3 ,," THIS ADDENDUM, (Number 1 to Contract No. 40-2016) is made and entered into this
�t,'�1 day of 2017, by and between Richmond, Indiana, a municipal
corporation acting through its Board of Public Works and Safety with its office at 50 North 5 h Street,
Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Rinehart's Lawn Care, 5905 State
Road 121, Richmond, Indiana, 47374 (hereinafter referred to as "Contractor").
WHEREAS, City and Contractor entered into Contract No. 40-2016 on April 28, 2017, which
Agreement retains Contractor to provide mowing services for the City -owned right-
of-way properties for the City of Richmond Department of Infrastructure and
Development (f/k/a Metropolitan Development); and
WHEREAS, The request for quotes associated with said Agreement contains an option to renew
the Agreement upon the same terms and conditions for the 2017 calendar year; and
WHEREAS, City wishes to retain Contractor to continue to provide the mowing services for the
2017 calendar year, as set forth within the scope of Contract No. 40-2016.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained,
including the above stated recitals, City and Contractor hereby agree as follows:
The City and Contractor executed and entered into Contract No. 40-2016, on April
28, 2016. Pursuant to Contract No. 40-2016, Section XI (Miscellaneous), the Parties
may amend the Agreement in whole or in part at any time by filing with the
Agreement a written instrument setting forth such changes signed by both Parties.
The Parties wish to exercise the option to renew the Agreement as set forth in the
above -described request for quotes, and the Parties agree Contractor shall continue to
provide the mowing services for the Richmond Department of Infrastructure and
Development (f/k/a Metropolitan Development) as identified within said Agreement
for the 2017 calendar year. Such services shall be performed at the same rate and in a
manner consistent with Contract No. 40-2016, which is hereby incorporated by
reference and made a part hereof.
2. City and Contractor expressly agree that all other terms, conditions, and covenants
contained in Contract No. 40-2016, shall be applicable to the work performed
pursuant to this Addendum, unless such term, condition or covenant conflicts with
this Addendum Number 1, in which case this Addendum Number 1 shall be
controlling.
Both parties hereby agree that with the exception of extension of the contract date of
termination pursuant to the exercise of the option to renew the contract for a second
year, Contract No. 40-2016 shall remain intact and unchanged and in full force and
effect.

4. Both parties agree that any person executing this Contract in a representative capacity
hereby warrants that he or she has been duly authorized by his or her principal to
execute this Addendum.
