ATTORNEY /CLIENT SESSION - FEBRUARY 19, 2008
An Attorney /Client Session of Bal Harbour Village was held on Tuesday, February 19,
2008, in the Administrative Offices at Bal Harbour Village Hall (655 — 96 Street, Bal
Harbour, Florida).
1. CALL TO ORDER /ROLL CALL: The meeting was called to order at
8:00 a.m. by Mayor Berlin. The following were present:

Assistant Mayor Jean Rosenfield
Councilman Joel S. Jacobi
Councilman Martin Packer
Councilman Jaime M. Sanz
Alfred J. Treppeda, Village Manager
Ellisa L. Horvath, CMC, Village Clerk
Andrea Greenblatt, Administrative Assistant
Richard J. Weiss, Village Attorney
Michael S. Popok, Village Attorney
Mary G. Stephenson, Taylor Reese and Associates, Inc.
As a quorum was determined to be present, the meeting commenced.
2. PLEDGE OF ALLEGIANCE: The Pledge was led by the Council.
3. ATTORNEY - CLIENT SESSION: Mayor Berlin explained that the Council
will have an Attorney /Client Session, in accordance with Florida Statute 286.011, regarding
the litigation styled Babak Raheb versus Village of Bal Harbour, Case Number 03 -21932
CA 23, Circuit Court of the 11 Judicial Circuit in and for Miami -Dade County, Florida. He
advised that the session is estimated to last one hour and the following people will be in
attendance at the meeting:

Councilman Joel S. Jacobi
Councilman Martin Packer
Councilman Jaime M. Sanz
Alfred J. Treppeda, Village Manager
Richard J. Weiss, Village Attorney
Michael S. Popok, Village Attorney
Mayor Berlin advised that the proceedings will be recorded by a certified court reporter
(Mary G. Stephenson, Taylor Reese and Associates, Inc.) and that, at the conclusion of all
litigation discussed, the transcript will be made part of the public record. All individuals, who
were not named by Mayor Berlin, left the room and the Attorney - Client session began.

The meeting was reconvened in public session at 8:55 a.m. Mayor Berlin explained that the
Attorney /Client Session was terminated and that members of the general public were
invited back into the meeting for any further proceedings or matters. Those present were:

4. OTHER BUSINESS: None.
5. ADJOURN: There being no further business to come before the Council, a
motion was offered by Assistant Mayor Rosenfield and seconded by Councilman Packer to
adjourn. The motion carried unanimously (5 -0), and the meetine adjourned at 9 :00 a.m.
