There being no further business to conduct the motion was made and seconded to adjourn
to March 19, 1987 All in favor. Motion carried.

SUBJECT: RECRUITMENT FOR ECONOMIC DEVELOPMENT SPECIALIST
The position of Economic Development Specialist is presently vacant
as result of Ida Ruiz' resignation effective March 6, 1987. Three (3)
City staff members have expressed interest in applying for the position.
I have reviewed their professional backgrounds and I have found they all
meet the minimum qualifications of the position concerning education,
training and job - related experience. Therefore, in order to expedite
the filling of the position and allow qualified staff to further their
professional development goals and desires within the system, I would
like to request that a closed promotional recruitment be conducted to
fill said position. My request complies with the existing provisions
of the City's Personnel Policies and Procedures.

SUBJECT: RECRUITMENT - ECONOMIC DEVELOPMENT SPECIALIST
OBJECTIVE
To have the Personnel Board consider a closed promotional exam for the position
of Economic Development Specialist.
FACTS
* The Director of Community Development has requested that a closed promotional
exam be conducted for the position of Economic Development Specialist.
* Staff has identified three current members of the City workforce who qualify
and have expressed interest in the position. The past practice of the Per-
sonnel Department has been to consider closed promotional examinations in
such cases
* Rule VII, Section 2 of the Personnel Rules and Regulations bestows upon the
Personnel Board the authority to direct that a closed promotional exam be
conducted
ANALYSIS
Staff is of the opinion that a closed promotional exam for the position of
Economic Development Specialist will allow us to expedite the process of filling
the vacancy and also allow in -house staff an opportunity for career advancement.
Should the Board wish to examine the qualifications of the three in -house candi-
dates, staff would recommend that a closed session be held.

It has come to my attention that the Personnel Commission'
met on March 19, 1987 and discussed and passed an extension
on the lateral list for Fire Fighter. ,
The agenda that I received on March 18, 1987 regarding the.
Personnel Board for the City of Lynwood was devoid of any
mention as to the Fire Fighter issue nor was I given an
amended agenda.
A check of some of the newspapers reveal that they were
not given amended agendas either. Therefore I feel Section
54950 thru.54961 of the Brown Act were violated.and I am
demanding the Personnel Board and the City of correct
its actions as soon as possible.

.' Re: Violation of the Brown Act', So`vt Code Section 54950 -54961
I have been notified that the Personnel Commission met on
March:I9, 1987 and extended the expiration date on the lateral -
list for the Lynwood Fire Fighters..
The agenda that I received on March 18, 1987 regarding the
Personnel Commission for the city did not refer to the lateral
list and I was never given an amended agenda.
According to Sec. 54956 of the Brown Act, the legislative
body must provide advance notice of a special meeting to each
member of the legislative body and to each local newspaper at
least 24 hours before the time of the meeting.
' This is a written demand to inform the Personnel Commission
that a violvation of the Brown Act has occurred and I am requesting
' -this legilative body to "cure or correct" its actions.

Re Violation of Government Code Sections 54950 - 54961, The Brown Act.
By the Personnel Commissioners and City of Lynwood in meeting of
March 19, 1987.
This letter is written in accordance with Section 54956.1 of
the Government Code, better known as The Brown Act was noted
when actions taken on the extension of a lateral hiring list
for the Fire Department which was not legally posted or dis—
seminated to the public, members of the Personnel Commission,
or newspapers as required by law.
This fetter is a demand for the City Of Lynwood and the Per —..
sonnel Board and Commissioners to correct or cure the viola—
tion described above, and to refrain from such actions in
future meetings.
