Home My Public Portal AboutAddendum No. 1 to Contract No. 68-2016 - Metro - Mikesell Excavatin - DemolitionW ADDENDUM THIS ADDENDUM, (Nmber 1 to Contract No. 68-2016) is made and entered into this a� day of �fj/ 2016, by and between Richmond, Indiana, a municipal corporation acting througlf its Board of Public Works and Safety with its office at 50 North 5th Street, Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Mikesell Excavating, Inc., 652 New Garden Road, New Paris, Ohio, 45347 (hereinafter referred to as "Contractor"). WHEREAS, City and Contractor entered into Contract No. 68-2016 on July 7, 2016, which Agreement retains Contractor to provide services in connection with demolition of certain properties for the City's Blight Elimination Program ("BEP" per Indiana Housing and Community Development ("IHCDA") Guidelines; and WHEREAS, The parties to said Agreement wish to add an additional property (bid out as Round 1, Bid 4, Group 17) located at 1530 Oakland Avenue in Richmond, Indiana, to said �emen— t nder the same terms an con itions as set forth in Contract No. 68- 2016. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows: 1. The City and Contractor executed and entered into Contract No. 68-2016, on July 7, 2016. Pursuant to Contract No. 68-2016, Section XII Miscellaneous, the Agreement may be altered or amended in whole or in part at any time by filing with the Agreement a written instrument setting forth such changes signed by both parties. As set forth above and as set forth on Contractor's quote, attached as Exhibit A to this Addendum, services in connection with the abatement of the additional properties located at 1530 Oakland Avenue, Richmond, Indiana (bid out as Round 1, Bid 4, Group 17), shall be provided as set forth within Contract No. 68-2016. Such services shall be performed in a manner consistent with Contract No. 68-2016. 2. Section III Compensation of said Agreement shall be altered in order that City shall pay Contractor an additional amount of Six Thousand Dollars and Zero Cents ($6,000.00) for the additional services, with said final contract amount to be increased to a total amount not to exceed One Hundred Eleven Thousand Four Hundred Dollars and Zero Cents ($111,400.00). 3. City and Contractor expressly agree that all other terms, conditions, and covenants contained in Contract No. 68-2016, shall be applicable to the work performed pursuant to this Addendum, unless such term, condition or covenant conflicts with this Addendum Number 1, in which case this Addendum Number 1 shall be controlling. Both parties hereby agree that with the exception of the additional property abatement services to be provided and increased contract amount, Contract No. 68-2016 shall remain intact and unchanged and in full force and effect. Both parties agree that any person executing this Contract in a representative capacity hereby warrants that he or she has been duly authorized by his or her principal to execute this Addendum.
