AN ORDINANCE ANNEXM CERTAIN TERRITORY PLATTED AND UNPLAT M, LEGALLY
DESCRIBING THE AREA TO BE AID, PROVIDING FOR THE PUBLICATION THERE-
OF, AND FIXIIIG THE TIME M-UN THE ANION MAIL . TAKE. EFFECT .
WHEREAS, I.C. 18-5-10-25 permits cities of the second class to annex
territories which are one -eighth (1/8th) contiguous to
corporate limits and are sixty percent (607.) or more sub-
divided. and,
WHEREAS, the City has adopted a policy on annexation and has prepared
a written fiscal plan demonstrating the time frame for deli-
very of services, the services to be provided and the manner
of funding for such services; and,
WHEREAS, the City has adopted Resolution No. 5-1980, setting forth the
guidelines to be utilized in determining what unincorporated
areas may be annexed; and,
WHEREAS, a written fiscal plan has been adopted through Resolution of
the Board of Public Works and Safety; and,
WHEREAS, the Richmond City Plan Commission held a public hearing on the
day of , 1980, and voted
to in favor of in opposition to reconmending passage
of this Ordinance to Conlon Council.
NOW THEREFORE BE IT ORDAINED by the Comm Council of the City of Rich-
mond, Wayne County, Indiana.:
SECTION 1. That the following described territory, adjacent to the
corporate boundaries of the City of Richmond, be annexed to and
hereby is declared to be a part of the said City of Richmond,
Indiana; said territory being located in Wayne Township, Wayne
County, State of Indiana., and more particularly described as
follows:
Being a part of Fractional Section Twenty -Two (22), Township
Sixteen (16) North, Range Fourteen (14) East, in Center
Township, and part of Fractional Section One (1), Township
Thirteen (13) North, Range Two (2) West in Wayne Township,
both townships being in Wayne County, Indiana..
Beginning at the centerline intersections of College Corner
Road and Salisbury Road and in the present west corporation
line of the City of Richmond, Indiana, and running thence
southward along the centerline of Salisbury Road and said
corporation line to the northeast corner of K-Mart Corpora-
tion property; thence south eighty-nine (89) degrees and
fifty-eight (58) minutes west along the said corporation line
eleven hundred forty-three and ninety-one hundredths (1143.91)
feet; thence south two (02) degrees and twenty-three minutes
(23) east along said corporation line eight hundred thirty-five
and thirty-seven hundredths (835.37) feet to the centerline of
U.S. Highway JX0; thence westwardly along the centerline of
said highway to the centerline intersections of U.S. Highway
#40 and Round Barn Road; thence northward along the centerline
of Round Barn Road to the centerline intersections of Round
Barn Road and College Corner Road; thence eastward along the
centerline of College Corner Road to the place of beginning,
containing an area three hundred thirty-two and three hundred
and eighty-five thousandths (332.385) acres, more or less.
SUBJECT' TO: The right of way -of -all legal highways and ease-
ments of record.
SECTION 2. This Ordinance shall.be in full force and effect sixty (60)
days after its passage and approval by the Mayor and publication
as by law required.
