HomeMy Public PortalAboutAddendum No. 1 to Contract No. 13-2014 - Metro - Rundell Ernstberger - Bike Path Improvementsc 1 CONTRACT SUPPLEMENT NO. 1 THIS SUPPLEMENTAL AGREEMENT, made and entered into this 9'` day of 7994� 2017, by and between RUNDELL ERNSTBERGER ASSOCIATES, INC, Indianapolis, Indiana, hereinafter referred to as the "CONSULTANT', and the City of Richmond, IN, hereinafter referred to as the "LOCAL PUBLIC AGENCY" or "LPA" WHEREAS, on February 21, 2014, the LPA entered into a Contract with the CONSULTANT for services required for development of Contract Plans for the construction of the Richmond Stellar Streets Project, Richmond, Indiana, INDOT Project Des. No. 1382810, herein after referred to as the Contract, and WHEREAS, the LPA and the CONSULTANT have determined that a modification of the Contract is required to include modify Appendices A to include additional environmental study requirements, and WHEREAS, the LPA and the CONSULTANT have determined that a modification of the Contract is required to include fees for certain services listed in Appendix A and listed as "to be determined (TBD)" in Appendix D of the Contract. NOW, THEREFORE, the parties agree that the Contract shall be modified by this Contract Supplement No. 1 in accordance with the following: Appendix A of the Contract shall be modified as follows: ADD the following Environmental Report Services under Paragraph A to include the following services: "A, 8. Phase II Investigation: The Phase II Investigation will collect and analyze soil samples from select areas of concern that were identified by INDOT following a review of the Phase I Environmental Site Assessment (Phase I ESA) and the associated sections of the Category Exclusion (CE) document. The Phase II Investigation will assess whether hazardous substances are present within the soils in the areas of concern, which may affect scope, schedule, and/or budget of the proposed redevelopment project. The Phase 11 report will document the field activities, findings, conclusions and outline requirements necessary for the project to comply with federal and state environmental laws and regulations during construction. II. Appendix D of the Contract shall be modified as follows: Appendix D, Section A, paragraph 1, shall be MODIFIED to read: "1. The CONSULTANT shall receive as payment for the work performed under this Contract the total fee not to exceed $00 750,380.00 in accordance with the following Fee Schedule, unless a modification of the Contract is approved in writing by the LPA." Appendix D, Section A, paragraph 2, shall be MODIFIED to read: "2. The CONSULTANT will be paid for the work performed under this Contract as indicated in the following Schedule of Fees: a. Environmental Documentation, as indicated in Appendix A, Paragraph A $58,630.00 86,330 b. Field Surveying, as indicated in Appendix A, Paragraph B $81,300.00 c. Preliminary Engineering Report, as indicated in Appendix A, Paragraph C $15,000.00 d. Design and Construction Documents, as indicated in Appendix A, Para. D $533,500.00 e. IDEM Rule 5 Permit, as indicated in Appendix A, Paragraph E* $11,550.00 Page 1 of 2 Addendum No. 1 to Contract No. 13-2014 Geotechnical Investigation, as indicated in Appendix A, Paragraph F $ 16,830.00 Reimbursable Expenses" $5,870.00 IN TESTIMONY WHEREOF, the parties hereto have executed this Contract Supplement.
