A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF TEMPLE CITY DECLARING ITS
INTENT TO CONDUCT A PUBLIC HEARING TO
DETERMINE THE EXISTENCE OF A PUBLIC NUISANCE
THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DOES RESOLVE:
WHEREAS, the Planning Commission of the City. of Temple City finds
that certain premises within the City may be maintained contrary to the
provisions of the Municipal Code of the City; and
WHEREAS, the City Manager has recommended that a public hearing be
;held to ascertain whether or not a public nuisance exists,
NOW, THEREFORE, the Planning Commission hereby declares its intent
to hold a public hearing on March 26, 1985 to ascertain whether certain
premises situated in the City of Temple City, State of California, known
and designated as 5942 Muscatel Avenue in said City, and more
particularly described as Tract No. 5904, Map Book 69, p. 29, south portion of Lot
108 of Maps in the Office of the County Recorder, County of Los Angeles, State of
California
=::constitute a public nuisance subject to abatement by the City:
That the following conditions maintained on said property may exist
contrary to the provisions of Section 4240 of the Municipal Code of the
.ity:
Section 4230(i) - Dead trees, weeds and debris: (1) constituting unsightly
appearance, or (2) dangerous to public safety and welfare, or (3) detri-
mental to nearby property or property values.
Section 4230(t) - Maintenance of premises so out of harmony or conformity with
the maintenance standards of adjacent properties as to cause substantial
diminution of the enjoyment, use or property values of such adjacent properties.
That abatement by the following method(s) has been suggested:
1. Removal of miscellaneous debris from rear yard.
2. Maintenance of property in a.manner consistent with neighboring properties.
Abatement to be accomplished within 30 days.
That the City Clerk shall cause the owner of said premises to be
served with appropriate notice in the manner prescribed by the Municipal
Code:
That the Secretary of the Planning Commission shall cause said
premises to be posted in the manner prescribed by the Municipal Code;
The Secretary shall certify to the adoption of this Resolution.
ADOPTED and APPROVED this 12 day of Mar 1985.
