HomeMy Public PortalAbout059-1980 - Amending Ord No 93-1979 - Authorizing Special Use - 620 Nationa Rd WestSPECIAL ORDINANCE NO. 59-1980 AN ORDINANCE ANEDING ORDINANCE NO. 93-1979 AND AU HORIZ12U A SPECIAL USE IN A R-2 SINGES FAMILY RESIDENCE DISTRICT FOR A MEDICAL OFFICE ON PROPERTY LOCATED AT 620 NATIONAL ROAD WEST, FURS= TO ARTICLE 48 OF CHAPTER 22 OF THE MUNICIPAL CODE CONMDNLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHM0ND, INDIANA, ADOPTED JUNE 3, 1968. WHEREAS, it is the intent of this Ordinance to amend Ordinance No. 93- 1979 by rescinding the Special Use granted at 624 National Road West for a medical office and relocate said medical office at 620 National Road West; and, WHEREAS, Article 21 of Chapter 22 of the Municipal Code allows medical offices by Special Use authorization as provided in Article 48 of said Chapter; and, WHEREAS, a notice was given and a public hearing on this Ordinance was conducted by the Richmond City Planning Commission the 24th day of Jame, 1980, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Planning Commission was nine (9) to zero (0) in favor of recommending the passage of Ordinance No. 59-1980; therefore, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana., as follows: SECTION 1. That Ordinance No. 93-1979 is hereby amended by rescinding the Special Use granted for a medical office at 624 National Road West. SECTION 2. As provided in Article 21 of Chapter 22 of the Municipal Code the following described use of the following described real estate is allowed as a Special Use for a medical office at 620 National Road West in the City of Richmond, Indiana; more particularly described as follows: A part of Outlot Number 1, as laid out by the Trustees of the Indiana Yearly Meeting of the Religious Society of Friends in the northeast quarter of Section 6, Township 13 North, Range 1 West, now a part of the City of Richmond, Wayne County, Indiana., and bounded as follows, to -wit: Begi ing at a point two hundred two (202.00) feet south and one hundred three and 25/100 (103.25) feet east of the northmaest corner of said out - lot (which point is 202.00 feet south of the south line of Southwest "A" Street and 95.25 feet east of the east line of Southwest Seventh Street, due to the widening by 8.00 feet of said Southwest Seventh Street on the east side thereof) at the northeast corner of a part of said outlot deeded to Frederick C. Fulgum by Harry R. Robinson. and wife by deed dated April 11, 1902, as appears in Deed Record 117, page 326 of said County, and running thence east, parallel to the north line of said outlot, (which is along the south line of a Public Alley) sixty (60.00) feet, thence south parallel to the west line of said outlot, one hundred eighty-seven and 67/100 (187.67) feet, more or less, to the north line of the National Read, thence south - westwardly along the north line of the National Road, sixty and 52/100 (60.52) feet, more or less, to the southeast corner of said part of said outlot deeded by said Robinson to said Fulgum, which point is the intersection of the north line of the National Road with a line parallel to and ninety-five and 25/100 (95.25) feet east of the east line of Southwest Seventh Street, thence north, along the east line of said pant of said outlot conveyed to said Fulgum, one hundred ninety-six and 4/100 (196.04) feet, more or less, to the place of begiYming. ORDINANCE NO. 59-1980 Page 2 ALSO, a part of outlot number 1, as laid out by the Trustees of the Indiana Yearly Meeting of the Religious Society of Friends in the northeast quarter of Section 6, Township 13 North, Range 1 West, naw a part of the City of Richmond, Wayne County, State of Indiana, and bounded as follows, to wit: Beginning at a point one hundred forty-three and 50/.100 (143.50) feet south of the north line of said outlot (which is the south line of Southwest "A' Street) and one hundred sixty- three and 25/100 (163.25) feet east of the west line of said outlot (being one hundred fifty-five and 25/100 (155.25) feet east of the east line of Southwest Seventh Street due to said Seventh Street having been widened eight (8.00) feet on the east side) said point being at the intersection of the south line of a fifteen (15.00) foot Public Alley and the east line of a ten (10.00) foot Public Alley, said Alleys being estab- lished as indicated in Plat Book 4, page 126, in the Office of the Recorder of said County, and running thence east, along the south line of said Public Alley which is parallel to the north line of said outlot, forty-six and 75/100 (46.75) feet, thence south parallel to the west line of said outlot, two hundred thirty-nine and 65/100 (239.65) feet, more or less; to the north line of the National Road, thence southwestwardly along the north line of the National Road forty-seven and 16/100 (47.16) feet, more or less to the intersection of the north line of the National Road with a line parallel to and one hundred fifty-five and 25/100 (155.25) feet east of the east line of Southwest Seventh Street, thence north parallel with the west line of said outlot, two hundred forty-six and 17/100 (246.17) feet, more or less, to the place of beginning. SECTION 3. As a condition of the aforesaid Special Use and as an addi- tional restriction on said use, the following requirements shall hereafter and at all times be met by the owner, leasee or any person, firm or corporation using said real estate. a. The site plan accompanying the petition be identified as Exhibit "A' and made a part of Ordinance No. 59-1980. b. The Special Use authorization shall be considered null and void should the Special Use cease for a period of one (1) year or more. c. The off-street parking area as designated on the site plan accompanying the petition shall be paved within twelve (12) months of the effective date of this Ordinance. SECTION 4. The Zoning Administrator of the City of Richmond, Indiana, is hereby authorized and directed, upon enactment and publication of this Ordinance, to record and approve the issuance of a per- mit for the establishment of the use herein allowed. SECTION 5. This Ordinance shall be in full force and effect from and after its passage and approval by the Mayor, and publication as by law required.
