A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD COMMENDING THE LYNWOOD JAYCEES FOR OUTSTANDING SERVICE TO THE COMMUNITY. WHEREAS, the Lynwood Jaycees did on the weekend of June 10, paint the Lynwood Recreation Building, and WHEREAS, this project contributed to the City beautification program and resulted in significant economic savings to the City,, and WHEREAS, the Jaycees participating in this project included, President Wes Varvi, Vice President Bill McDowell, Jim Morton, Bill Hardy, Dave Ott, Manny Zuniga, Mickey Davidson, Brian Cooley, Hank Lafuente, and Sal Sferrazza, and WHEREAS, the Jaycees in the past have provided playground equipment, flag poles, playground lighting systems, recreation depart- ment marquees, public address systems for the park, handball courts and baseball field improvements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LYNWOOD THAT the Council extend to the Lynwood Jaycees on behalf of the citizens of Lynwood their appreciation for out- standing performance as a community service group and their many fine contributions to the City of Lynwood. RESOLUTION CONFIRMING THE REPORT OF THE BUILDING OFFICIAL OF THE EXPENSE INCURRED BY THE CITY IN THE DEMOLITION OF BUILDINGS DONE PURSUANT TO SECTION 203 OF THE UNIFORM BUILDING CODE 1970 EDITION AND THE UNIFORM HOUSING CODE 1964 EDITION AND ORDERING -THE EXPENSE BE ASSESSED AGAINST THE REAL PROPERTY UPON WHICH THE BUILDINGS FORMERLY STOOD, CONFIRMING THE ASSESSMENT, THAT THE SAME TO BE RECORDED AND THE THE COUNTY TAX ASSESSOR, THE COUNTY TAX COLLECTOR AND THE COUNTY AUDITOR UPON RECEIPT:,OF NOTICES OF LIEN, TO RECEIVE THE SAME AND TO ADD THE AMOUNT OF THE ASSESSMENT TO THE NEXT REGULAR BILL FOR TAXES LEVIED AGAINST THE LOT OR PARCEL OF LAND THEREIN DESCRIBED AND THE AMOUNT OF THE COUNTY ASSESSMENT UNDER THE LAW IN SUCH CASES MADE AND PROVIDED. WHEREAS, the Building Official has prepared and filed with the City Clerk a report specifying the work done and an itemized account of the expense incurred by the City in the demolition of the hereinafter described premises under Section 203 of the Uniform Building Code, 1970 Edition and the Uniform Housing Code 1964 Edition, and WHEREAS, pursuant to Section 17.2 of the Lynwood City Code, the City Clerk on May 16, 1972, presented the report of the Building Official to the City Council for consideration, and WHEREAS, in accordance with law the City Council fixed a time, date, and place for hearing said report, and any protest or objections thereto, and WHEREAS, the City Clerk did cause notice of said hearing to be posted upon the property hereinafter described, and published once in the Lynwood Press, a newspaper of general circulation in the -1- 0 0 City, and did serve by certified mail, postage prepaid, addressed to Mr. Kelvin K. Pringle, the owner of the property as his name and address appears on the last equalized assessment roll of the County, on the 30th day of May , 1972, which is more than ten days prior to the date set for the hearing, and did in such notice give further notice that on the 20th day of June, 1972, beginning at the hour of 7:30 p.m. or as soon thereafter as the matter can be heard in the Council Chambers of the City Hall of the City of Lynwood, California, the Council of the City of Lynwood would hear and pass upon said report of the Building Official of the said cost of said repairs, together with any objections and protests which might be raised by the property owner liable to be assessed for the cost of said demolition, and the objections or protests of any other interested persons, and WHEREAS, on the said 20th day of June, 1972, said City Council did proceed to hold said hearing and did duly and regularly conduct the same; all as contemplated by law, and WHEREAS, protest(s) and objection(s) was /were made, presented and filed in such matter. NOW, THEREFORE, the City Council of the City of Lynwood, California, does hereby resolve, declare, find, determine and order as follows: Section 1. That the facts.with reference to said matter as recited in the preamble to this resolution are true. Section 2. That the City Council does hereby confirm the report of said Building Official which is on file in the Office of the City Clerk of said City and open to public inspection, and which is referred to and incorporated by reference herein. Section 3. That the said Council does hereby assess the costs of said demolition against the real property hereinafter described, and does hereby order that unless the amount so assessed is paid within 30 days, the said amount shall constitute and be -2- I I t 0 0 and is hereby levied by said Council as a special assessment against said parcel of real property for the amount as set forth in said report, and as contemplated under the provisions of Sections 17.2 of the Lynwood City Code, which said lien shall continue until the assessment and interest thereon is paid, or until the lien is discharged of record. Section 4. Said County Assessor, said County Tax Collector and said County auditor are hereby authorized, instructed, directed and ordered, upon receipt of such notice of lien, to receive the same and thereafter to proceed to add the amount of the assessment indicated in notice of lien herein above set forth in said above report of said Building Official, to the next regular bill of taxe levied against the lot or parcel of land hereinafter described and to enter the amount thereof on the County Assessment Book opposite the description of the property described and referred to in the notice of lien as set forth in said report, and the amount thereof shall be collected with all other taxes thereon against the property described. Said County officers, and each of them, are hereby further authorized, instructed, directed and ordered to perform any further acts on their respective parts, all as contemplated under the w in such cases made and provided. Section 5. That this resolution shall take effect immediately. Section 6. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD DETERMINING THE RESULTS OF HEARING; OVERRULING PROTESTS; DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRE CERTAIN WORK OR IMPROVEMENT SUBSTANTIALLY AS SET FORTH IN REPORT ON PROJECT FILED UNDER THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION, AND MAJORITY PROTEST ACT OF 1931; DETERMINING THAT SAID PROJECT IS FEASIBLE; AND MAKING OTHER DETERMINATIONS IN THE MATTER OF LYNWOOD STREET LIGHTING DISTRICT NO. 2 WHEREAS, 'this City Council has heretofore, by Resolution No. 72 -56, taken the steps provided by Sections 2821, 2822, and 2823 of the Streets and Highways Code of the State of California (said Sections being a part of the Special Assessment Investigation, Limitation, and Majority Protest Act of 1931, Division 4 of said Code) for certain street lighting work in the City of Lynwood, California; and WHEREAS, by said Resolution No. 72 -56 this City Council also - directed the City Engineer to procur the required information and prepare and present to this City Council the written report on said work and improve ment required by said Special Assessment Investigation, Limitation and Majority Protest Act of 1931; and WHEREAS, said report has been presented to this City Council and said City Council, by Resolution No. 72 -57, approved and ordered said report filed and fixed a time and place for a hearing on said report; and WHEREAS, notice of said hearing was mailed as required by said Special Assessment Investigation, Limitation and Majority Protest Act of 1931; and WHEREAS, at the time and place so fixed a hearing was duly held by this City Council at which all written protests or objections, if any, which were presented were read, and all persons desiring to be heard thereon, were heard and this City Council gave all persons present an opportunity to be heard in respect of any matter relating to said report, said work or improvement, or any of the proceedings; and WHEREAS, all persons desiring to appear and be heard were heard at said hearing, and said hearing has been regularly held and closed; and WHEREAS, this is the time and place for consideration of said report, and this City Council has considered said report and is fully informed in the premises; NOW THEREFORE, THE CITY COUNCIL. OF ,THE CITY OF LYNWOOD DOES HEREBY RESOLVE, FIND, DETERMINE, AND ORDER AS FOLLOWS: RESOLUTION NO. Lynwood Street Lighting District No. 2 Page 2 Section 1. That said report contains all the matters and things required by law and that notice of hearing of the proposed project generally described therein has been duly and regularly given. Section 2. That no written protest has been filed with the Clerk of this City Council by the owners of one -half of the area of the property to be assessed for said proposed work or improvement and that there is no majority protest as provided in Section 2931 of the Streets and Highways Code, against only a portion of said proposed work.or improvement. Section 3. That all protests and objections be and the same hereby are over- ruled and denied. Section 4. That the public interest, convenience and necessity require the work or improvement substantially as set forth in said report; that the project for said work or improvement is feasible; that the land to be assessed for said work will be able to carry the burden of the proposed assessment for said work and that, pursuant to Section 2905 of said Code, the limitations as set forth in said Division 4 may be and shall be disre- garded, both with respect to the proposed assessment district as a whole and as to the limitation on individual specific assessments for said work. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD MAKING DETERMINATIONS, DECLARING NO MAJORITY PROTEST, ORDERING IMPROVEMENTS, AND LEVYING ASSESSMENTS IN THE MATTER 'OF LYNWOOD STREET LIGHTING DISTRICT NO. 2 /I WHEREAS, this City Council on the second day of May, 1972, adopted Resolution No. 72 -57 approving the Debt Limit Report prepared pursuant to the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 and fixing the 20th day of June. 1972, at the hour of 7:30 P. M. in the Council Chambers of this City Council as the time and place for holding a hearing on said Report; and WHEREAS, after notice duly given and at the time and place fixed in said Resolution No. 72 -57 a hearing was duly held by this City Council at which all written protests or objections, if any, were duly presented and read and all persons desiring to be heard on the report were heard; and WHEREAS, protests were not made by the owners of more than one -half of the area of property to be assessed for the work or improvement proposed in said report and this City Council adopted its Resolution No, 72- , making certain determination; and WHEREAS, this City Council has, by Resolution No. 72 -55, declared its intention pursuant to the Street Lighting Act of 1919 Plan Division 14 of the Streets and Highways Code of the State of California, to form Lynwood Street Lighting District No. 2, for the installation of certain street lighting improvements and appurtenances and all appurtenance work in connection therewith, in accordance Plan 1972 -D on file in the office of the City Engineer, and the service and maintenance of the street lighting systems in said City, including the annual maintenance and energy costs on certain Edison Company facilities as well as certain City facilities and the installation of certain standards and fixtures; and WHEREAS, by Resolution No. 72-55, this City Council has approved a report prepared by the City Engineer under and pursuant to the Street Lighting Act of 1919 and, in particular, Sections 18040 and 18041 of the California Streets and Highways Code; and WHEREAS, said report contains, among other things, plans and specifications for the said work and improvements, estimate of the cost of said work and improvements, a diagram showing the assessment district and the boundaries and dimensions of the respective lots or parcels of land within the assessment district, and a proposed assessment of the total amount of the costs and expenses of said work or improvements upon the several lots or parcels of land in the assessment district in proportion to the estimated benefits to be received by such lots or parcels, respectively, from the said work or improvements; and i • WHEREAS, in said Resolution No. 72 -55 said City Council fixed June 20, 1972, at the hour of 7:30 P.M. at the meeting place of said City Council, in the City Hall, 11330 Bullis Road, Lynwood, California, as the time and place of hearing protests and objections to the work or improve- ments proposed in said reports to be made, the extent of the assessment district proposed to be created and /or to the proposed assessment; and WHEREAS, the Clerk of said City has given the notices of the passage of the Resolution of Intention, Resolution No. 72 -55, and of the filing of the report, and of the time and place and purpose of said hearing, all as required by the Street Lighting Act of 1919; and WHEREAS, said City Clerk has filed with this City Council her affidavit setting forth the time and manner of the compliance with the requirements of the Street Lighting Act of 1919 for publishing, posting, and mailing of said notices; and WHEREAS, at the time and place stated in said notices, a hearing was duly held by this City Council at which meeting said report was duly presented and considered, and all written protests and objections received, if any, were duly presented, read, heard, and considered, and all persons appearing at said hearing and desiring to be heard in the matter of said report were heard, and a full, fair and complete hearing has been held and this City Council is fully informed in the premises, and WHEREAS, this City Council has examined and considered the assessment proposed in said report and proceedings prior thereto, and the evidence presented at said hearing; and WHEREAS, all protest and objections, written and oral, made or filed in the matter of said report or said assessment have been overruled and denied, ! NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY, RESOLVE, DETERMINE AND ORDER, AS FOLLOWS: Section 1. That said hearing has been duly held and notices thereof duly given as set forth in the recitals hereof, and each and every step in the proceedings prior to and including the hearing has been duly and regularly taken. Section 2. That all persons at said hearing were given the opportunity to be heard on the extent of the assessment district, the work, and the assessments. The assessment district designated '"Lynwood Street Lighting District No. 2 ", with the exterior boundaries as shown on the map showing "Proposed Boundaries of Lynwood Street Lighting District No. 2 ", recorded in the office of the County Recorder, County of Los Angeles, California, in Book of Maps of Assessment Districts, is hereby ordered formed. The report and assessment diagram prepared by the City Engineer and filed with the City Clerk are hereby approved and confirmed. Section 3. That all protests and objections, written and oral, made or filed in the matter of said report and or assessment contained there- in have been and are hereby overruled and denied. Y • 9 ' Section 4. That the amount of the assessments shown in said report should be, and the same hereby is, confirmed and fixed. Section 5. That the amounts to be assessed against the individual parcels shown on the assessment diagram contained in said report are hereby approved and confirmed, and the City Clerk of the City is hereby directed to endorse the fact and date of such approval on said report. Section 6. That the work or improvements referred to in said report are hereby ordered to be made. Section 7. That the City Clerk of this City is hereby authorized and directed to file and record the said diagram and assessment as required by law and shall record a notice of assessment and give notice of the recordation of said assessment as required by law. SHEPHERD City Clerk City of Lynwood 3+ I `J June 20, 1972 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL L SUBJECT: LEASE OF CITY OWNED LAND TO SCHOOL DISTRICT Gentlemen: The Lynwood Unified School District has requested that the City of Lynwood consider leasing a small parcel of land owned by the City for the purpose of accommodating a temporary facility for the Junior High Opportunity Class. The parcel of land being proposed for this use is the southwest corner of Mulford Avenue and Birch Street. Requested lease is for a three -year period commencing July 1, 1972 and terminating June 30, 1975 with an option to renew the lease annually thereafter. The School District proposes to pay the City $80 per month for the stated period. Enclosed is a lease developed for Council consideration which will accomplished the conditions requested by the School District. RECOMMENDATION Council approval of the enclosed lease between the City of Lynwood and the Lynwood Unified School District for temporary lease of the land at the southwest corner of Mulford Avenue and Birch Street. WHEREAS, the students enrglled in the Junior H"gh Opportunity Classes Lynwood Unified School District cannot be accommodated in the classrooms, of said present building, and I WHEREAS, the City of Lynwood is desirous of making available to the Board of i `d k' �I I E � Education land for temporary quarters for the Junior High Opportunity Class to alleviate the overcrowded conditions, NOW THEREFORE, the parties, for and in consideration of the rents, covenants, and agreements hereinafter set forth, mutually promise as follows: WITNESSETH 1, The Lessor does hereby grant to the Lessee property described as: I; The Portion of property being a part of the Oscar Tower 40.37 acres commonly known as the Lynwood City Park, bounded on the west and south sides by the I southwest corner of said tract, on the east by the prolongation!of the west property fine of Birch Street, and on the north by the prolongation of the south property line of Mulford Avenue. All within the corporate boundaries of the City of Lynwood, (See attached plot plan), together with the right of I ingress and egress for school purposes, and all rights, privileges and appur- tenances thereto for a period of three years, commencing July 1, 1972 and terminating June 30, 1975, with the option to renew the lease annually there- , after. Four alternative street patterns were considered by the City Planning Commission of which a street pattern was eventually approved as indicated in the enclosure. Based on this, engineering street plans were designed and prepared. Generally, the street design begins from Wright Road into the Industrial Park area with an intersecting north -south street having its northerly terminus at Cortland Avenue to the north and a cul -de -sac to the south. The geometrics of this road -way are of a typical industrial street, approximately 2,000 feet long having a curb -to -curb width of 50 feet on a 70 foot line right -of -way. The structural section of the street is 4" of A.C. on 12" of compacted aggregate base. These plans have been submitted to the State Division of Highways and the City has been notified the plans are in conformance with their ramping structure locations, and thus offer no conflict with the proposed freeway interchange. The street design contract with this Engineering firm is now complete and plans are now on file in the City Engineer's office. RECOMMENDATION Council approve and accept Street Construction Plans for the Lynwood Industrial Park and authorize payment of all remaining moneys for this contract work. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADDING ARTICLE IX TO CHAPTER 2 OF THE CODE OF THE CITY OF LYNWOOD ESTABLISHING A REAL ESTATE PRACTICES COMMISSION AND SETTING FORTH THE POWERS AND DUTIES THEREOF THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN AS FOLLOWS: Section 1. Article IX is added to Chapter 2 of the Code of the City of Lynwood to read: Article IX REAL ESTATE PRACTICES COMMISSION Sec. 2.180 Creation. There is created hereby a Real Estate Practices Commission as provided in this article. Sec. 2. 181 Composition. The Real Estate Practices Commission shall consist of five (5) members, all of whom shall be residents of the City of Lynwood. Two of the members shall be members of the real estate profession, and three of the members shall be members of the general public not engaged in the real estate profession. The City Manager or his designated representative shall serve as the Secretary of the Commission, but shall not be entitled to vote or otherwise be considered a member of the Commission. Sec. 2. 182 Appointment of Members. The members of the Real Estate Practices Commission shall be appointed by the City Council. Sec. 2. 183 Term of Office. The term of office of the members of the Real Estate Practices Commission first appointed shall be selected by lot as follows: one member of the public for a term of two years; one member of the public and one member of the real estate profession each for a term of three years; and one member of the public and one member of the real estate profession each for a term of four years. All succeeding terms shall be for a period of four years. Members shall hold office until their successors are qualified and take office. Sec. 2.184 Removal from Office. Members may be removed prior to the expiration of their term by a majority vote of the members of the City Council. Absence from three consecutive meetings without cause shall be deemed to constitute the retirement of such absent member and his position shall thereupon become vacant. Sec. 2. 185 Meetings. The Real Estate Practices Commission shall meet regularly at least once a month in the Council Chambers in the City Hall of the City of Lynwood, except as otherwise provided by law. Special meetings may be called by the chairman or a majority of the members of the Commission. All meetings shall be open to the public except as otherwise authorized by the laws of the State of California. Regular minutes a ORDINANCE NO. The Real Estate Practices Commission shall elect one of its members as chairman and one of its members as vice chairman. The Commission members so elected shall hold office for one year and until their successors are elected. The Commission shall estab- lish such rules and regulations as it deems necessary for the regulation of its proceedings and the performance of its duties. Such rules and re- gulations shall not be inconsistent with the laws of the State or the ordi- nances of the City of Lynwood. Sec. 2. 187 Powers and Duties. The Real Estate Practices Commission shall have the following powers and duties: (a) To investigate, study, review, and analyze real estate practices within the City of Lynwood, with special emphasis on such questionable and unworthy practices as may be associated with racial and /or ethnic discrimi- nation and blockbusting in connection with the sales of residential property in the City; (b) To make recommendations to the City Council of the City of Lynwood concerning policies, resolutions, and /or ordinances which might be adopted by that body to upgrade and improve real estate practices within the City of Lynwood especially as they relate to discrimination and blockbusting; (c) To work with the Ethical Practices Committee of the Lynwood - Compton Board of Realtors to help formulate such recommendations; and, (d) To serve as the agency responsible for the enforcement of Chapter 25 -A of the Code of the City of Lynwood. Section 2. Section 4 of Chapter 25 -A of the Code of the City of Lynwood is amended to read as follows: Sec. 4 Enforcement. (a) The Real Estate Practices Commission shall have the following functions, powers, and duties in addition to those provided otherwise by law: (1) To adopt, promulgate, amend and rescind suitable rules and regulations to carry out the provisions of this ordinance provided that such rules and regulations shall be approved by the City Council and, upon approval, filed with the City Clerk; (2) To receive and investigate complaints alleging violations of the provisions of this ordinance; ORDINANCE NO. REAL ESTATE PRACTICES COMMISSION Page 3 (3) To hold conferences and make investigations, and for this purpose to call upon City of Lynwood officials and employees and other bodies to aid and assist it therein, (4) To render each year to the City Council a written report of activities pertaining to this Chapter, (b) Any person claiming to be aggrieved by an alleged unlawful practice forbidden by this ordinance, may be himself or by his attorney at law, make, sign, and file with the Real Estate Practices Commission a verified complaint in writing which shall state the name and address of the person, firm, partnership, or corporation alleged to have committed the unlawful practice complained of and which shall set forth the particulars thereof and contain such other information as may be reasonably required by the Real Estate Practices Commission. (c) After the filing of a complaint by an aggrieved person, or by any City of Lynwood resident, the Real Estate Practices Commission shall cause a prompt investigation to be made of the alleged unlawful practice. (d) If, after such investigation, the Real Estate Practices Commission shall determine that no probably cause exists for crediting the allegations of the complaint, it shall, within ten (10) days from such determination, cause to be issued and served upon the complainant written notice of such determination, (e) If, after such investigation, the Real Estate Practices Commission shall determine that probably cause exists in accordance with the allegations of the complaint, it shall immediately endeavor to elimi- nate the unlawful practice complained of by conference and conciliation. Such conference shall be opened to the public unless otherwise requested by one or both of the parties to the conference. It may refer the matter to other public boards of the City of Lynwood officials or employees to conduct or assist in such conferences, (f) If the practice complained of be not eliminated, the Real Estate Practices Commission may: (1) Refer the matter to the Real Estate Commission of the State of California for such disciplinary action as may seem appro- priate, and may make any records available to the Commission as may relate to the matter notwithstanding any other action which the Real Estate Practices Commission may take or may already have taken; or (2) Refer the matter to the Office of Equal Opportunity (Housing Opportunity Division) for appropriate action pursuant to Title VIII of the Civil Rights Act of 1968 (the Fair Housing Law); or (3) Refer the entire file to the appropriate legal repre- sentative of the City of Lynwood for such action as it may deem proper or necessary in the circumstances, �. • • Section 3. The Bill will go to vote on the floor of the House on June 21. Telegrams have been sent under the Mayor's signature to all key Congressmen. NEW LIBRARY PROGRESS REPORT Attached is a letter from Arlyn Weber, Deputy to Supervisor Hahn, regarding the subject of our new Library. 'This office has been trying to commit them to a definite schedule and this letter is in response to that request. MONTGOMERY WARD PROGRESS REPORT In telephone conversation on June 16 with Bob Turner of Montgomery Ward, he indicated that all outstanding bids would be accepted the week of July 3. He stated that the major complicating factor at this point is the masonery strike. The Hod Carriers have settled, but it is un- determined when the masonery contractors will settle. He still main- tains that their construction schedule is such that they hope to complete the physical construction on January 1, 1972, with fixturization during January and February and opening in late February or early March. REAL ESTATE PRACTICES COMMISSION Attached is a letter from the Compton - Lynwood Board of Realtors re- commending certain realtors for appointment to this Commission. ORM DRAIN CONSTRUCTION -- ABBOTT ROAD The Mike Masanovich Construction Company has completed the lateral pipe installation for the storm drain work along Abbott Road. Mainline storm drain work is now progressing in the vicinity of Abbott and Otis. The City Public Works personnel are coordinating relocation work with the contractor. Overall progress is satisfactory. VIRGINIA AVENUE WATER INSTALLATION Due to an increasing number of water leaks from the steel water lines in the alleys in the vicinity of Virginia Avenue and Los Flores Boulevard, ' the Water. Division is currently supervising the installation of a small portion of a six inch line on Virginia from Los Flores Boulevard south. This installation will provide residents of Virginia Avenue with uninter- rupted water service. • • INFORMATION BULLETIN NO. 72 -11 June 20, 1972 Page 2 ABANDONED VEHICLE PROGRESS REPORT City Staff has now completed the removal of 411 abandoned vehicles from private property since the initiation of this program. The removal of these eyesores has made a significant difference in the overall appearance of the Community. HOUSE NUMBERS ON STREET CURBS Mr. Richard Chad of Residential Services has begun to paint house numbers on street curbs in the City of Lynwood. The paint he is using contains glass beads for greater reflectivity at night and as usual a minimum of a $2. 00 donation is being requested of the residents for this service. The City Engineer's office will monitor this project . as it progresses. TRAFFIC ANALYSIS OF ACCIDENT AT STATE AND FERNWOOD At the Council Meeting of June 7, the Council expressed concern re- garding a traffic accident occurring at the intersection of State Street and Fernwood Avenue. Engineering Staff has reviewed this accident and the facts are as follows: On June 5, 1972, at approximately 5:10PM a traffic accident occurred here involving four cars. Major damage was involved with the vehicles and injury occurred to a driver. From the physical evidence after the accident, and upon statements from various witnesses and drivers, it is the general conclusion that one single vehicle went west on Fernwood Avenue and failed to stop for a red light at State Street, thereby colliding with others and eventually ricbhetting and causing further damage to other vehicles. In addition, the officer who prepared the report indicated that it was in his opinion that this vehicle was travelling perhaps in excess of a speed of 35 miles per hour or 10 miles above the posted speed limit. LYNWOOD FOURTH OF JULY CELEBRATION Attached is a report from Don Snavely, Recreation and Parks Director, regarding the Fourth of July Celebration. QUACKING DUCKS Section 15. 25 (b) of Ordinance 570 prohibits quacking ducks. Therefore, the owner of ducks at 3909 Cortland Avenue was given notice to.remove the ducks by June 17. COST OF ABATING SUBSTANDARD DWELLINGS During the current 1971 -72 Fiscal Year the City has spent $3, 891 in the removal and clearance of unsafe and substandard dwellings as defined by the City Codes. INFORMATION BULLETIN NO, 72 -11 June 20, 1972 Page 3 PROPERTY AT 3517 IMPERIAL Councilman Stevens asked Staff to investigate the condition of the property at this address. Although the property is in need of maintenance, the dwelling itself appears sound. The vacant house is in an estaie administered by a local attorney and for sale through a local realtor. Immediate action will be taken to rid the property of weeds. PAINTING OF COMMUNITY CENTER BUILDING As part of an annual service project, the Lynwood Jaycees on Saturday, June 10, provided assistance with the painting of the Cummunity Service Building at Bullis Road and Century Boulevard, Public Works personnel had been doing preparatory work prior to this and have continued with the Civic Center vicinity buildings, such as the City Hall and Lynwood Medical Plaza. The Police building is also presently undergoing minor painting to match the City Hall and Community Service building. THE STREET LIGHTING PROGRESS REPORT Southern California Edison Company reports that Phase 1 of the Street Lighting Improvement Program is complete and all 85 lights have been installed. (H.R. 14370) On May 11 we sent you a bulletin indicating that Congressman Wilbur Mills' ' H.R. 14370, providing for $3.5 billion annual federal revenue sharing, was in need of your immediate support. It still is! H.R. 14370 was to have been ; considered on June 12 but will now be considered on June 21 and 22. The success of H.R. 14370 depends on its consideration under a "closed rule" and a "'waiver of points of order." A substantial number of the members of the California delegation will not support the closed rule and if the bill is subject to floor,, amendments, it will be in serious trouble. Postponement of floor consideration, of the bill was delayed in part by leadership discussion of an amendment which would reduce the present 5 -year appropriation to two years of advance funding. This would open the bill up to annual appropriations. f I As we have indicated earlier, H.R. 14370 will grant cities approximately $10 pier capita. It appears that the California Legislature is not going to do anything at the current session to assist cities in meeting their critical revenue needs. Unless California Congressmen hear from each city within their districts, the { chances are they will not support consideration of H.R. 14370 under a closed rule. Vote on final passage will not come unless the closed rule is first accepted. ; We respectfully urge all mayors to let their Congressmen know that enactment of the Mills' bill is important to their cities because it will permit cities to maintain an adequate level of municipal services and to reduce property ' taxes'. TAX SHELTERED EMPLOYEE RETIREMENT PLANS (H.R. 12272) I An important amendment is now being considered by the House Ways and Means Com -' mittee. H.R. 12272, authored by Congressman Wilbur Mills (D- Arkansas) and sponsored by the Nixon Administration, is now being heard in the House Ways and Means Committee. While the bill seems likely to pass, what is crucial right now is a proposed amendment concerning the extent an employee will be.allowed to j supplement his employer's retirement plan. I, 4 ; The current version of, H.R. 12272 allows an employee to set aside $1,500.00 (tax deferred) per year for'retirement benefits, but this amount would be reduced byl the annual sum of his employer's contribution to his retirement plan. " Our tally on final pas_ sage shows a substantial „ yes" vote.' Prince, City Manager: Lot Division A lot division was granted to Braymeld Inc„ to split. Lot. 121, Tract 2551. This lot split is necessary in order to develop a parcel of land at the southeast corner of Imperial Highway a:+nd Peach Sireel, The parcel is to be sold to Security Pacific Bank for their new facilities and is also across from the Muntg_,mery Ward project area. Lot Division Commission continued discussion of the lot division application received from Robert Compton. The Commission suggested. Mr. Compton apply for a variance to alter the lot lines on Lot 699, Traci 2992. Motion was made and approved to continue the lot split after application for variance is made by Mr. Compton„ School Property Purc hase Commission approved a request from the Lynwood Unified S -ohool District to acquire additional school property. The subject property is the old City Hall on Plaza Street„ which was previuusly approved for sale by the City Council. Home Rel Two separate home relocations were approved by the Planning Commission at 11154 Virginia Avenue and 11367 Wright Road, These homes will be relocated subject to Building Department code requirements. 0 • Disposition of Excess Property The State Division of Highways submitted several parcels of land which after freeway acquisition, the lots would be less than the required 6000 sq. ft, minimum. The Commission declared each lot with less than 6000 sq. ft, be purchased in full from the property owners and disposed on by the State as excess property. Organization of Pla Commission The Commission held an executive session to discuss Planning Commission personnel matters. Upon reopening the regular meeting the following recommendations were made by the Planning Commission to the City Council: 1. Recommend to City Council to Change Ordinance No. 728, Article IV, Section 2.84* that the Secretary of the Planning Commission shall be a designate of Council's choice omitting word "City Manager ". 2. That a salary be reinstituted for this proposed designated position. 3. That Mr. Melvin Rice be appointed for this position of Secretary to the Planning Commission. * Ordinance No. 728, Article IV. Composition and appointment of members, secretary The planning commission of the city hall consists of nine members, seven of whom shall be appointed by the city council, and one ex officio member, who shall, be the city engineer or his designated deputy, and one other ex officio member, who shall be the secretary of the commission, to be selected by the city council. Unit L12 took the alley entrance and the undersigned pulled up in front of 11110 Atlantic Ave. Upon determining that everything was Code It, the undersigned went back to his police unit, cleared the call, then checkldl the rear view mirror and observed a large Coca Cola truck parked approk mately one car space back, then proceeded to back up. After moving approximately 6 feet, the undersigned heard a noise and stopped his vehicle. Undersigned checked to the rear of his police unit and observed Vehicle /r2 on the ground; the front headlight was bent and right foot peg heel rubber cap torn loose. Officer J. I feel, due to the circumstances of my accident, that there was negligence on the part of the City' of Lynwood. I was leaving my place of employment, Western Gear Corporation, south on Franklin Street. As I was about to turn onto Lynwood Road, I became aware of water in the middle of the street. I slowed to allow for the wet surface. As I continued to complete my turn, I suddently realized that the pavement was not only wet but water was spouting out of a manhole cover. linable to slow the motorcycle any more, I lost control, turning the bike and myself down onto the ground. I was hurt very little. with a few minor scrapes and bruises. The damage done to the motorcycle., however, is a bit costly. I have enclosed two estimates of these damages. Mr. James Roy and Mr. Victor Krizan, two employees of Western Gear, did see part of the accident. The City of Lynwood has been working in this area off and on for the.past three months. 'I feel that the crew doing the work did not realize the danger involved when the water started continually flowing onto the street. The above accident was the result of this negligence. A caution .sign was not posted nor was there anything protecting the manhole while the water was flowing and city employees away from the area.
