ORDINANCE NO.345
AN ORDINANCE AMENDING ORDINANCE NOS. 311, 322, AND 333,
INTERIM ORDINANCES RESTRICTING DEVELOPMENT WITHIN
THE CITY.
THE CITY COUNCIL OF THE CITY OF MEDINA ORDAINS AS FOLLOWS:
Section 1. Background.
1.01. On October 5, 1999, the city of Medina (the "City") adopted Ordinance No. 311,
an interim ordinance declaring a moratorium on development within a large portion of the
community.
1.02. The City's purpose in adopting the interim ordinance was to protect the on -going
planning process associated with the amendment of the City's comprehensive plan. The City
needed an opportunity to adopt or modify its official controls as they related to the commercial
areas.
1.03. On October 3, 2000, the City adopted Ordinance No. 322, an interim ordinance
extending the moratorium on development within portions of the community through April 3,
2001, or until such time as the City might revoke or amend the ordinance.
1.04. On April 3, 2001, the City adopted Ordinance No. 333, an interim ordinance
extending the moratorium on development through July 3, 2001.
105. Since the adoption of the original interim ordinance, the City finalized its
comprehensive plan and initiated a process to consider various amendments to its zoning
ordinance and other official controls. This effort has resulted in the adoption of numerous new
zoning district ordinances, the last of which was adopted by the City on June 19, 2001 and will
be effective upon publication.
Section 2. Findings.
2.01. In light of the conclusion of the planning process regarding the commercial areas
of the community, it is hereby found and determined by the City that, subject to the exception
noted in 2.02 below, there remain no areas of the community which need to be subject to a
moratorium on development.
2.02. It is hereby declared that no area of the community is subject to the moratoria
imposed by Ordinance No. 311, Ordinance No. 322, and Ordinance No. 333, except the property
guided public/semi-public and zoned multifamily residential and identified by PINS 12-118-23-
21-0001 and 12-118-23-22-0001. City staff may henceforth accept and process applications

regarding development on properties within the entire City, except as noted herein, subject to
such restrictions and processes generally imposed by the City's ordinances and other law.
Section 3. Effective Date.
3.01. This ordinance be effective upon its adoption and publication.
Adopted by the city council of the city of Medina on the 19th day of June, 2001.

URBAN RESERVE DISTRICT IN
TOWNSHIP 118, RANGE 23
The city council of the city of Medina ordains as follows:
Section I. The property described by Hennepin County
Property, Identification Numbers in Exhibit A and shown
on the map in Exhibit B attached hereto are hereby rezoned
to rural residential - urban reserve zoning district and the
Medina zoning administrator is hereby authorized and
directed to cause the city's zoning map to be changed to
reflect the new zoning.
Section II. This ordinance shall be effective upon its adop-
tion and publication.
Adopted by the city council of the City of Medina on the
19th day of June, 2001.

The city council of the city of Medina ordains as follows:
Section I. The property described by Hennepin County

on the map in Exhibit B attached hereto are hereby rezoned
to urban residential zoning district and the
Medina zoning administrator is hereby authorized and
directed to cause the city's zoning map to be changed to

AN ORDINANCE AMENDING
SECTION 825.07, SUBD. 29 OF THE CODE
OF ORDINANCES REGARDING
ESSENTIAL SERVICES
The city council of the city of Medina ordains as follows:
Section. I. Section 825.07, subd. 29 of the Medina Code of
Ordinances is amended by adding the underlined material
as follows.
Subd. 29. Essential Services - Overhead or underground
electric, gas, communication, steam or water transmission
or distribution systems and structures, by public utilities or
,governmental ¢Rpartments.or ..commissions or ,as are
' required for protection of the public health; safety or gen-
eral welfare including towers; poles, wires, mains, drains,
sewers, pipes, conduits; cables, fire alarm boxes, policy call
boxes, and accessories in connection therewith; but not
including buildings or any personal wireless service facil-
ities or unlicensed wireless service facilities, as defined in
47 U.S.C. 332(c)(7)(C). Notwithstanding the above, a
building may be constructed as an accessory structure to an
essential service provided that it may be used only to pro-
vide weather protection for stationary equipment, may not
exceed 400'square feet and may not exceed 15 feet in
height. If a building is constructed as an accessory structure
to an essential service, the exterior building materials must
be in compliance with Section 828.04 and the site must be
landscaped in accordance with Section 828.09 of this ordi-
nance.
Section II:. This amendment shall take effect upon its adop-
tion and publication.
Adopted by the Medina City Council on the 19 day of June,
2001.
