SPECIAL ORDINANCE NO. 73-1980
AN ORDINANCE AUTHORIZING A SPECIAL USE IN A R-2 SINGLE-FAMILY RESIDENCE
DISTRICT FOR A NURSING HOME ON PROPERTY LOCATED AT 1811 AND 1813 SOUTH
NINTH STREET, PURSUANT TO ARTICLES 48 AND 20.017 OF CHAPTER 22 OF THE
MUNICIPAL CODE SLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
RICIkUND, INDIANA,
WHEREAS, Article 20.017 of Chapter 22 of the Municipal Code allows
nursing homes by Special Use authorization as provided in
Article 48 of said Chapter; and,
WHEREAS, a notice was given and a public hearing on this Ordinance was
conducted by the Richmond City Planning Commission the 26th
day of August, 1980, at which time remonstrances were heard
from all parties interested in or affected by this Ordinance;
and,
WHEREAS, the vote of the Richmond City Planning Commission was ten (10)
to zero (0) in favor of recommending the passage of Ordinance
No. 73-1980.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Rich-
mond, Indiana., as follows:
SECTION 1. As provided in Article 20.017 of Chapter 22 of the Municipal
Code, the following described use of the following described
real estate is allowed as a Special Use for a nursing home at
1811 and 1813 South Ninth Street in the City of Richmond,
Indiana; more particularly described; to wit:
A part of the Southwest Quarter of Section Nine (9), Township
Thirteen (13), Range One (1) West in Ridmoond, Wayne County,
Indiana. and being more particularly described as follows:
Commencing at a point one thousand forty-two and eight tenths
(1,042.8) feet south and thirty-six (36) feet east of the
northwest corner of the Southwest Quarter in the east line
of South Ninth Street in said City; thence eastthree hundred
(300) feet; thence north, parallel with the east line of said
South Ninth Street, two hundred (200) feet; thence west parallel
with the south line of said described lot, three hundred (300)
feet to a point in the east line of South Ninth Street; thence
south along said east line of South Ninth Street, two hundred
(200) feet to the place of beginning, containing one and three
hundred seventy-seven thousandths (1.377) acres, more or less.
SECTION 2. As a condition of the aforesaid Special Use and as an addi-
tional restriction on said use, the following requirements shall
hereafter and at all times be met by the owner, leasee or any
person, firm or corporation using said real estate.
a. The site plan accompanying the petition be identified as
Exhibit "A, and made a part of Ordinance No. 73-1980.
b. As a condition of being granted the Special Use and prior
to the issuance of an Improvement location Permit, a de-
tailed site drainage plan shall be prepared and submitted
to the City Engineer for approvals
c. All existing and proposed accessory off-street parking
facilities shall be paved and developed in accordance
with the requirements and standards of Article 41 of the
Zoning Ordinance.
