Home My Public Portal About2008-02-04 Special Meeting119 BAL HARBOUR VILLAGE COUNCIL MEETING MINUTES SPECIAL MEETING - FEBRUARY 4, 2008 A Special Meeting of the Bal Harbour Village Council was held on Monday, February 4, 2008, at the Bal Harbour Village Hall Council Chambers (655 — 96th Street, Bal Harbour, Florida). Members of the public were advised that due to the lack of a quorum, the meeting would be postponed until 1:15 p.m. 1. CALL TO ORDER/ROLL CALL: The meeting was called to order at 1:25 p.m. by Councilman Jacobi. The following were present: Councilman Joel S. Jacobi Councilman Martin Packer Councilman Jaime M. Sanz Alfred J. Treppeda, Village Manager Ellisa Horvath, CMC, Village Clerk Anthony C. Soroka, Village Attorney Absent: Mayor Howard J. Berlin Assistant Mayor Jean Rosenfield As a quorum was determined to be present, the meeting commenced. 2. PLEDGE OF ALLEGIANCE: The Pledge was led by Village resident Cecil Mullen. 3. VILLAGE ATTORNEY REQUEST FOR HOLDING OF ATTORNEY CLIENT SESSON CONCERNING PENDING LITIGATION IN RAHEB V. BAL HARBOUR VILLAGE: Mr. Soroka requested an Attorney Client Session to discuss the pending Raheb v. Bal Harbour Village litigation. A motion was offered by Councilman Packer and seconded by Councilman Sanz for the Village Attorney to schedule an Attorney Client session through the Village Manager's office. The motion carried unanimously (3-0). 4. OTHER BUSINESS: Dina Cellini, resident— 211 Bal Cross Drive, objected to Councilman Jacobi making the quorum to hold the Special Council meeting, since the election litigation regarding his service on the Council is ongoing. She noted that his presence could impact the legality of the meeting in the future. Councilman Packer requested the Village Attorney to respond to Ms. Cellini's comments. Mr. Soroka noted that although the election is in dispute, the Village cannot stop business based on litigation. ADJOURN: There being no further business, a motion was offered by Councilman Packer and seconded by Councilman Sanz to adiourn.
