TOWN BOARD JAN. 20,1999 6:00 P.M. WORKSHOP PAVING PROJECT 7:30 REGULAR MEETING The regulaz meeting of the Boazd was called to order at 7:30 p.m. Board present were Mayor Johnston, Klancke, Sanders, Rantz and Soles. McIntyre was out of Town but was on a speaker phone during the meeting. Staff present were Reid and Winter. Minutes of the ~~~,~ious meeting were a~r~~.,~~ed with the following correction: 9:00 p.m. Soles made a motion to hold an executive session to discuss personnel, 2nd Sanders, carried 10:30 p.m. In regular session. Soles made a motion approving the Town Manager contract as presented, 2nd Sanders, carried. Meeting adjourned at 10:30 p.m. OPEN FORUM Jon DeVos representing the Twin Rivers Condominium .Development discussed the road going through Twin Rivers. Devos asked for help with the cost of maintaining this road as it remains open to the public. He estimates of cost of approx. $38,000 for pavement • repairs in the next couple of yeazs. The north end culvert will need to be replaced as well. He also asked for consideration of closing the road to the public. The Board will study the srtuahon. R:,~~.,sentatives from Safeway and the various c.,uuuctors for the Safeway project were present to discuss the progress of the public improvements and presented a request to obtain a street cut to facilitate hooking into the sewer at County Road 804. Boazd reviewed the letter fi.,.., Galloway, Romero & Associates dated Jan. 15th relating to the issues to be discussed at this meeting. After full discussion and comments from the public the following was resolved: • MacGregor Wathan and Safeway will each rY ~ /ide the Town of Fraser a $2500 check, delivered to the Town Hall by Monday, January 25, 1999 at 9:00 a.m. These checks will be returned if the street cut is completed before 3:15 p.m. on Tuesday, January 26, 1999, or they will be used by the Town to call in a ca~l~actor to complete the job within this timeframe. • The street cut will be done on Monday and Tuesday, January 25 & 26, from 9:15 a.m. to 3:15 p.m. Both lanes of County Road 804 must be open before and after these times. • Only the southern lane of County Road 804 will be closed to traffic. The northern lane will remain open. MacGregor Wathan will ~,~., side traffic mana~~~ent for the single lane. • • Backfill for the trenching will be imported as needed and will be dry and unfrozen. ýÿ • County Road 804 will be bladed smooth and compacted to street level at the end of each day. A permanent (temporary} patch will be completed by January 27, 1999 by 3:15 p.m. In other matters, Kevin Neb ro~~~,senting the EMS updated the Board on the services that are being provided in response to budget cuts the county has made. DISCUSSION ~ Y CMS Reid stated that the Housing Authority has asked that the St.Onge pr.,i.:,~ ty owned jointly by the Town and the Town of Winter Park be given to them for future devel.,,r~..ent. A meeting with the Town of Winter Park, Housing Authority, GCWSD and WPWWSD will be scheduled to discuss patterning on this property. Wellhead i,~ ~..l..ction zoning discussion postponed. A proposed Noise Ordinance was discussed. Reid will bring it back as an action item at the next meeting and will check with Attorney McGowan that the the Sheriffs' Dept. assessment of the noise will be considered prima facia evidence for issuing the ticket. Reid advised that the Walk Through History Foundation has received 200 shares of • Procter/Gamble stock from Herbert and Martha Hetzler that will be used to bronze the Indian and Eagle and part of the next statute in line for bronzing. Board expressed deep appreciation for this generous gift. Reid reviewed that the Town approved the Agreement to amend Subdivision Im~~~~ement Agreement relating to Tracts B and C of the Clayton Subdivision last July by Resolution No. 7-1-98. Sanders declared a conflict of interest and removed herself from discussion on the subject. The agreement had the Alves as signatories. The Alves have communicated that would not sign the agreement as written. As the Town is not interested in making changes to the agreement, the Alves have been eliminated as signatories in the agreement. Rantz made a motion a~N~.,~/ing the elimination of the Alves' to the agreement and allowing the Mayor to sign the agro.,~ent with the change, 2nd Soles, carried. AN ORDINANCE PROHIBITING CONDUCT WHICH DISTURBS THE PEACE, AND AMENDING APPLICABLE PROVISIONS OF THE CODE OF THE TOWN OF FRASER. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, THAT: PART I: AMENDMENT TO TOWN CODE. The Code of the Town of Fraser, Colorado is hereby amended by adding a new Article 7-10 to said Code entitled "Disturbing the Peace", which shall read as follows: ARTICLE 7-10 DISTURBING THE PEACE Section 7-10-1. Prohibition. (1) It shall be unlawful for any person to make, cause to be made, or permit or assist another • to make any unreasonably loud or unusual noise in a public or private place, which, under all of the circumstances presented, would cause a person of ordinary sensitivities significant annoyance and irritation. (2) No person shall permit another to commit an act of disturbing the peace as described above in or upon any premises owned, possessed, or under his management or control when it is in his power to prevent such an act. Section 7-10-2. Exceutions. (1) Noise caused in the performance of emergency work for the immediate safety, health, or welfare of the community or individuals of the community shall not be subject to the provisions of this Article. (2) Noise resulting from regular use of the railroad tracks in Fraser shall not be subject to the provisions of this Article. Section 7-10-3. Permits. (1) Applications for a permit to hold a public event which may violate the provisions of this Article shall be made to the Town Manager or his duly authorized representative. Such permit shall be valid only at the specific times, dates, and conditions noted in the permit. • ýÿ • • (1) Any person who violates, disobeys, omits, neglects, refuses, or fails to comply with or resists the enforcement of any provision of this Article shall be punished by a fine not exceeding $300 for each and every violation, or imprisonment for term not exceeding 90 days, or by both such fine and imprisonment. Section 7-10-4. Penalty. PART 2: REPEAL. Any and all existing ordinances or parts of ordinances of the Town of Fraser covering the same matters as embraced in this Ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this Ordinance are hereby repealed; provided, however, that such repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance. PART 3: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Town of Fraser hereby declares that it would have adopted this Ordinance, and each section, subsection, clause or phrase thereof, irrespective of the.fact that any one or more sections, subsections, sentences, clauses and phrases thereof be declared invalid or unconstitutional. PART 4: Err~CTIVE DATE. This Ordinance shall take effect immediately after passage, adoption, and publication thereof as provided by law.
