Winter reported documents are in order and provided information from the Sheriffs Dept. on four reports regarding this business. The Construction Team for the Safe4vay project would like to request a variance of the Town's street cut policy in order to complete o'ur sanitary sewer installation. In addition, we would like to formally outline and present a schedule for • the site work aspects of the project that will be completed prior to requesting a Temporary Certificate of Occupancy (TCO), and those items that will be completed after TCO for weather related reasons. MacGregor Wathen Construction Company {-M~~ has completed the majority of the utility work for this project. The sanitary sewer from the manhole located irx County Road 804, just north of the Fraser River crossing, aczoss the river into the Safeway site must be completed. The existing manhole is located four feet from the eastern edge of pavement, therefore only a sanall portion of County Road 804 would be cut at this time. In order to complete this task, MW will have to redirect traffic on Couz-ty Road 804 for a period of one to two days. It is our request that MW be allowed to complete this `vark on January 25 and 26, 1998. MW would limit the hours of construction on County Road 804 from 9:15 A.M. to 3:15 P.M. There is a possibility that this work could be completed in one day, but it is likely to take two days to complete the portion of work that requires a cut of County Road 804. In addition, the enlargement of the easternmost traffic island at the County Road 804 and Highway 40 intersection requires MW to sawcut the oxisting roadway. This technically requires a street cut permit as well. Tl,e demolition of the existing island and placement of concrete for tl1e new island will occur from approximately February 2 through February 16, 1999 Th1s phase of construction should not impact traffic flows. In addition, with this letter we would l,ke to present the construction schedule provided to Safeway by MW outlinl.ng the timeframe required by the contractor to complete this project. • The Construction Team understands the Town's frustration over the delays in completing the public improvements portions of this project. It is our intent with this letter to work with the YIr. Chuck Reid • January 15, 1999 Page 2 Town to determine the most appropriate means of assuring that this project is completed based on MTV's schedule. As discussed during the January 11, 1999 Constntetion Team meeting with you in attendance, it is understood by the Safeway Construction Tcam that the following aspects of construction are of primary importance to the Town of Fraser. 1. Completion of the retaining wall on County Road 804 near the bus turnout area. NIW proposes to complete this work from January 18 through February 4, 1999. • 2. Completion of the easternmost traffic island at the County Road 804 and Highway 40 intersection. As discussed previously, MW proposes to complete this item from February 2 through February 16, 1999. 3. Completion of the traffic island at the entrance to the Safeway site. MW proposes to complete this work from Macch 7 through March 24, 1999. 4. Completion of the grading, retaining wall, and rip rap along the Fraser River. :VI~V' praposes to complete tk~e retaining wall at the east ezad of the site from February 4 through February 20, 1999 and the grading and rip rap placement around the east and north sides of the store from March 4 through March 24, 1999. The Construction Team cannot accept these dates and will work with MW to complete this work in a more timely manner. 5. Placement of geotextile fabric in stormwater quality ponds. IVI1~V proposes to install the geotextile fabric from January 14 through February 23, 1999. The Safeway Construction Team acknowledges that you have requested that you be notified to inspect this installation. 6. Completion of the FEMA Certification and Letter of Map Revision (LO_'VIR) Request. Once MW completes item 4, above, Galloway, Romero & Associates (GRA) will order as-built surveys. Qnce GRA receives the as-built survey, we will complete the certification and LOMR request within ten tivorking days. The certification and LO'VIR request will be submitted to the Town, the Colorado Water Conservation Board, and FEMA for review. Review and approval is anticipated to take three months £xotn submittal. 7. Traffic signal. installation. The traffic signal is scheduled to be on site around mid- March. It will take approximately one week to install the signal and based on discussions with you, one week of flashing lights to make the public aware of the signal. It is anticipated that the signal ~uvill be fully operativnaI on April I, 1999. MW v~zll complete ail of the above items and tl~.ose outlined in the attached schedules prior to Safeway requesting a TCQ for the store. Several items •~~ill have to be bonded over and completed after the opening oFthe store. These include: • 1. Final site landscapinb and seeding. These items will be designed by GRA, submitted to the Town artd the Town's Engineer for approval and constructed prior to TCS. ?. Final overlay and striping on County Road 804. As discussed previously, the final overlay for County Road 804 must «ait until the weather is suitable for laying asphalt. All potholes asphalt damaged by construction will be removed acid the sub-base .repaired prior to the placement of the final overlay. Members of the Safeway Construction Team, as well as Lon Kersting, of MW will be in attendance at the Town's January 20, 1999 Town Council meeting. The members of our Construction Team and MW will be available for questions by the Council. It would be our intent to have the issues described in this letter with respect to waiving the Town's street cut requirements and TCO conditions be approved by the Town Council at that time. CLAYTON and ELSIE J. CLAYTON ("Developers"), and the TOWN OF ERASER, by its Board of Trustees ("Fraser").; WITNESSETH: . WHEREAS, Developers previously platted a tract of land into a subdivision known as a Resubdivision of Tracts B and C of Clayton Subdivision (the "Subdivision"), according to the Correction Plat recorded at Reception No. 291300 of the records in the office of the Clerk and Recorder of Grand County, Colorado; and WHEREAS, Developers executed a Subdivision Improvement Agr.;,~...ent, dated September 19, 1990 (the "Improvement Agr:,:,...ent"), to guarantee the construction or installation of required improvements for such Subdivision in accordance with the Fraser Subdivision Regulations, and a copy. of such Improvement Agreement was recorded in Book 460 • at Page 674 of said records of the Grand County Clerk and Recorder; and WHEREAS, the Developers have proposed to resubdivide a portion of such subdivision, to be known as a Resubdivision of Tract B of a Resubdivision of Tracts B and C of Clayton Subdivision (the "Resubdivision"), which will result in a modification of the required improvements applicable to the Subdivision as a whole; and WI~REAS, the Developers and Fraser have agreed to amend the Improvement Agreement, as provided herein, to account for such changes in the required subdivision improvemens and to modify certain other provisions of said L...r.avement Agreement; and WHEREAS, this Agreement and the amendments to the Improvement Agreement provided herein are intended to comply with the requirements of the Fraser Subdivision Regulations with respect to the Developers' guarantee of the required improvements for both the original Subdivision and the Resubdivision. NOW THEREFORE, in consideration of the premises, the parties hereto agree as follows: (1) Fraser agrees that upon compliance with all other conditions of approval, the Plat for the Resubdivision shall be promptly recorded in the office of the Grand County Clerk and Recorder. • • (2) The Resubdivision will result in the elimination of part of the street known as Clayton Avenue, from the East boundary of Tract C to County Road 804, which would have provided a secondary means of access to the Subdivision. The parties agree that no such secondary access to the Subdivision shall be required at this time. Fraser will subsequently construct a secondary access between the northerly end of Clayton Court and Fraser Avenue, through the property known as the "Williams Parcel", at such time as the Town decides that such secondary access is deemed necessary or desirable. (3) As a consequence of the Resubdivision, the following subdivision improvements will no longer be required and are deleted from the Improvement Agr,;,;;...ent: (a) Road construction and paving of Clayton Avenue, between Clayton Court and County Road 804; and (b) Installation of the water main in Clayton Avenue, between Clayton Court and County Road 804. Fraser may subseque~ly construct the road and/or water main within the remaining part of Clayton Avenue, between Clayton Court and Amended Lot B2/B4 of the Resubdivision, which Fraser now owns, if required for access and/or water service for such Lot B2/B4. Such construction shall be at Fraser's sole option and expense. • (4) Fraser has r. ~ piously completed the following subdivision improvements, which were provided for under the terms of Improvement Agreement: (a) Road construction, with gravel surfacing, for the entire length of Clayton Court; (b) Road construction and paving of Clayton Avenue, between Clayton Court and Highway 40; and (c) Installation of water mains in Clayton Court, from fire hydrant to Clayton Avenue. (5) The following subdivision improvements remain to be completed: (a) Installation of water main in Clayton Court, from fire hydrant to Lot 1; (b) Installation of water main loop, from Lot 1 to Fraser/Doc Susie Avenue; and (c) Paving of Clayton Court. • -2- • (6) Subject to Developers compliance with the requirements of Paragraph (7) below, Fraser agrees to complete said remaining subdivision improvements referred to in Paragraph (5), on or before October 31, 2001. (7) In consideration of Fraser's completion of the subdivision improvements referred to in Paragraph (4), and Fraser's agreement to complete the remaining subdivision improvements referred to in Pazagraph (5), Developers agree to convey to Fraser the following real property located in the Town of Fraser, County of Grand, State of Colorado, to-wit: Lot 1, A Resubdivision of Tracts B and C of Clayton Subdivision, Reception No. 249237, according to the Plat thereof filed February 8, 1991, at Reception No. 291300. Such conveyance shall be made by general warranty deed, free and clear of all financial encumbrances, but subject to easements and restrictions of record, and subject to general ad valorem real property taxes for the year of the conveyance. Such deed shall be executed by Developers and delivered to Fraser on or before October 31, 2000. VIII. Upon completion of the conveyance of Lot 1 to Fraser, as provided in Pazagraph (7), Developers shall be relieved of any further obligations for completion of the required subdivision improvements and for payment of the costs of such improvements; and Developers • shall be ~r.l:lled to obtain a release of the restrictions contained in Paragraph 3 of the Improvemenrt Agreement with respect to the sale of transfer of Lots within the Subdivision. If; however, Developers fail to convey said Lot 1 to Fraser, within the time and in the manner specified in Pazagraph (7) hereof; then Developers, and their heirs, devisees, successors and assigns, shall remain obligated for completion of all such subdivision ii~~r~ ovements and for reimbursement of Fraser for all costs of such improvements, and said restrictions on the sale or transfer of Lots shall remain in effect, in accordance with the provisions of the Improvement Agreement, as amended by this Agreement. IX. Except for those provisions of the Improvement Agreement ~,~.r~ ~ssly amended herein, all other terms, conditions and provisions of said Improvement Agreement shall remain unchanged and aze hereby ratified and confirmed by Developers and Fraser. Said terms, conditions and provisions of the Improvement Agreement, as amended herein, shall continue to apply to both the Subdivision and Resubdivision.
