HomeMy Public PortalAbout2012.097 (05-15-12)RESOLUTION NO. 2012.097 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE EXTENSION OF THE AGREEMENT BETWEEN THE CITY OF LYNWOOD AND THE CITY OF INGLEWOOD TO PROVIDE PARKING CITATION SERVICES AND COLLECTION SERVICES; AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT TO AVOID INTERRUPTION OF SERVICES; AND AUTHORIZING STAFF TO ISSUE A REQUEST FOR PROPOSAL TO ENSURE THAT THE CITY RECEIVES THE MOST COST EFFECTIVE PARKING COLLECTION AND CITATION PROCESSING SYSTEM WHEREAS, at the March 20, 2012 Council meeting, staff indicated, per the terms of the original agreement, that a month -to -month contract extension with the City of Inglewood to provide parking citation and processing services is not permitted; only two optional 1 -year extensions are permitted; and WHEREAS, staff requested Council to reconsider item and approve a 1 -year extension with Inglewood with the intent that the City would engage in a RFP process, utilize the 120 day termination clause to end services early in order to avoid interruption of services and transition to new service provider; and WHEREAS, the City Council requested the City Attorney to review the terms and conditions of current agreement with the City of Inglewood to clarify if the agreement allowed for a month -to -month extension and to verify the termination clause and requirements, and upon the City Attorney's review; Council requested staff to bring back item for a final recommendation; and WHEREAS, the City Attorney has reviewed and verified that the current agreement with the City of Inglewood only allows for a one -year extension and also, a 120 day written notice is required to terminate contract early; and WHEREAS, further, staff continued to negotiate and work with the City of Inglewood officials, in which Inglewood agreed to lower the termination clause from 120 days notice to a 30 day notice; thus resembling a month -to -month agreement term; and WHEREAS, to avoid interruption to services and ensure seamless transition of new vendor and processing system, staff recommends that the current service agreement with the City of Inglewood be extended for one additional year; and WHEREAS, pending the completion of the RFP process, selection of vendor, and implementation of new processing system; the RFP process should take less than one year in which staff will exercise the new 30 -day termination clause of the contract in order to transition to new service provider. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The City Council approves the extension of the Parking Citation Management Services between the City of Lynwood and City of Inglewood and authorizes the Mayor to execute the Agreement entitled "Service Agreement Change Notice ". Section 2 . That the City Council authorizes staff to issue a Request for Proposals to ensure conformance with Section 6 -3.9 of the Lynwood Municipal Code on contracts exceeding $15,000. Section 3: The appropriation for the contract services will continue to be deducted from the Municipal Code Fines revenues for the remainder of FY12 in the event appropriation for contract services exceeds the budget included in the Parking Enforcement Division expenditure budget. The collection fees as incurred will continue to be included in the penalty charged to the registered owners of unpaid parking citations pursuant to Lynwood Municipal Code 6 -8. Section 4. This Resolution shall take effect immediately upon its adoption. Section 5. The City Clerk shall certify as to the adoption of this City Council Resolution.
