HomeMy Public PortalAboutOrd. 1651ORDINANCE NO. 1651 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA AMENDING CHAPTER 2 -1 OF THE LYNWOOD MUNICIPAL CODE TO CHANGE THE REGULAR CITY COUNCIL MEETING TIME AND UPDATE THE COUNCIL REIMBURSEMENT AND COMPENSATION PROVISIONS CONSISTENT WITH PRIOR CITY COUNCIL ACTION WHEREAS, regular meetings of the City Council of the City of Lynwood had been commencing at 5:00 p.m. on the first and third Tuesdays of the month; and WHEREAS, to better accommodate the members of the public who are unable to attend the Council meetings because of conflicts with their regular work schedules, the Council directed that the time for the commencement of the regular meetings be changed to 6:00 p.m.; and WHEREAS, the provisions of Chapter 2 -1 of the Lynwood Municipal Code, entitled "City Council" had not been updated in some time insofar as it references a start time of 7:30 p.m. for City Council meetings, does not reference current reimbursement provisions approved by the City Council approved on August 5, 2008 by Resolution No. 2008.071 or the applicable stipend amounts approved by the City Council on February 5, 2008; and WHEREAS, the inconsistencies found in Chapter 2 -1 require that the Council correct Subsection 2.1.2,a. related to City Council regular meeting times, Section 2 -1.3 related to City Council expense reimbursements and Section 2 -1.4 related to City Council compensation; and WHEREAS, the City Council wishes to amend the start time to 6:00 p.m. and update the other provisions of Chapter 2 -1 pursuant to this Ordinance; and WHEREAS, the City Council now desires to codify these changes to the Lynwood Municipal Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ORDAIN AS FOLLOWS: Section 1. Section 2 -1.2, "Meetings Of The City Council," of the Lynwood Municipal Code is hereby amended, as to Subsection a. only to read as follows, with all provisions of Subsection 2 -1.2 b remaining unmodified and in full force and effect: "a. Time And Days For Regular Meetings: The regular meetings of the City Council shall be held on the first and third Tuesdays of each month at six o'clock (6:00) p.m.; however, when a meeting day falls upon a legal holiday, then the meeting shall be held on the next succeeding day that is not a legal holiday; unless the regular meeting is duly cancelled." Section 2. Section 2 -1.3, "Reimbursement Of Expenditures," of the Lynwood Municipal Code is hereby amended, as to Subsection b. only to read as follows, with all provisions of Subsections 2 -1.3 a and c remaining unmodified and in full force and effect: "b. Members of the City Council shall be reimbursed for expenses incurred by them in the use of their personal vehicles and for media use in the performance of their duties in the sum set by Resolution of the City Council, including Resolution Nos. 2008.071, as such Resolution may be amended from time -to- time." Section 3. Section 2 -1.4, "Compensation of Councilmembers," of the Lynwood Municipal Code is hereby amended, as to Subsection b. only to read as follows, with all provisions of Subsection 2 -1.4 b remaining unmodified and in full force and effect: "a. In accordance with section 36516 of the California Government Code, each member of the City Council will receive as salary the sum of seven hundred eighty dollars ($780.00) per month." Section 4. Except as expressly modified pursuant to this Ordinance, all provisions of the Lynwood Municipal Code shall remain unmodified and in full force and effect. Section 5. If any section, subsection, clause or phrase of this ordinance is for any reason, held to be unconstitutional, or otherwise invalid, such decision shall not affect the validity of the remaining sections of this ordinance. The Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 6. This ordinance shall take effect 30 days after its final passage, and within fifteen (15) days after its passage, the City Clerk shall cause it to be posted as required by law, and hereby designated for that purpose. First read at a regular meeting of the City Council held on the 1St day of May, 2012 and adopted and ordered published at a regular meeting of said Council on the 15th day of May, 2012.
