HomeMy Public PortalAbout2012.091 (05-01-12)li RESOLUTION NO. 2012.091 jA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACTIVATING I THE PARKING AUTHORITY OF THE CITY "OF .LYNWOOD WHEREAS, the City of Lynwood expects to participate in the development and operation of parking lots adjacent to public transportation nodes and other parking facilities serving the City's residents and visitors; and WHEREAS, pursuant to California Streets and Highways Code sections 32650 and following, the City Council may activate the Parking Authority of the City of Lynwood (the "Parking Authority "), which may facilitate the development and operation of such parking facilities. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LYNWOOD, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are true and correct and the City Council so finds and determines. Section 2. Declaration of Need. The City Council hereby declares that there is a need for the Parking Authority to function within the City and is hereby established and authorized to transact business within the City and have all powers provided under Streets & Highways Code sections 32801 et seq. The City Council hereby finds and determines that the Parking Authority's jurisdiction shall be coextensive with the jurisdictional border of the City of Lynwood. Section 3. Designation of Governing Body. Pursuant to Streets and Highways Code section 32661 1, the City Council hereby designates itself to be the Parking Authority When functioning as the Parking Authority, the City Council shall be referred to as the Board of Directors of the Parking Authority and the Mayor shall serve as the chairperson of the Board Section 4. Approval of Conflicts Code. The City Council, as the conflict code reviewing body, hereby approves the conflict of interest code, attached hereto, proposed for adoption by the Board of Directors of the Parking Authority on the date hereof Section 5. Transactions and Audited Financial Statements. The Parking Authority shall annually file with the City Council a detailed report of all its transactions, including a statement of all revenues and expenditures. Additionally, at least once annually, the authority shall submit a statement of all its financial affairs, audited by independent certified public accountants, to the City Council. Section 6. Other Acts. The officers and staff, of the City, and each of them individually, are hereby authorized and directed to do any and all things and to execute and deliver any and all documents that, in consultation with the City Attorney, they may deem necessary or advisable in order to effectuate the provisions of this resolution. All actions heretofore taken by such officers that are in conformity with the purposes and intent of this resolution are hereby ratified, confirmed, and approved in all respects. Section.7. Effective Date. This resolution shall take effect upon adoption. Section B. Certification. The City Clerk shall certify to the adoption of this resolution. The disclosure and disqualification requirements for individuals occupying the positions designated below shall be as set forth by regulation of the Fair Political Practices Commission (Title 2, California Code of Regulations, Section 18730, hereafter "Section 18730 "), as Section 18730 may be amended by the Fair Political Practices Commission from time to time. 2) Designated Positions. The positions listed below constitute the list of designated positions required by Section 18730 The individual occupying each position is deemed to make, or participate in the making of, decisions that may have a material effect on a financial interest of that individual.
