Page 2 of 2 5.Discussion and Possible Action: a)Fraser Center for The Creative Arts Steve Fitzgerald, Public Arts Committee Chair and President of the Fraser Valley Arts 501(C)(3) presented a conceptual design for the Fraser Church remodel that was created by DAO Architect. Fraser Valley Arts 501(C)(3) board members Lisa Baird and Brian Whitman also spoke. Public Comment was taken from Fraser Valley Metropolitan Recreation District Employees Callie McDermott and Michelle Lawrence and Grand County Economic Development Coordinator, Diane Butler. The Board came to a consensus to move forward with the new Fraser Arts Facility in downtown Fraser and not to add additional classroom space to the Fraser Historic Church. b)Mill Ave Surety Reduction Trustee Soles moved, and Trustee Miller seconded the motion to approve Resolution 2022-02-02 Approving Partial Reduction in the Surety Pursuant to the SIA for Byers Peak Ranch Filing 2, Parcel 2, The Mill Apartments. Motion carried: 5-2, Nay Waldow and Quinn. c)Cozens Ranch Restrooms The Board came to a consensus to move forward with Green Flush Restrooms. d)SB16 Discussion The Board authorized the Town Manger to write a letter opposing SB16 and the Mayor to sign. 6. Trotter, AICP, Town Planner DATE:February 8, 2022 SUBJECT:Minor Subdivision – Final Plat & Conditional Use Permit MATTER BEFORE THE BOARD: We are in receipt of a Minor Subdivision Final Plat and Conditional Use Permit (CUP) for Waldron Minor Subdivision. A CUP public hearing has been scheduled at Town Board on February 16, 2022. ACTION REQUESTED/EXECUTIVE SUMMARY: A motion to recommend approval of the Minor Subdivision Final Plat and Conditional Use Permit. BACKGROUND: Marian Waldron is the current owner of Lot 4, Block 2, Byers Vista Subdivision, Reception # 93956. The property address is 401 Norgren Road. Marian Waldron is requesting approval of a minor subdivision final plat and a conditional use permit. The applicant is proposing to subdivide 401 Norgren Road into two lots. See Waldron Minor Subdivision plat. Lot 4A will be used for a future single family dwelling unit. Lot 4B has an existing single family dwelling unit. The purpose and scope of a minor subdivision is that the resulting subdivision will create a total of not more than four (4) lots or four (4) dwelling units and no public improvements need to be constructed or extended to serve the subdivision. Per the Land Development Code, Town Staff has discretion to review and render a decision on a minor subdivision application. The Town Staff shall approve, approve with conditions, or deny the minor subdivision application within thirty (30) days of determination that the application is complete. This application is also being processed as a conditional use in accordance with Section 19-2-270 (d) of the Fraser Municipal Code. This section of the code allows for reduced lot size, width, setback and/or floor area for a residential dwelling as a conditional use, subject to the following provisions: 1 . The CUP review process requires a recommendation from Planning Commission and a public hearing at the Town Board. See Waldron Minor Subdivision plat. The current lot size of Lot 4 is approximately 13,939 SF and is zoned Low Density Multi-Family Residential (LDMF). The applicant is proposing to split Lot 4 into two lots. Lot 4B meets the criteria for a stand-alone lot in the LDMF zoning district. The zoning district standards require a minimum lot area of 6000 SF for a single-family detached dwelling and 3000 SF per dwelling for a single-family attached or multiple-family dwelling and a minimum lot width of 50’. Lot 4B is 9213 SF with a lot width of 90.20’ Lot 4A is 4612 SF with a lot width of 44.78’. As stated above, Section 19-2-270 (d) of the Fraser Municipal Code allows that reduced lot size, width, setback and/or floor area for a residential dwelling may be permitted via a conditional use process in accordance with Section 19-2-120, entitled Conditional use permits, subject to the following provisions: 1 . The following general policies shall apply to all applications for permits or other approvals required under the provisions of this Code, unless different requirements, which are inconsistent with the following, are specified under the provisions of this Code for a particular type of application: 1) No application will be considered complete until all prescribed fees and deposits have been paid. 2) Application fees. Application fees are established and modified from time to time by the Board of Trustees and are set forth in the current fee schedule approved by the Board of Trustees. This 300 plus page legislation has made significant changes to the Colorado classification and penalty structure for misdemeanors. As part of these changes, the maximum fine for any criminal municipal code violation shall not exceed $1,000. Motion carried: 5-0. 4.Discussion and Possible Action Regarding: Waldron Minor Subdivision Town Planner Trotter presented information regarding the Minor Subdivision,Final Plat and Conditional Use Permit.The Planning Commission will make a recommendation to the Town Board.A public hearing has been scheduled at Town Board on February 16, 2022. Marian Waldron is the current owner of Lot 4, Block 2, Byers Vista Subdivision, Reception # 93956. The property address is 401 Norgren Road. Marian Waldron is requesting approval of a minor subdivision final plat and a conditional use permit. The applicant is proposing to subdivide 401 Norgren Road into two lots. Lot 4A will be used for a future single family dwelling unit. Lot 4B has an existing single family dwelling unit. Page 2 of 3 Lot 4B meets the criteria for a stand-alone lot in the Low Density Multi-Family zoning district. The zoning district standards require a minimum lot area of 6000 SF for a single- family detached dwelling and 3000 SF per dwelling for a single-family attached or multiple-family dwelling and a minimum lot width of 50’. Lot 4A has a minimum lot area of 4612 SF and a minimum lot width of +/- 44’. Lot 4A meets the provisions delineated below: Section 19-2-270 (d) of the Fraser Municipal Code allows that reduced lot size, width, setback and/or floor area for a residential dwelling may be permitted via a conditional use process in accordance with Section 19-2-120, entitled Conditional use permits, subject to the following provisions: 1 . The proposed building footprint is 22’ X 44’ or approximately 968 SF. Building height is 35’. No ADU shall be allowed on Lot 4A per Code. Marian Waldron presented her ideas for the property. Other Business: Commissioner Soles attended a meeting for big picture sustainable planning efforts for Fraser Valley. The Town needs to update their comprehensive plan, which was last done in 2010 according to Town Manager Ed Cannon. This expense was eliminated from the 2022 budget. Town Manager Cannon updated the Commission on the purchase of Victoria Village. The Town made an offer of $3,800,000,which was accepted by the sellers.Assistant Town Manager Michael Brack has submitted a grant which would cover 80 percent of Page 3 of 3 the cost.The Town will know by February if they received the grant,with the grant money in hand by May. Town Manager Cannon briefed the Planning Commission on the acceptance of Grand Park Drive. Town Manager Cannon gave an overview of the deed restriction program. 6.Open Forum: Town Planner Trotter brought up another grant from Colorado Parks and Wildlife,which will be used to create a non-motorized trail on the west side of the Fraser River from the Lions Ponds to Rendezvous.The grant is for $250,000.00 and the Town will be notified in March if we are awarded the grant. 7.Future Agenda Items: Willows Apartments –Town Planner Trotter let the Commission know the Willows Apartments project has morphed into the Alpenglow project.It will be presented at the February 23, 2022 meeting. Trotter has also met with the new owners of the One Love property (315 Fraser Ave/416 Zerex).They have submitted a sketch plan with both commercial and residential land uses. 8.
