AUTHORIZING THE MAYOR TO EXECUTE THE BUILDING
ENCROACHMENT EASEMENT AGREEMENT
FOR LOT 29, BLOCK 6805
WHEREAS, Virk Apartments, LLC is the owner of real property located in the Borough
of Carteret, known as 2 Carteret Avenue, Carteret, New Jersey and also known as Lot 29
in Block 6805 on the Borough of Carteret Tax Map; and
WHEREAS, the south end of the existing building located on the above sited property
encroaches onto the public right of way (sidewalk) by approximately one -half (1/2) foot;
and
WHEREAS, Virk Apartments, LLC wants to acquire an easement to eliminate a building
encroachment on the above property; and
WHEREAS, the Borough of Carteret feels it is in the interest of the general public and
the welfare of the Borough of Carteret to grant the building encroachment easement; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
I. That the proposed Building Encroachment Easement Agreement
between the Borough of Carteret and Virk Apartments, LLC for Lot
29, Block 6805, known as 2 Carteret Avenue is hereby approved and
the Mayor is hereby authorized and directed to execute the same in a
form approved by the Borough Law Director.
2. That a certified copy of this Resolution be forwarded to the Borough
Law D and John W. Spoganetz, Esq., on behalf of Virk
Apartments, LLC.
Adopted this 21" day of November, 2013
and certified as a true copy of the
original on November 22, 2013.
