Stevens Councilman Byork, Liewer, Rowe (1) Appointment of voting delegate and alternate for League of California Cities Annual Conference XIII PUBLIC BUSINESS FROM THE FLOOR XIV ADJOURNMENT Adjourn to Adjourned Regular Meeting of the City Council of the City of Lynwood to be held in the Council Chambers of City Hall at 7:OOPM on August 29, 1972. > kDJOURNED REGULAR MEETING A UGUST 9, 1972 The City Council of the City of Lynwood met in an adjourned regular session in the City Hall, 11330 Bullis Road, on above date at 4 30 p.m. Councilmen Liewer, Morris and Rowe answered the roll call. Councilmen Byork and S tevens were absent. The Mayor announced the purpose of the adjourned meeting to be to discuss the Long Beach Boulevard Project - Central Business District development. Planning Commission members Bowen, Herbold, Higgins and Discussion re Storms were present in adjourned session to take Long Beach Bl� part in the discussion. Bus. Dist. Pr( Mr. Bob Oliver and Mr. Bob McClelland addressed the Council to report on progress made since their last meeting with the Council on June 19, 1972, and Mr. McClelland presented plot plans for the area bounded by Peach Street, Long Beach Imperial Highway and Sanborn Avenue. Councilman Byork arrived. Vacation of Peach Street and widening of Long Beach Boulevard was discussed. In considering the time involved to commence the project, the Council was informed that a major factor is the widening of the boulevard which is dependent'on the County negotiating for acquisition of the necessary - parcels of property and completion of the engineering work. Mr. Oliver informed the Council that it is vitally important that the developer acquire the surplus property remaining from the widening project, either by purchase or lease from the city. The Public Works Director was questioned about the acquisition of right of way and he informed the Council that the County has indicated they are now in the process of completing their appraisal report. The matter will then go to the land management division to begin negotiations for acquisition of the property on the west side of Long Beach Boulevard. Following informal discussion of the project generally among members of the Council, the developers, and members ofl the Planning Commission present, the Mayor requested Mr. Wright to urge early action on the part o£ the County in their land acquisition activities, and the Council was assured that they would do so and that the city would proceed with the necessary engineering and continue to meet with Mr. Oliver: It was moved by Councilman Liewer, seconded by Council - I_. man Byork, and carried, that the meeting be adjourned to August 15, 1972, at 7 p.m. City Clerk, City of Lynwood APPROVED AUGUST 15, 1972 Mayor of the City o° Lynwood e August 15„ 1972 HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL SUBJECT: PUBLIC BEARING - 5507 CORTLAND AVENUE Gentlemen: At the meeting of July 18, 1972, the City Council ra_eived an abatement cost report for de., work completed at 5507 Cortland Avenue. PARTIES: This sublease made , 1972, 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 321 between the City of Lynwood, a municipal corporation hereinafter I referred to as "Sublessor," and International Qhurch of the Foursquare Gospel, a corporation, hereinafter referred to as "Sublessee." 2. RECITALS: Sublessor has entered into a written lease, dated January 28, 1970, with Southern Pacific Transportation Company, a corporation, hereinafter referred to as "Railroad," being Railroad's lease No. 162389, for certain portions of the railroad right of way owned by Railroad for parking lot purposes, hereinafter referred to as the Master Lease. Sublessor and Rail- road have also entered into a Supplemental Agreement dated , 1972, by which tfie area included in the aforesaid lease was expanded and-the rental obligation of Sublessor was increased. The purpose of said Master Lease is to make it possible for Sublessee to sublet from Sublessor said portions of said right of way to afford ample vehicle parking facilities for Sublessee's operations at 3655 Fernwood Avenue, Lynwood, California. The parties hereto have previously entered into a Sublease Agreement dated December 23, 1969, which agreement sublet the property leased to Sublessor'in the Master Lease. The parties intend that this Sublease Agreement supersede the Sublease Agreement of December 23,' 1969, in its entirety. a 3. TERM: Sublessor hereby subleases to Sublessee the premises of Railroad at or near Fernwood Avenue and Fir Street, City of Lynwood, State of California, shown on the print attached to the aforesaid Supplemental Agreement for the term of one year from the date of this agreement; provided, however, that each renewal of the Master Lease shall automatically constitute a re- newal of the sublease for the same term for which the Master Lease has been renewed. 4. INCORPORATION OF TERMS OF MASTER. LEASE: Sublessee shall be. bound by all of the covenants and conditions of the Master Lease and the Supplemental Agreement, except as to the amount of rent, and wherever in said Master Lease the word "Lessee" appears, the word "Sublessee" shall be substituted. 5. RENT: Sublessee agrees to pay to Sublessor rental at the annual rate of $1,500 which shall be payable in monthly 1 2 3'� 4 5 6 7 installments as follows: $125 on the 30th day following the date of the.execution.of this s.ublease,.and $.125 on the 30th day of each and every month thereafter during the term hereof. (c) Sublessee will promptly pay any judgment (against Sublessee covering such claims, damages, penalties, obligations or activities of Sublessee hereunder, and Sublessee l agrees to save and hold Sublessor harmless therefrom. (d) In the event Sublessor, without the fault Ithereo•f, is made,a. party to any action or proceeding filed or prosecuted against Sublessee for damages or other claims arising out of or in connection with the activities of Sublessee hereunder, Sublessee agrees to pay to Sublessor any and all costs and expenses incurred by Sublessor in any such action or proceeding, together with reasonable attorney's' fees. 8. INSURANCE: Sublessee shall provide before entering the premises, and shall maintain in force during the term of this sublease, comprehensive personal injury and property damage liability insurance, including automobiles, with minimum personal injury liability limits of $500,000 per person and $1,000,000 per occurrence and minimum property damage liability limits of $1,000,0 per occurrence and $1,000,000 aggregate. Each such policy of liability insurance shall contain the following special endorsement The City of Lynwood, its city council, officers, agents, and employees are hereby declared to be additional insureds under the terms of this policy, both as to the activities of Inter- national Church of the Foursquare Gospel and as to the activities of the City of Lynwood as related to the activities of International Church of the Foursquare Gospel described herein. This policy will not be cancelled, nor the coverage theraof reduced, without three days' prior written notice to the City of Lynwood. The City of Lynwood is not liable for the payment of premiums or assessments on this policy. No cancellation provision in any insurance policy shall be construed in derogation of the continuous duty of Sublessee to furnish insurance during the term of this Sublease. Said policy or policies shall be underwritten to the satisfaction of the City of Lynwood. A signed complete certificate of insurance, with all endorsements required by this paragraph, shall be submitted to Sublessor concurrently with the execution of this permit. At least 30 days prior to the expiration of anv such policy, a signed complete certificate of insurance, with all endorsements required by this paragraph, shall mean that such insurance coverage has been renewed or extended shall be, filed with Sublessor. 9. NOTICE: Any notice'to be given by Sublessor to Sub- lessee hereunder shall be deemed to be properly served if delivered to Sublessee, or if deposited in the post office, postpaid, addressed to Sublessee at the leased premises or to last known address. 10. TIME OF ESSENCE: Time and specific performance are each of the essence of this sublease. 11. SUCCESSORS: This sublease shall inure to the benefi� of the successors and assigns of the parties hereto, but shall not be assicned or subleased by Sublessee without the prior written consent of Sublessor. 12. CANCELLATION OF PREVIOUS SUBLEASE: That certain Sublease Agreement dated December 23, 1969, between the parties hereto is, by the mutual agreement of said parties, cancelled in its entirety. PUBLIC WORKS LEADMAN Gentlemen; At the meeting of July 18, 1972, the Personnel Commission reviewed a proposal to amend the salary resolution by deleting special assignment compensation for the position of Water Leadman and creating this compensation for Public Works Leadman. Compensation is currently provided in the amount of $50 per month during such time as when a Utility Maintenance Man is required to fill a supervisory position in the water division. It is proposed that this Water Leadman be modified to Public Works Leadman in order to encompass the entire Public Works Department, From time to time throughout the department, specific instances do occur whereby an employee is required to hold supervisory responsibilities for a crew of. four to eight employees. With the expanded title, the City would be able to properly compensate such an employee during the time he is maintaining these responsibilities. BRADFIELD IS AN OFFSET INTERSECTION WHICH IS ADJACENT TO THE EAST BOUNDRY OF THE LYNWOOD HIGH SCHOOL FOOTBALL FIELD. AT THE PRESENT TIME, BOULEVARD STOPS EXIST ON BRADFIELD AT BOTH THE NORTH AND SOUTH APPROACHES TO CARLIN AVENUE. ALTHOUGH CARLIN AVENUE IS AN EXCEPTIONALLY WIDE STREET, IT IS PRIMARILY A RESIDENTIAL STREET AND 15 50 POSTED AT 25 MILES PER HOUR. SINCE MAY OF 1967, THERE HAVE BEEN 33 ACCIDENTS ON CARLIN BETWEEN THORSON AND BULLIS RD. TEN HAVE BEEN AT THE INTERSECTION OF BULLIS AND CARLIN AND SIX AT THE INTERSECTION OF THORSON AND CARLIN. NINE OF THE 32, OR 28.12% HAVE BEEN WITH INJURIES, INCLUDING ONE FATALITY. FIVE ACCIDENTS HAVE OCCURRED AT BRADFIELD AND CARLIN ONE IN 1970, ONE IN 1971 AND THREE IN 1972). THREE OF THE FIVE, OR 60% WERE WITH INJURIES, ONE OF WHICH WAS A FATALITY. THE THREE RECENT ACCIDENTS INVOLVED A 91 YEAR OLD MALE DRIVER WHOSE PASSENGER IN AN ELECTRIC CAR WAS KILLED, AN 18 YEAR OLD MALE DRIVER RUNNING A BOULEVARD STOP AND HITTING A TREE, AND AN 80 MILES PER HOUR HEAD -ON CRASH THAT INJURED FOUR. CONTROLS WERE IN PLACE FOR TWO OF THESE ACCIDENTS. HOWEVER, IN THE THIRD INSTANCE, CON- TROLS WOULD HAVE BEEN TO NO AVAIL. District No. 1 shall include all commercial and industrial areas as from time to time are zoned P• -1, CB -1, C -2, C -2 -A, C -3, M -1 and M -2, pursuant to the Zoning Ordinance of the City. District No. 2 shall include the rest and remainder of the City. Section 3. 7 to 3.11 and Sections 3.13 to 3. 16 control all advertising media in District No. 1. No signs shall be permitted in District No. 2 except one (1) unlighted sign not exceeding three (3) square feet in size, plus one attached rider of no more than 4 by 16 inches in size and one "open house" rider as otherwise permitted herein, and containing advertising on one side only regarding the sale, lease, or rental of the building and/ or premises upon which it is displayed, and the name, address, and telephone number of the owner and /or duly authorized agent for such owner. Such sign shall be no more than 48 inches in total height above ground, placed on a single supporting pole or bracket, located parallel to the sidewalk in front of the house or lot, and shall be set back not less than fifteen (15) feet from the sidewalk; provided, however, ORDINANCE NO. 909 Page 2 where the set -back line on a particular parcel is less than 20 feet from the sidewalk, the sign may be located not more than five (5) feet in front of such set -back line; and provided further, that when a sign at such location is obscured from view from the street by landscaping or shrubbery, such sign may be placed directly in front of such landscaping or shrubbery. Such advertising sign shall be removed from the property on the date said property enters escrow, or execution of a contract of sale, whichever is first to occur.. One (1) "open house" rider not exceeding two (2) square feet in size may be attached to any such sign or supporting post or bracket and two (2) flags shall be permitted on each lot or parcel located at least 10 feet behind the curb line and shall be permitted on each lot or parcel for a period not exceeding more than 12 hours per week. The previsions of this section shall be applicable to all property within District -No. 2, notwithstanding any provision of the Zoning Ordinance of the City of Lynwood to the contrary. OF THE CITY OF LYNWOOD HEREBY DOES ORDAIN AS FOLLOWS: SECTION 1: Section 20 City of Lynwood to read as follows 73 A is added to the City Code of the Section 20. 73 A Realtors (a) For the purposes of this section a person shall be considered to be engaged in the real estate profession if he, for a compensation or in expectation of a compensation, does or negotiates to do one or more of the following acts for another or others: (i) Sells or offers to sell, buys or offers to buy, solicits prospective sellers or purchasers of, solicits or obtains listings of, or negotiates the purchase, sale or exchange of real property. (ii) Leases or rents or offers to lease or rent, or negotiates sale, purchase or exchanges of leases on real property, or collects rents from real property, or improvements thereon. However, the provisions of this subsection do not apply to the manager of a hotel, motel, auto and trailer parks, to the resident manager of an apartment building, apartment complex, court, or to the employees of such manager, (iii) Assists or offers to assist in filing an application for the purchase or lease of, or in locating or enter- ing upon, lands owned by the State or Federal Govern- ment. (iv) Solicits borrowers or lenders for or negotiates loans or collects payments or perform services for the borrowers or lenders or note owners in connection with loans secured directly or collaterally by liens on real property. (v) Sells or offers to sell, buys or offers to buy, or exchanges or offers to exchange a real property sales contract, or a promissory note secured directly or collaterally by a lien on real property and per- forms services for the holders thereof. SECTION 2; It is the intention of the City Council that the license fees set forth in the aforesaid Section 20, 73 A shall supersede any other license fees contained in the City of Lynwood which would otherwise apply to persons engaged in a real estate profession for the privilege of participating in that profession. CITY MANAGER REVENUE SHARING PROGRESS REPORT • The Revenue Sharing proposal passed a major hurdle on Thursday, August 10, when it was passed out of the Senate Finance Committee and onto the floor of the Senate. According to representatives from Congressman Glenn Ander- son's office, vote from the Senate is not expected until after the Republican Convention with final passage in September. The Senate version of this Bit! provides for approximately 100 million dollars less than the House version for California cities; however, no specifics as to individual allocations to each City are available, Once the Senate version is passed, the Bill will go to the Joint Senate -House Committee for final review and consideration, It is the opinion of Congressman Anderson's office that the final joint committee Bill will be very similar to the House version and they are ex- tremely confident that Revenue Sharing wilt pass during this legislative session, 1972 - -73 OPE BUDGE -- TAX RATE The Office has recently completed review and received recommended modi- fications to the 1972 -73 Annual Operating Budget from the City Clerk's office and re- typing and collating is now underway. The entire document should be ready for Council review by Monday, August 21, 1972, and it is proposed that the Council set a meeting for Monday, August 28, 1972, in order to complete final review and adoption of the Budget documents as well as review of the Revenue Sharing proposals to date which will enable the Council to establish a tax rate for the coming Fiscal Year, As you know, the tax rate must be set by August 31, 1972, PO LICE' OF FICER' D EATH The office has learned that after undergoing surgery for an injured hand Police Officer Stanley E, Pate, suffered a massive heart attack and died, Officer Pate had come to the City as a lateral transfer from the Compton Police Department and had been with the department since November 1, 1970 POLICE BUILDING PROGRESS REPOR The Office has been in contact with Dick Omert, architect of this project and a meeting has again been scheduled during the week of August 14, 1972, in order to determine the next procedural step for the Council to take in order to initiate this project. During the month of July„ ,1971, overtime in the uniform division totalled 478 3 /4 hours. During the same month in t 1972, under the P , an, overtime totalled 170 hours -- a reduction of 62. 16% in total overtime costs to the City. A review of the sick leave taken during these same periods reveals that 32 eight-hour days were taken for sick leave during the 'm ' onth of July, 1971, and a total 11 ten-hour days were taken for ' sick leave during July of 1972. This revealed a total reduction in sick leave of 65. 6216. Contractors. The latest informa- tion from the County Road Department, who will handle this contract, will be a delay of 30 days due to a material approval requirement. It is expected, however, the improvement will be nearing completion in the coming months. ENFORCEMENT OF THE REAL ESTATE SIGN ORDINANCE The City Staff has continued to survey all possible violations as they relate to the City's Real Estate Sign Ordinance. Approximately 70% of the entire residential districts have been surveyed. The latest survey resulted with Staff calling by telephone approximately eight realtors in the local area and notifying them of their violations. The Code Enforcement Officer has continued citing those realtors which have not complied and has recently given three citations to the following realtors: Alberta Storms, Ken Porter, and Edith Wren. These charges have since been dropped due to compliance, Surveys have also been performed during Sunday with Staff members notify- ing the realtors personally of any possible violations such as open house signs or flags in the public parkways.
