2.Approval of Agenda:
Trustee Cerkvenik moved, and Trustee Soles seconded the motion to approve the
amended agenda to include Open Forum before Updates. Motion carried: 7-0.

Trustee Waldow moved, and Trustee Cerkvenik seconded the motion to approve the

4.Discussion and Possible Action:
a)Treasurer's Report
Finance Director Rob Clemens introduced the Treasurer’s Report. This will be a monthly
report presented at the second meeting each month.
b)Cornerstone Attainable Housing Report
Clark Lipscomb of Cornerstone presented the Cornerstone Attainable Housing Report
c)Public Art Committee Application
Trustee Cerkvenik moved, and Trustee Quinn seconded the motion to appoint Tara
Rose Hendricks to the Public Art Committee. Motion carried: 7-0.
d)Fraser River Valley Regional Housing Partnership Appointment

Trustee Quinn moved, and Trustee Gregory seconded the motion to appoint Mike
Johnson to the Fraser River Valley Regional Housing Partnership Board as the Fraser
Representative. Motion carried: 7-0.
e)Colorado Paid Family and Medical Leave Insurance Program
Town Manager Ed Cannon presented the Colorado Paid Family and Medical Leave
Insurance Program. There will be a hearing and vote at the last meeting in June
f)Byers Avenue Waterline Replacement Status and Lions Ponds Update
Taylor Excavating will execute the contract for the Lions Ponds Bathrooms, which was
approved by Merrick. Taylor Excavating is expecting to present a bid for the Byers
Avenue Waterline Replacement

a) Cerkvenik, The Waterwaste Water Advisory Committee inquired as to there
purpose. An ordinance to dissolve the committee will be presented at the next meeting.
The Board supports a letter of support for the Highway 40 grant for repairs. Thank you to
NWTPR for filling holes on Berthoud Pass.
b)Quinn, asked for a Pre-Treatment update, the town is working with Geosyntec, and
Joe Fuqua will be inspecting the breweries and distilleries. What is the status of the
augmentation pond in Grand Park, this will be discussed in the executive session?
c) Fisher, the pole yard has historic buildings from the POW camp. The Grand County
Historical Association should be contacted.
8.Executive Session:
For a conference with the Special Attorney for the purpose of receiving legal advice on
specific legal questions under C.R.S. Section 24-6-402(4)(b) and for the purpose of
determining positions relative to matters that may be subject to negotiations, developing
strategy for negotiations, and/or instructing negotiators, under C.R.S. Section 24-6-
402(4)(e). Regarding litigation. Including Town Attorney Kent Whitmer, Town Manager
Ed Cannon
Trustee Cerkvenik moved, and Trustee Soles seconded the motion to open the
Executive Session at 7:50 p.m. Motion carried: 7-0.

Executive Session at 8:49 p.m. Motion carried: 7-0.
Attorney’s Opinion Required by C.R.S. 24-6-402(2)(d.5)(II)(B). As the attorney
representing the Town of Fraser, I am of the opinion that the entire executive session,
which was not recorded, constituted a privileged attorney-client communication.

A RESOLUTION APPOINTING A DIRECTOR TO REPRESENT THE TOWN OF FRASER ON
THE FRASER RIVER VALLEY HOUSING PARTNERSHIP BOARD
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER,
COLORADO THAT:
WHEREAS,The Town Board approved the Intergovernmental Agreement (IGA)forming
the Fraser River Valley Housing Partnership in Resolution 2022-04-08 to participate in the
establishment of a multijurisdictional housing authority serving the interests of residents of
Winter Park, Fraser, Granby and Grand County;
WHEREAS,the IGA calls for each participating government to appoint a director
representing the jurisdiction to the board of the Fraser River Valley Housing Partnership;
WHEREAS,the Fraser Town Board has published and accepted applications for the
appointed director seat and has reviewed the submitted applications;

A RESOLUTION AUTHORIZING THE TOWN MANAGER TO APPROPRIATE FUNDING FOR
A FLEET PURCHASE
WHEREAS, the 2021 budget appropriated funds to purchase a water wastewater truck
with a manual extension, rotation boom, and plow as a Capitol Equipment Replacement. The
town was not able to secure the purchase in 2021.
WHEREAS, the town is able to secure a vehicle to purchase in 2022; however, the full
allocation was not re-budgeted in 2022 for the vehicle purchase including the outfitting.
WHEREAS, it has been determined that a hydraulic extension and powered rotation
boom would be better suited for the staff and town rather than a manual boom.
WHEREAS; The 2022 Ram Pickup 3500 has increased in cost by $10,000 and the
request to purchase a ET8KX hydraulic crane rather than a manual crane is an additional
$14,000. The truck and outfitting are a total cost of $125,000.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FRASER, COLORADO THAT:
1.The Town Manager is authorized to expend up to $130,000 for the purchase of a 2022
Ram Pickup 3500, ET8KX hydraulic extension, powered rotation boom, and plow, to
include the materials and labor for the outfitting.
2.The purchase must be made by December 31, 2022 or this resolution is null and void.

SUBJECT:Staff Report PW: Utilities Truck and Outfitting Exceeds Original Estimate
SUBJECT: CONSENT AGENDA
Consideration of a Resolution Authorizing the allocation of additional funding for the purchase of
water wastewater truck and the outfitting with a hydraulic crane, power rotation and plow. The
town has committed to the purchase of the truck and requires approval for the truck purchase
and outfitting.

REQUESTED ACTON:
Approve the Resolution to appropriate funding from the Regular Fleet Purchases (30-40-750) of
the 2022 Capitol Equipment Replacement Fund and authorize the appropriate Town officer to
expend said funds.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The 2021 budget allocated funds for the purchase of the water wastewater truck replacement.
The town was not able to secure a purchase in 2021 and the full allocation was not re-budgeted
in the 2022 budget. The 2022 budget allocated $140,000 in the Capitol Equipment Replacement
Fund (30-40-750) and $150,000 in the Heavy Equipment Purchase (30-40-755), total $290,000.
These funds were allocated for the purchase of the water wastewater truck to include the
outfitting, an operations and maintenance (O&M) vehicle including the outfitting and a haul
truck. The O&M vehicle has been purchased for $90,000 and the haul truck for $105,000, total
$195,000, remaining funds of $95,000.

The purchase of the water wastewater truck and the outfitting is $125,000 which is $35,000 over
budget for the total of these two funds. This does not require a budget amendment.
The truck has increased in cost by $10,000 and the request to purchase a ET8KX hydraulic
crane rather than a manual crane is an additional $14,000. The total outfitting of the truck is
$25,000 including the set up of the hydraulic crane, power rotation, and a plow.
A crane is necessary to perform many of our maintenance activities, primarily the repair of
damaged fire hydrants, control valve maintenance, and the loading/unloading of pipes and gate
valves. Additionally, having a crane installed on a dedicated maintenance truck reduces labor
costs, equipment requirements and down time from mobilization. Since many repairs that would
require mobilizing a loader and a loader operator can be accomplished with a single utility
operator with a remote control.
Our current crane requires manual setup, extension, and rotation. This has caused back strain
and an increased risk of injury due to the lifting and manipulation of the boom while under load.
This also causes an unsafe work environment due to employees taking shortcuts to avoid the
time and effort needed to setup the crane. For these reasons we are asking for the hydraulic
crane and power rotation.

MATTER BEFORE BOARD:
The Public Arts Committee (PAC) applied for s special event permit for the Fraser Mountain
Mural Festival (FMMF). The event will take place August 5-7, 2022.
ACTION REQUESTED:
The PAC would like to close Railroad Avenue for the duration of the FMMF.
BACKGROUND:
The Fraser Public Arts Committee has submitted a Special Event Permit application for the
FMMF. The application request to close Railroad Avenue from the alley between the Fraser Car
Wash and Fraser Ace north to Park Avenue, see map below. The dates are August 5-7. All
activities will take place during the day and the road will remain closed for the duration of the
dates. There will be a stage for music, murals, and bathrooms. Barriers will be placed at the
north and south end of Railroad Avenue and no non-emergency vehicle access will be allowed.
An egress will be available for emergency vehicles on the east side of Railroad Avenue.
Volunteers will be present to monitor the event. The town will provide barriers to be placed at
the north and south side of Railroad Avenue.
The 4th annual Fraser Mountain Mural Festival will have a similar layout as the 2 previous
years, with mural spread throughout town. We are losing some space at the property that One
Love was on and moving the murals from the far north and south end of town closer to the
center of town to provide a more condensed layout. They will also be adding 5 more murals to
make it a grand total of 30. The PAC has talked with the Fraser Winter Park PD to discuss
access for emergency vehicles, and we will be placing the murals on the west side of the road
to allow enough access for a vehicle if needed.
A courtesy notice was mailed to all of the property owners with in a 200 feet radius. The FMMF
special event permit does not require a public hearing because it is an alcohol-free event.
However, this does require Town Board approval to close the town right-of-way.

Staff recommends approving the Special Event Permit for the Fraser Mural Festival on August
5-7, 2022.

AN ORDINANCE AMENDING CHAPTER 2 ARTICLE 10 OF THE FRASER MUNICIPAL CODE
REGARDING THE DISSOLUTION OF THE WATER AND WASTEWATER COMMITTEE
WHEREAS, while the role of the Water and Wastewater Advisory Committee has been
advantageous over the years to the Town’s ability to manage wastewater facilities, the Town
now has a dedicated staff to manage and maintain all water and wastewater utilities and future
planning.
WHEREAS, the Town Board has determined it best to dissolve the Water and Wastewater
Advisory Committee via this amendment to the code.
WHEREAS, members of the Water and Wastewater Advisory Committee have confirmed their
interest to provide counsel regarding water and wastewater matters and facilities following the
dissolution of this committee.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FRASER, COLORADO, THAT:
PART 1: AMENDMENT OF MUNICIPAL CODE.
Chapter 2 (Water and Wastewater Advisory Committee), Article 10 of the Fraser Municipal
Code (herein sometimes referred to as the "Municipal Code") are hereby amended as follows

print]:
ARTICLE 10 - Water and Wastewater Advisory Committee
Sec. 2-10-10. - Creation.
There is hereby created a Water and Wastewater Advisory Committee for the Town composed
of five (5) members who may perform all functions currently or hereinafter authorized by this
Article and future ordinances adopted by the Board of Trustees.
Sec. 2-10-20. - Members.
The Water and Wastewater Advisory Committee shall consist of two (2) ex officio members who
shall be members of the Board of Trustees selected by the Board of Trustees. The balance of
the Water and Wastewater Advisory Committee shall consist of three (3) members appointed by
the Board of Trustees. All members of the Water and Wastewater Advisory Committee may be
compensated as established by resolution of the Board of Trustees.
Sec. 2-10-30. - Terms.

The terms of the ex officio members shall correspond to their respective official tenure. The
terms of each of the appointed members shall be two (2) years, or until his or her successor
takes office. Terms of the appointed members shall be concurrent with the two-year municipal
election cycle.
Sec. 2-10-40. - Eligibility.
All members of the Water and Wastewater Advisory Committee shall be bona fide residents of
the Town, own property within the Town or have at least ten-percent ownership interest in a
business that owns property within the Town. If any member ceases to meet these eligibility
requirements, his or her membership on the Water and Wastewater Advisory Committee shall
immediately terminate.
Sec. 2-10-50. - Removal from Water and Wastewater Advisory Committee.
Members, other than a member currently serving on the Board of Trustees, may be removed by
resolution of the Board of Trustees for inefficiency, neglect of duty or malfeasance in office, or if
such member has missed three (3) consecutive meetings or three (3) meetings in a fiscal year
unless such absences shall be excused by the Committee. The Mayor or the Board of Trustees,
as the case may be, shall file a written statement of reasons for such removal for consideration
by the Board of Trustees. Due to the nature of matters that may be considered by the Water and
Wastewater Advisory Committee, members are expected to serve with discretion and shall be
required to enter into confidentiality agreements with the Town.
Sec. 2-10-60. - Chairperson.
The Water and Wastewater Advisory Committee shall elect a Chairperson from among the
members. The term of the Chairperson shall be one (1) year, with eligibility for reelection.
Sec. 2-10-70. - Expenditures and employees.
The Water and Wastewater Advisory Committee is not authorized to hire any employees or
expend any Town funds. The Town Manager will assign staff and make other resources
available as he or she deems appropriate.

Sec. 2-10-80. - Responsibilities.
(a)The Water and Wastewater Advisory Committee shall act in an advisory capacity to the
Board of Trustees as requested by the Board of Trustees and/or the Town Manager.
(b)The Water and Wastewater Advisory Committee is authorized to explore matters related to
water and wastewater and make recommendations to the Board of Trustees and/or the Town

Manager.
(c)The Water and Wastewater Committee shall hold at least one (1) regular meeting quarterly. A
quorum is not required in order to hold a meeting.
PART 2: REPEAL. Any and all existing ordinances or parts of ordinances of the Town of Fraser
covering the same matters as embraced in this Ordinance are hereby repealed and all
ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby
repealed; provided, however, that such repeal shall not affect or prevent the prosecution or
punishment of any person for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this Ordinance.
PART 3: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this
Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect
the validity or constitutionality of the remaining portions of this Ordinance. The Town of Fraser
hereby declares that it would have adopted this Ordinance, and each section, subsection,
clause or phrase thereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses and phrases thereof be declared invalid or unconstitutional.
PART 4: EFFECTIVE DATE. This Ordinance shall take effect thirty (30) days after passage,
adoption and publication thereof as provided by law.
PART 5: PUBLICATION. This Ordinance shall be published by title only.
