DATED FEBRUARY 11, 2011
WHEREAS, the City and the District have diligently followed the terms of the Settlement
Agreement dated February 11, 2011; and
WHEREAS, the Technical Advisory Group (TAG) has been working on developing its
recommendation for future wastewater treatment, storage and disposal; and
WHEREAS, the Settlement Agreement requires the TAG to complete its
recommendation by July 29, 2011; and
WHEREAS, the TAG has unanimously requested additional time to complete its
recommendation; and
WHEREAS, the Settlement Agreement requires the City, by action of its city council, to
take action on a recommendation by TAG not later than December 31, 2011; and
WHEREAS, the City and the District agree that it is in the best interests of their patrons
to extend the deadlines set out at sections 4.f and 4.g of the Settlement Agreement.
NOW, THEREFORE, the parties hereto agree as follows:
1. The TAG Plan recommendation shall be submitted to the City and the District not
later than October 14, 2011.
2. The deadline for City action on a recommended TAG Plan, imposed by section
4.g of the Settlement Agreement, is extended to March 8, 2012.
