HomeMy Public PortalAboutAddendum No. 2 to Contract No. 43-2012 - Beam Longest Neff Manor Dr to CataplaSUPPLEMENTAL AGREEMENT NO. 2 This Supplemental Agreement, made and entered into this day of Nov 3, .1 of to , 2016, by and between the City of Richmond, Indiana, acting by and through its proper officials (hereinafter referred to as the "OWNER"), and Beam, Longest and Neff, L.L.C., Consulting Engineers, 8126 Castleton Road, Indianapolis, Indiana 46250 (hereinafter referred to as the "CONSULTANT"). WITNESSETH: WHEREAS, the OWNER and the CONSULTANT did enter into an Agreement, dated June 1, 2012, to provide professional engineering services for the extension of Manor Drive from Dillon Drive to Catalpa Drive, and Supplemental Agreement No. 1, dated December 11, 2014, for the formal public hearing for the Project in lieu of just an opportunity for a hearing, and, WHEREAS, the CONSULTANT was required to perform R/W Engineering on fewer parcels due to the design of the Project and is now required to perform utility coordination during construction due to changes in INDOT policy, and, WHEREAS, the CONSULTANT is qualified and prepared to perform the services required in said work and they agree to perform such services under the terms and conditions herein set forth, and, WHEREAS, in order to provide for completion of the work as modified, it is necessary to amend and supplement the original Agreement and Supplemental No. 1, NOW, THEREFORE, it is agreed by and between the parties hereto as follows: 1. On page 1, Appendix "D" of the original Agreement, under Section A, paragraph 1 is amended to read as follows: 1. The CONSULTANT shall receive as payment for the work performed under this Contract the total amount not to exceed $251,880.00, (Sections A.1, A.2, A.3, A.4, A.5, A.6, A.7, A.8, A.9, A.10 and A.12 - $246,880.00, Section A.11 - $5,000.00), unless a supplement is executed by the parties which increases the maximum amount payable. 2. On page 2, Appendix "D" of the original Agreement, under Section A, paragraph 4 is amended to read as follows: 4. Compensate the CONSULTANT for the Services under Appendix "A", Item 7 (Right -of -Way Engineering), based on the specific cost per unit 1+nPq.Nfluw, Na.2 tb �o,�rer��rlVo. y3��la. 3. 4. 5 multiplied by the actual units of work performed in accordance with the following schedule. The schedule shall be renegotiated should the completion of the work extend beyond 24 months from the date of the execution of the Agreement. The CONSULTANT will contact the LPA when 80% of the fee has been expended. A determination will be made at that time if the fees are sufficient to complete the Project. The CONSULTANT is to be compensated monthly. On page 2, Appendix "D" of the original Agreement, under Section A, paragraph 5, the not to exceed amount is increased by $7,600.00 to $25,600.00. On page 3, Appendix "D" of the original Agreement under Section A, paragraph 6 is amended to read as follows: 6. If services are required in accordance with Section A.11 of Appendix "A", funding will be encumbered in an amount not to exceed $5,000.00, and the CONSULTANT will receive payment for the work in accordance with Section B.3 of Appendix "D". On page 4, Appendix "D" of the original Agreement, under Section B, paragraph 3, the maximum hourly rate is increased to $64.64. 2 6. Except as herein modified, changed and supplemented, all terms of the original Agreement, dated June 1, 2012 and Supplemental No. 1, dated December 11, 2014, shall continue in full force and effect.
