95 regarding the rear setback of the existing building; and WHEREAS, the Applicant has submitted plans through the site plan process to illustrate compliance with the requirements of the City's Land Development Regulations and to illustrate all non -conforming aspects of this operation. The Applicant will take steps to mitigate or reduce the non -conforming aspect as much as possible by site design or through variance request; and WHEREAS, on November 17, 2020, AMDI USA, Inc. presented their formal application request, all evidence, documents, and marked exhibits before the Planning & Zoning Board and the Planning & Zoning Board recommended approval of the application for the variance requests by a 4 to 0 vote, pursuant to the City Code of Ordinance and the City Zoning Regulations; and WHEREAS, the City desires to approve the application for variance requests attached hereto as Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: SECTION 1. RECITALS. The above recitals are true and correct and are incorporated into this Resolution by reference. SECTION 2. APPROVAL. Approval of the Variance Requests. The City Commission of the City of Opa- Locka hereby approves a request for the Variances, attached hereto as Exhibit "A", for operation of a Concrete Batching Plant on the property located at 13050 NW 30th Avenue and identified by folios 08-2128-002-0020; 08-2128-002-0030; 08-2128- 002-0040; 08-2128-002-0050; 08-2128-002-0060; 08-2128-002-0090; 08-2128-004-0380; and 08-2128-004-0330, in the I-2 (Industrial Planned) Zoning District. SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected or re -codified copy of same with the City Clerk. 2 Resolution No. 21-9921 SECTION 4. The biggest wildcard leading up to the qualify- ing deadline, incumbent Commissioner Michael Gongora, dropped his bid to seek reelection in Group 3 following a judg- e's order barring him from running due to city term 1110110. Gdngom instead filed Thursday to run for mayor in 2023, which he said was initially his plan before ha aupportea told him to run for reelection. He also threw his support behind the newest Group 3 candi- date, Planning Board Member Alex Fernandez, whom Gdngom said he had initially recruited to run for his seat earlier this year. Gongora said he would transfer the more than $200,000 in his cam- paign coffers to his neat campaign. "A lot of people in- vested in my race and want to have my voice on the dais in City Hall," he said. Fernandez, who filed to ran this week, is joined in the Group 3 race by Mi- chael "Mike B" Barrineau, Melissa Beattie and Ste- phen Cohen. The applicant, AMDI USA, INC., desires to continue the operation of their concrete batching plant on this eight parcel development site in the I-2 (Industrial Planned) zoning district and to comply with the requirements of the City Land Development Regulations. This development site includes the properties listed and a portion of NW 130th Street and a portion of NW 30th Court between NW 130th Street and NW 131st Street, and the site is approximately 166,498 square feet or 3.82 Acres according to the site plan. The applicant submitted plans through the site plan review process to illustrate compliance with the requirements of the Land Development Regulations and to illustrate all non -conforming aspects of this operation and the steps the applicant will take to mitigate or reduce the non -conforming aspect by site design or through variance approval request. In accordance with the I-2 zoning regulations, in order for the Property to continue its current operations, 4 variances from the City of Opa Locka Land Development Code ("Code") are being requested: (1) variance from Code section 22-153 regarding the location of parking spaces; (2) variance from Code section 22-182(A)(7)(e) regarding the width of the landscape buffer; (3) variance from Code section 22-95 regarding the setback of the existing building; and (4) variance from Code section 22-95 regarding the rear setback of the existing building. With these 4 variances in mind (2 of which address existing conditions), the balance of this narrative will address compliance with the variance criteria outlined in Section 22-58 of the Code. Variance 1. Code section 22-153 (A) regarding the location of parking spaces. Code requirement: "No parking lot shall be closer than 5 feet behind the front of the building line of an adjacent building." Provided Parking: Provide required parking 30 feet from the property line along NW 30th Avenue. 1. The strict application of the regulations of this ordinance would produce undue hardship. Strict application of the regulations of this ordinance would produce an undue hardship on the Developer, as he is taking ownership of a parcel with an existing condition. The hardship demonstrated by this application is not generally shared by other properties in the same zoning district, in that the Property conditions have existed for more than 25 years. Further, the existing conditions have operated safely since the business has been in operation. 3. That the authorization of such variance will not be of substantial detriment to adjacent properties and that the character of the district will not be changed by the granting of the variance. The authorization of such a variance will not be a substantial detriment to the adjacent properties. The benefit of this variance is that the building location and associated parking are set back on the Property in such a manner that other surrounding properties are not impacted, as the parking field is separated from the other properties by an existing right of way (NW 30`h Avenue). 4. Such variance is not contrary to the public interest or to the stated purpose of the ordinance. Such as variance is not contrary to the public interest because the surrounding properties are not impacted. Additionally, the Property has operated with this same condition for a number of years. 5. That the hardship is not self-imposed. The hardship is not self-imposed in that the current Property owner purchased the land with an existing condition. In fact, submitting this variance application, along with the related development applications is an effort to make the Property conform to the City's existing development code. 6. That the hardship is not financial in nature. The hardship is not financial in nature. In fact, the Developer could have continued the Property operation in its current state without submitting the pending applications. However, instead of 2 doing that, the Developer chose to address the conditions on the Property in an effort to improve same, and continue the operation of a viable business. Variance 2. Code section 22-182(A)(7)(e) regarding the width of the landscape buffer. Code Requirement: "A buffer area shall be required along boundaries of ...nonresidential ...lots abutting a less intensive use. Such lots shall comply with the following minimum standards: 30 - foot buffer between a residential and industrial use". Bt er provided: 25 -foot buffer between the Property and the closest single-family boundary. 1. The strict application of the regulations of this ordinance would produce undue hardship. The strict application of the regulations of this ordinance would produce an undue hardship on the Developer because the hardship only relates to a single point on the Property. Denial of this request because of one location could cause the business to close because the Property would be considered non -conforming. Furthermore, the landscape buffer situation is currently existing, and a modification of this existing condition would not be possible while still allowing the Property to operate in a safe manner. 2. That such demonstrated hardship is not shared generally by other properties in the same zoning district and in the same vicinity. The hardship is not generally shared by other properties in the vicinity because there are not many industrial properties in the area which are close to residentially zoned property. 3. That the authorization of such variance will not be of substantial detriment to adjacent properties and that the character of the district will not be changed by the granting of the variance. The authorization of the requested variance will not change the character of the district. In fact, it is unlikely that anyone outside of the Property will notice the one spot on the Property that is not consistent with the Code, therefore there will be no detrimental impact to the adjacent properties. 4. Such variance is not contrary to the public Interest or to the stated purpose of the ordinance. 3 The requested variance is not contrary to the public interest. In fact, as stated above, persons outside of the Property will no likely notice the one buffer area that is not in compliance. Furthermore, the location of a buffer on the Property will serve as an improvement to the area. 5. That the hardship is not self-imposed. The hardship is not self-imposed in that the Developer purchased property, and the parcel limitations are preexisting. The modification of the land, or the existing building in order to bring this variance into compliance would make the operation of the existing business not feasible. 6. That the hardship is not financial in nature. The hardship is not financial in nature. In fact, as stated previously, it would be less expensive for the Developer not to bring this variance application forward. This application is being brought forward by the Developer in an effort to allow the Developer to operate the Property, and the related business thereupon to operate with the appropriate City approvals. Variance 3. Code section 22-95 regarding the setback of the existing building. Code Requirement: "50 foot side setbackfrom a residential district" Setback Provided: 43 feet, 5inches between the existing industrial building and the residential district east of NW 30'x' Avenue. 1. The strict application of the regulations of this ordinance would produce undue hardship. Strict application of the regulations of the Code would produce an undue hardship because the building location is an existing condition. As a result, for the building located on the Property to be forced to comply with the Code, the building would have to be demolished. Given the time that the building has been on the Property, and considering that it is a successful business, requiring the demolition of the building in order to comply with an 8 inch discrepancy would really serve as an undue hardship on the Developer. 2. That such demonstrated hardship is not shared generally by other properties in the same zoning district and in the same vicinity. 4 The existing hardship is not shared with other properties in the vicinity as this is one of the few industrial properties in the area that is close to a residential district. The balance of the residential properties in the area are NOT adjacent to residential properties. 3. That the authorization of such variance will not be of substantial detriment to adjacent properties and that the character of the district will not be changed by the granting of the variance. The granting of the variance will not change the character of the district. Specifically, the requested variance is minimal, and is not likely that the minor 8 -inch intrusion of the building into the setback will create a detriment to the adjacent properties. 4. Such variance is not contrary to the public interest or to the stated purpose of the ordinance. The requested variance is not contrary to the public interest in that the existing building only encroaches into the setback by 8 inches. It is unlikely that such an encroachment impacts anyone outside of the Property. 5. That the hardship is not self-imposed. The hardship is not self-imposed. As previously stated, the Developer purchased the Property in its existing state. The Developer brought this condition to the attention of the City in an effort to create a parcel that is compliance (to the extent possible) with the City's Code. 6. That the hardship is not financial in nature. The hardship is not financial in nature in that the Developer purchased the Property with the existing building in its current location. The Developer is actually expending more funds by trying to make sure that the City is aware of all non -conformities on the Property, and addressing same. Variance 4. Code section 22-95 regarding the rear setback of the building. Code Requirement: "25 -foot rear setback is required between a building located on an industrial property and a residential district" Setback Provided: 3 feet 9 inches between industrial and residentially zoned property. 5 1. The strict application of the regulations of this ordinance would produce undue hardship. Strict application of the Code would produce undue hardship in that the specific location of the buildings existing, and the demolition of same WOULD create an undue hardship on the Developer, as the building which is the subject of this request is a part of an existing, successful business operations. 2. That such demonstrated hardship is not shared generally by other properties in the same zoning district and in the same vicinity. The referenced hardship is not shared with other properties in the vicinity. This situation is unique because if it one of few industrial properties in the area which are adjacent to residentially zoned property. However, it is important to note that the building setback does not meet the Code, it still has not impact on the adjacent residential parcels because of its location on the Property. 3. That the authorization of such variance will not be of substantial detriment to adjacent properties and that the character of the district will not be changed by the granting of the variance. The authorization of the requested variance will not be a substantial detriment to the adjacent properties. Specifically, although the building encroaches into the required buffer, there do not appear to the any residential units on the property despite the fact that it is zoned as such. 4. Such variance is not contrary to the public interest or to the stated purpose of the ordinance. The granting of the variance is not contrary to the public interest. Specifically, the encroachment will not be noticed by anyone outside of the Property. 5. That the hardship is not self-imposed. The hardship is not self-imposed in that the Developer purchased the Property with the existing building in its current location. To that end, the Developer is making these applications to the City in an effort to bring same into conformity with the Code. 6 6. That the hardship is not financial in nature. I am the owner of 13195 NW 38th Avenue. The property to the south of the above subject property. I have the following questions and concerns about the effects of the Operations of A, C and D to the neighboring properties. What type of construction material will be processed and how will it be processed? Will the material be asbestos free and how will this be monitored? Will the material be lead free and how will this be monitored? Will the process be compacting, compressing and/or pulverizing? Will the process be noisy? Will the process pollute the air and ground water with dust? What tonnage do you anticipate processing in a year? What will be the effects on local traffic? A major concern is the erosion and flooding of 38th Avenue directly in front of my property and the only entrance and exit to the 3805 property. When this area floods (which is often), getting in and out of this area is extremely dangerous. It is common to see abandoned cars sitting in the street that has been flooded. Any zoning approvals for this area should be directly tied to Road and Sewer Repairs prior to increased industrialization. This proposed process will require daily, multiple trucks bringing material to the site and multiple trucks leaving the facility with the processed material. I would appreciate my concerns and recommendations being considered for the sake, safety and respect of the neighborhood. To facilitate the site plan review, non -conforming components or aspects of the site are identified below; including a description of the requirement, the degree or extent of the non- conformity and the steps taken as part of this site plan process to mitigate or reduce the overall non -conforming nature of this site through variances, special exceptions and site design. 1. This site spans and utilizes portions of unimproved right of way. In order to plat, site plan and develop the property, the applicant requests the vacation of portions of NW 30th Court between NW 130th and NW 131st Streets along with the vacation of portions of NW 130th Street, west of NW 30th Avenue. These are shown on the T - Plat. The right of way being vacated is also shown on the site plan. 2. Concrete production is a (special exception) conditional use in the 1-2 district. By operating without conditional use approval, concrete production is non -conforming and cannot be expanded. Conditional use approval for concrete production (the existing and current use of the property) is requested as part of this application. 3. Setbacks. The require setback (east) to residential zoned districts is 50 ft. where 40'5" is provided. The required rear setback (south) is 25 ft., 3'9" is provided. Please advise whether a variance or acknowledgement of legal non -conforming status is the appropriate mechanism to formalize these conditions. 4. Buffers 30 ft wide are required to the north and east of Parcel B, between the parking and residential zoned properties. Buffers equal or greater than 30 ft. are provided except at the vehicle turn around, where 25 ft. is provided. A variance allowing a minimum buffer of 25 ft. where 30 ft. is required is being requested. 5. The site plan is phased to accommodate the departure of the existing tenant and truck storage use on Phase 2. Phase 1 covers the concrete plant, buildings, concrete truck parking and a small storage area for finished product.
