RESOLUTION #33-2014
A RESOLUTION APPROVING A FINAL PLAT FOR THE POUCHERT TWO -LOT MINOR
SUBDIVISION LOCATED AT 394 LOVERIDGE DRIVE IN THE R-2 RESIDENTIAL ZONING
DISTRICT
WHEREAS, Marta Empinotti-Pouchert and James Pouchert of 126 Old Post Office
Road, as the "Owners" of record ("Owner") of a .34 acre parcel on the northwest corner of the
intersection of Loveridge Drive and Mill Creek Drive in the R-2 Zone has applied to the city for
approval of a 2-lot Minor Subdivision on said property; and
WHEREAS, the applicant provided the City of Moab with the necessary documents,
plans and drawings to complete the application for review of said subdivision as required in
Code Title 16, Subdivisions; and
WHEREAS, Owners can exercise the exception for a public hearing as established in
Utah State Code 10-9a-608 and MMC Chapter 16.08.020 if the subdivision is owned by the
applicants and dedication of right-of-way is not required; and
WHEREAS, the Moab City Council ("Council"), having considered Staff
recommendations, finds that the Final Plat of The Pouchert Two Lot Minor Subdivision has met
or can meet the requirements of Utah State Code and Title 17 of the Moab Municipal Code; and
NOW, THEREFORE, be it resolved by Council, that adoption of Resolution #33-2014
favorably approves the two lot minor subdivision without conditions.
Passed and adopted by action of the Governing Body of the City of Moab in open session this
12th day of August, 2014.
